RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS.
Moved by Jack Epple that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the application for:

REQUEST: - A Site Specific Development Plan and a Special Review Permit for a public church with an
associated grass playground area and ball field in the A (Agricultural) Zone District.
LEGAL DESCRIPTION: LotA of RE -1850 being located in part of the SE4 of Section 8, T2N, R67W of the 6th
P.M., Weld County, Colorado.
LOCATION: East of and adjacent to Weld County Road 15-'% , approximately 1/4 mile north of Weld
County Road 22.

be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance, as amended.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
24.3 of the Weld County Zoning Ordinance, as amended, as follows:
A. Section 24.3.1.1 —This proposal is consistent with the Weld County Comprehensive Plan, as
amended. The site is located in the Town of Firestone's Urban Growth Boundary Area as
delineated in the Intergovernmental Agreement signed between Weld County, Firestone,
Frederick and Dacono. UGB.Goal 2 in the Weld County Comprehensive Plan states to
concentrate urban development in or adjacent to existing municipalities and maintain urban
growth boundary areas that provide an official designation between future urban and non -
urban uses. Churches, in nature, are considered urban -type development. A.Goal 3
discourages residential, commercial, and industrial development which is not located adjacent
to existing municipalities. The Town of Firestone has annexed property approximately '/
miles to the west of the proposed site.
B. Section 24.3.1.2 — This proposal is consistent with the intent of the A (Agricultural) zone
district. Public and quasi Public Buildings including churches are allowed in the Agricultural
zone district upon approval of a Special Use Permit.
C. Section 24.3.1.3 —The proposal is consistent with Section 24.3.1.3 of the Weld County Zoning
Ordinance, as amended and will be compatible with existing surrounding land uses. The
proposed site is located adjacent to the east of Enchanted Hills Subdivision. Agricultural
activities are located to the north and south of the site. The use of the church does not appear

to be incompatible with existing uses of the surrounding area. Weld County Road 15'/ is
undeveloped at this time, however, conditions of approval will adequately address the
upgrading of this road to maintain the proposed vehicular traffic.
D. Section 24.3.1.4 — The proposed uses will be compatible with future development of the
surrounding area as permitted by the A (Agricultural) zone districts and with the future
development as projected by the Comprehensive Plan or Master Plan of affected
municipalities. As previously stated, the proposed site lies within the Town of Firestone's
Urban Growth Boundary Area as defined in the Intergovernmental Agreement. The Town of
Firestone has reviewed this request and has indicated that the site is designated as Low
Density Residential in their Comprehensive Plan. The Town has also indicated that religious
institutions are allowed in all land use categories within a Planned Unit Development and
within R-1 provided that there is a one acre minimum lot size and a 50 -foot setback.
E. Section 24.3.1.5— The proposal is located within Town of Firestone's Urban Growth Boundary
area as delineated in the Intergovernmental Agreement Area. The site is not located within
any other Overlay District Areas identified by maps officially adopted by Weld County.
F. Section 24.3.1.6 — The applicant has demonstrated a diligent effort to conserve productive
agricultural land. The site is categorized as non -prime irrigated soils by the USDA Soil
Conservation Service. A large portion of the site is identified on the submitted map as a
grassland play area.
G. Section 2421.7 —The Design Standards (Section 24.5 of the Weld County Zoning Ordinance,
as amended), Operation Standards (Section 24.6 of the Weld County Zoning Ordinance, as
amended), Conditions of Approval, and Development Standards ensure that there are
adequate provisions for the protection of health, safety, and welfare of the inhabitants of the
neighborhood and county.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed on
the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's
Office within 30 days of approval by the Board of County Commissioners. (Planning)
2. Prior to recording the plat:
A. The applicant shall submit to the Department of Planning Services a landscape plan for the
site. The landscape plan shall identify the species name and caliper size of all proposed
landscaping, grass species for the grassland play area, and a maintenance schedule
delineating how the landscaping will be maintained and when it will be installed. The
landscaping plan shall be reviewed and approved by the Department of Planning Services
and the Weld County Extension Agency. (Planning)
B. The applicant shall enter into, and have approved by the Board of County Commissioners, an
Off -Site Improvements Agreement to pave Weld County Road 15'4 and the small section of

Weld County Road 22 from the end of the pavement to WCR 15-1/2,' to the specifications
identified in the referral from Weld County Public Works dated July 25, 1997. (Public Works)
C. The applicant shall enter into, and have approved by the Board of County Commissioners, an
On -Site Improvements Agreement to pave the parking area of the church and to perform any
landscaping identified in an approved landscape plan. The parking area of the church shall
be striped and curbed with adequate spaces to accommodate the membership in accordance
with Section 41 of the Weld County Zoning Ordinance. (Public Works & Planning)
D. The applicant shall submit and have approved, a storm water drainage plan in accordance
with Section 10.12 of the Weld County Subdivision Ordinance. This plan shall be submitted
to Weld County Public Works. (Public Works)
E. The Special Review activity shall not occur nor shall any building or electrical permits be
issued on the property until the Special Review plat is ready to be recorded in the office of the
Weld County Clerk and Recorder. (Planning)
3. The applicant shall submit to the Weld County Building Inspection, two sets of blueprints to determine
the type of construction, occupancy and any other code requirements applicable to the proposed
structures. The foundation and structural plans shall be certified by a Colorado State licensed
engineer.

SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Use Permit is for a public church with an associated
grass playground area and ball field in the A (Agricultural) zone district, as indicated in the application
materials on file in the Department of Planning Services and subject to the Development Standards
stated hereon. (Planning)
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance, as amended. (Planning)
3. No permanent disposal of wastes shall be permitted at this site. (Health Department)
4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions. (Health Department)
5. Fugitive dust shall be controlled on this site. (Health Department)
6. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as measured
according to 25-12-102, Colorado Revised Statutes. (Health Department)
7. The applicant shall provide adequate toilet facilities for the public and employees of the facility. (Health
Department)
8. The septic system is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations. In the event the hydraulic flow
from the septic system is greater than 2,000 gallons/day, the system must be approved through the
site application process in accordance with the regulations for the site application process (5 CCR
1002-12). (Health Department)
9. The site shall maintain compliance with the Mountain View Fire Protection District regulations.

10. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance, as amended. (Planning)
11. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance, as amended. (Planning)
12. Personnel from the Weld County Health Department and Weld County Department of Planning
Services shall be granted access onto the property at any reasonable time in order to ensure the
activities carried out on the property comply with the Development Standards stated hereon and all
applicable Weld County regulations. (Planning)
13. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Major changes from the plans or Development
Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld
County Planning Commission before such changes from the plans or Development Standards are
permitted. Any other changes shall be filed in the office of the Department of Planning Services.

14. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may be
