be recommended favorably to the Board of County Commissioners for the following reasons:
Section 2.E.1 -The existing Comprehensive Plan is in need of revision as proposed. At the time of revision
of the MUD Plan public sewer was not available to service the subject property. Public sewer service can
currently be made available to the subject site from the St. Vrain Sanitation District. The MUD area was
recognized in 1987 in the Weld County Comprehensive Plan as a future urban development corridor within
Weld County. In February of 1997, the MUD area was re-evaluated by County staff and consultants to
formulate the MUD Ordinance(Ordinance 191). Ordinance 191 is intended to guide and implement planned
land use changes in the MUD area. The subject property is approximately 1 mile east of I-25, south of and
adjacent to Weld County Road 28. The surrounding area has experienced recent growth which has occurred
partially through the County and also through the Town of Mead. Inclusion of this property within the MUD
area will ensure that proper measures are taken to impose urban-type standards on development as it occurs.
Staff understands from the application materials that the applicant is proposing to preserve approximately 30%
of the 118 acre site for open space. This area, adjacent to the St.Vrain River, is to be designated as Limiting
Site Factors on Structural Land Use Map 2.1.
Section 2.E.2-The proposed amendment will be consistent with existing and future goals, policies and needs
of the County.
MUD.Goal 1 - To plan and to manage growth within the 1-25 Mixed Use Development area and Urban
Development Nodes so as to balance relevant fiscal, environmental, aesthetic, and economic components
of the area.
The current policy statements and regulations concerning the 1-25 MUD area require environmentally and
aesthetically pleasing designs. All development in the MUD area is required
to address and pay its proportionate share of the impacts created in the community. Future application
proposals will be required to describe, in detail, the impacts of any proposed development of the subject
property.
MUD.Goal 2-To assure a well-integrated, balanced, transportation system which meets the public need with
maximum efficiency, comfort, safety and economy.

The subject property is currently accessed from Weld County Road 28. The potential development of
residential units in this area will undoubtedly require infrastructure improvements. The Weld County Public
Works Department indicated in a referral response dated Apnl 27, 1998 that upon future development of this
property,Weld County Road 28 would be extended as a two-lane Collector status road, requiring additional
right-of-way. Any future development proposals on the site will be required to meet the urban-type design
standards established by the MUD Ordinance, as well as address conditions of approval as required by the
Weld County Public Works Department and the Department.of Planning Services.
MUD.Goal 3-To provide efficient and cost-effective delivery of adequate public facilities and services which
assure health, safety, and general welfare of the present and future residents of Weld County and the area.
The proposal can be served in the future by a public sanitation district(St. Vrain Sanitation) and public water
is also available to the property (Little Thompson Water District). All potential future developments will be
required to connect to these systems. Fire protection in the area is provided by Mountain View Fire Protection
District. Future development applications will be sent to the District for review. The current population size
of the area makes providing private recreational facilities somewhat difficult at this time. However, these
facilities will be addressed at such time in the future that residential development necessitates the
development of these facilities.
MUD.Goal 4-To maintain and improve the existing natural state of the environment.
The addition of the proposed application into the MUD area will not adversely influence the existing natural
environmental resources in the area. Through the proposed inclusion the applicant will be required to adhere
to an expanded level of environmental standards.
MUD.Goal 5-The coordination of other municipal, county, regional, and state growth policies and programs
which include this area should be evaluated in order to minimize discrepancies, promote a better
understanding of growth dynamics in the area, avoid duplication of services and to provide economies of
scale.
The MUD area, in general, is developing at an accelerated rate. The growing population base will encourage
and necessitate increased levels of service. Through the referral of development application materials,
surrounding communities will have the opportunity to encourage a coordinated growth approach to handle
impacts to the area.
MUD.Goal 6-To assure that new development occurs in such a manner as to maintain an attractive working
and living environment.
Through future development applications, any proposed development will be required to adequately satisfy
all goals and policies designed to ensure that an attractive and compatible working and living environment
exists in the MUD area.
MUD.Goal 7 -All new development in the Mixed Use Development area should pay its own way.
Through future development applications, any proposed development is required to address and pay its
proportionate share of the impacts created in the community. Future applications will address this through
improvements agreements and other appropriate mechanisms.

On June 2, 1998, the Weld County Planning Commission recommended approval of
CompAmend 147-O & MUD Amend 191-C, Gerald and Kathryn Hamlin, with the attached
Condition of Approval #1 proposed by staff as follows:
"The applicant shall undertake the process to amend USR-639, J-Bar-B, Inc. Bailey Pit, so that
this USR will not be located on any portion of the subject property."
Staff has since had the opportunity to obtain the files for USR-639 from storage and discovered
that the legal description for USR-639 had been misinterpreted. USR-639 is located on adjacent
property in the NE1/4 and SE1/4 of Section 36, T3N, R68W, while CompAmend 147-O and
MUD Amend 191-C are located in the NW1/4 of the same section. Therefore, Condition of
Approval #1 is not necessary and staff recommends that the condition be removed.

SUBJECT: CompAmend 147-O and MUDAmend 191-C
A request to amend the Weld County Comprehensive Plan and Mixed Use Development (MUD)
Ordinance has been submitted by Gerald and Kathryn Hamlin. The request is to include additional
acreage into the Comprehensive Plan (Ordinance 147) Structural Land Use Map 2.1 and the MUD
Ordinance (Ordinance 191) Structural Land Use Map 2.1. The amendment includes the following
property description: Lots A and B of Recorded Exemption RE-1140, being part of the E1/2 NW1/4
and the NW1/4 NW1/4 of Section 36, T3N, R68W of the 6th P.M. The owners of Lot A of RE-1140,
Chris Edwards and Tiffany Fullerton, submitted a letter dated April 17, 1998, indicating that they
wish for their property to also be included in this proposal as the property is encompassed by Lot
B of RE-1140. The total acreage included in this proposal is 120.073 acres.
Staff has reviewed the proposal based upon the review criteria as stated in Ordinance 147,
Comprehensive Plan Amendment Procedure Section 2.E.1 and 2.E.2 and recommends approval,
with the attached condition of approval, for the following reasons:
Section 2.E.1 - The existing Comprehensive Plan is in need of revision as proposed. At the
time of revision of the MUD Plan public sewer was not available to service the subject property.
Public sewer service can currently be made available to the subject site from the St.Vrain Sanitation
District. The MUD area was recognized in 1987 in the Weld County Comprehensive Plan as a
future urban development corridor within Weld County. In February of 1997, the MUD area was re-
evaluated by County staff and consultants to formulate the MUD Ordinance (Ordinance 191).
Ordinance 191 is intended to guide and implement planned land use changes in the MUD area.
The subject property is approximately 1 mile east of 1-25, south of and adjacent to Weld County

PROPOSAL TO AMEND THE WELD COUNTY
COMPREHENSIVE PLAN
INTRODUCTION
This proposal asks the Weld County Planning Department and the
Board of County Commissioners to consider amending the Weld
County Comprehensive Plan by adding the following described
property to the I-25 Mixed Use Development Area.
The general legal description of the property is :
Lot B of Recorded Emeption No . 1207-36--2-RE1140, being a part of
the E1/2 of the N1/4 and the NW1/4 of the NW1/4 of Section 36 ,
Township 3 North, Range 68 West of the 6th P.M.
This property is approximately 118 acres and is located south of
Weld County Road 28 , between Weld County Roads 11 and 13 .
Presently we farm this property on the areas suitable for
cultivation. There is approximatley 29 acres or 24 . 5% of the
total that is not farmable due to the natural drainage areas ,
wetlands and floodplains of the St . Vrain River which crosses the
lower portion of the property.
Recently we were asked to participate in a trunk line to provide
sewer service from the St . Vrain Sanitation District to our
property and eight other properties that are already included in
the 1-25 MUD (Sections 26 , 35 and 36 ) . The line will further
extend north along I-25 to provide service to existing and new
developments north of Highway 66 .
We hope to continue operating as we are for many years to come,
but our participation in this Sanitation District project is an
opportunity for us to enact long-range planning for future
development . We are making this proposal to amend the Weld
County Comprehensive Plan now in order to ensure a return for our
investment in the trunk line and to plan for the future so that
our property will enhance the neighboring developments in •
accordance with the ideals and constraints established in the
conceptual plan of the I-25 MUD.

STATEMENTS :
THE WELD COUNTY COMPREHENSIVE PLAN IS IN NEED OF REVISION.
The 1-25 MUD plan was originally conceived using the St . Vrain
Sanitation District as a boundary for the urban development area
defined in the comprehensive plan. This property has been
included in the St . Vrain Saniitation District and paying special
district taxes since 1987 . In some drawings , a portion of the
proposed property is already included in the I-25 MUD (See
attached Conceptual Land Use Plan) . However , when the current
Comprehensive Map was drawn, an outdated Sanitation District map
was used that did not include this property. This resulted in the
property being inadvertantly omitted from the present
Comprehensive Plan.
Additionally, this property is currently included in a major
construction project in conjunction with the St . Vrain Sanitation
District . This project affects future development potential of
many properties already included in the MUD. Our participation
is necessary to make the project feasible because of the natural
drainage through our property and and the location of the pumping
station in that drainage basin.
Therefore , we are proposing the plan needs to be revised to
include this 118 acre parcel in the I--25 MUD.
THIS PROPOSED AMENDMENT IS CONSISTENT WITH THE EXISTING AND
FUTURE GOALS , POLICIES AND NEEDS OF WELD COUNTY.
The plan amendment would provide an opportunity to create an
attractive living environment in the future with generous areas
of open space and natural wetlands . With the cooperation of
neighboring properties already within the MUD Area, a
recreational corridor or regional trail system along the St .
Vrain River could provide a system of pedestrian and bike trails
to connect this area with commercial and retail centers located
to the west along 1-25 and Highway 119 . Low to medium density
residential development would complement neighboring properties
already designated as residential in the current plan.
Public facilities and services are available in this area similar
to the existing MUD Area.
Although current use is agriculture, this parcel is not
considered prime agricultural land. It is not highly productive
due to the soil type and steep grade of the land. Grassy open
space areas would prevent erosion and help to maintain and
preserve the habitat areas along the St . Vrain River .

THE AMENDMENT WILL NOT PLACE A BURDEN UPON EXISTING OR PLANNED
SERVICE CAPABILITIES
This property proposed for amendment is both adjacent to and
contiguous with the existing I-25 MUD Area. See the attached
diagram.
ROADS
Weld County Road 28 runs east-west along the entire north side of
this property. Weld County Roads 11 and 13 provide additional
north-south access to the property. These county roads , along
with the I-25 Frontage Road provide access to existing major
roadway corridors , including 1-25 , Highway 66 and Highway 119 .
Additional roads within the future development will be built and
paid for by the developer . The costs of necessary improvements
to the existing county road system to service future needs are
addressed in the current Comprehensive Plan implementing an
impact fee system paid for by the developers .
SEWER
Sewage collection and treatment will be provided by the St . Vrain
Sanitation District which is currently operating at less than 30
percent capacity. A current phase of trunk line construction is
presently being engineered and will be in place by the Fall of
1998 that will provide sewer taps for any development of this
property. Additionally, the St . Vrain Sanitation District is
looking forward to acquiring more land adjacent to their existing
plant to provide for future expansion when necessary. Future
development of this property would improve the financial base of
the District and allow them provide better service to
developments within the MUD area.
WATER
Water distribution will be provided by the Little Thompson Water
District . A six inch water line will be in place along Weld
County Road 28 by the Fall of 1998 that will provide adequate
service to this area. Additional water lines are presently being
engineered and will be installed as the service is required. The
company has other customers in this area. Any further waterline
extensions will be paid for by the developers .
FIRE PROTECTION
The Mountain View Fire Protection District serves this area.
This property is more easily accessed by the Fire Station on Weld
County Road 13 than any other property in the northern areas of
the current MUD. The Fire Station is less than 2 1/2 miles away
and can facilitate a response time of less than five minutes .

LAW ENFORCEMENT
Police protection will be provided by the Weld County Sheriff
Department . A substation is located in the fire station at Weld
County Road 13 , less than 2 1/2 miles away. This station is
staffed by two officers . A new Del Camino Station is planned to
serve the area as growth occurs and supports the need for
additional emergency services .
SCHOOLS
The area is currently served by the St . Vrain Valley School
District . Currently, students in this area attend school at Mead
Elementary, Mead Middle School and Skyline High School , all of
which are at or near capacity. The recently passed school bond
provides for additional classrooms at each of these schools and
construciton of new schools in the Frederick/Firestone area, less
than five miles from this property, to accomodate additional
students from the new and future development in the area.
PARKS AND OPEN SPACE
This area is especially suited to providing areas of open space ,
wildlife habitat and recreational areas to the benefit of this
property and other properties within the MUD area. If this
property is included in the MUD area, a system of trails could be
extended along the St . Vrain River to connect planned residential
areas to the commercial/industrial areas and help to alleviate
dependency on automobiles and encourage pedestrian/bike usage .
OTHER SOCIAL, HEALTH AND CULTURAL SERVICES
Similar to other areas within the MUD, this property depends on
additional services from neighboring communities until the
population within the MUD can support the services within this
area. Longmont , Loveland , Fort Collins , Greeley and the Denver-
Metro area are all within thirty minutes travel time by
automobile and provide activity centers , senior centers ,
recreations centers , libraries , social service agencies , health
facilities , etc .
CONCLUSION
At this time, we are asking that this property be included in the
I-25 Mixed Use Depevlopemnt Area with a land use designation of
residential . Both of the adjacent properties already included in
the MUD Area have the same designation. Although we have no
immediate plans for development , as a medium density residential
development with 30 percent of the 118-acre property set aside
for open space and infrastructure and homes built on 1/3-acre
lots , the build out potential would be approximately 250 homes .
As owners of this property , we respectfully request that you
approve this amendment to the I-25 Mixed Use Development Area.

28 would be extended as a two-lane Collector Status road within the MUD area and additional right-of-way will be

2.1, Structural Land Use Map to the School District. Without information on the number and type of dwelling
units, the student yield cannot be calculated. Please forward this information as soon as it is available. If
there is a residential component, any students living in this subdivision would attend Mead Elementary School
and Mead Middle and Skyline High School under the present school boundaries. However, due to potential growth
in these schools this development and other existing developments in this feeder could be placed in another
attendance area in the future. Bus transportation would be required.

The District is on record as not opposing growth so long as the growth is planned and is manageable from a
student enrollment stand point. While this development's impacts have not been determined, there are other
approved developments in these attendance areas which would, together with this proposal, have a significant
cumulative impact on these schools.
As the volume of development increases in this area, the District is becoming extremely concerned about our
ability to provide the same quality education for these new students that we are providing students in other
areas of the District due to increasingly overcrowded school facilities. If this development does contain a
residential component the District would request the cooperation of the County and the developer in
implementing an agreement to help mitigate this developments impacts on the schools. This agreement would
include the calculation of an appropriate cash in-lieu of land dedication fee to address the school land and
development needs based on this development's number of residential units. Please let me know if I can provide

I have reviewed the submitted materials pertaining to the Comprehensive Plan Amendment requested by
Gerald and Kathryn Hamlin (Case Number: 147-O and 191-C). The property named is within the
boundaries of the Mountain View Fire Protection District and receives service from the District. The Fire
District does not object to the amendment to the MUD, if the subsequent use of the property can meet the
requirements of the Fire District. Based on my review,I have the following comments:
• The water supply to the area will need to meet the required fire flow for the use at the time of
development. Whether a six-inch line is sufficient to provide the required fire flow can be determined
only after the actual uses for the property are known.
• Hydrants meeting the standards of the Fire District will be needed when development occurs in the
area. The number and locations of hydrants can be determined only after the actual uses are known.
• As development occurs,access will need to comply with the requirements of the Fire District.
• Plans for development will need to be submitted to the Fire District for review and approval.

Application has been made to include a parcel of land in the NW quarter of section 36, T3N,
R68W in the Mixed Use Development district. One of the basic objectives of the St. Vrain Rural
Impact District is the retention of some of the agricultural and natural features of this area as
development progresses. It seeks a balance between inevitable urbanizing development and
preservation of the agricultural and natural heritage of the St. Vrain-Boulder Creeks drainage area
east of Longmont. Therefor, the District would appreciate Weld County government considering
the following issues relating to the subject proposal:
Specifically:
1. In the case that Weld County government is favorable to the proposal, that approval be
irrevocably conditional on fulfillment of the application representations as to open space, natural
wetlands, recreational corridor and trail system, preservation of habitats, etc.
2. That alternative agricultural/open space uses for all this land, which reimburse the land owner
for the differential between present use value and that of potential higher uses, be investigated, as
outlined below.
3. That the Dept. of Planning Services undertake a study of agricultural and natural open space
environmental and ecological impacts in this case and in all cases as a standard part of a procedure
to be followed in applications for changes of land use.
In General:
1. That the present Weld County government reflect on the long standing policy, objective and
tradition of Weld County governments for retaining the agricultural character of the County. That
urbanization should proceed only through growth adjacent to municipalities as required by States
statues.
2. That Weld County government actively pursue a program of[a] investigating procedures for
retaining land in its agricultural use or natural state in order to establish a balance between
development and the agricultural/natural character of the area, [b] establish criteria for this
balance, and [c] formally provide for implementation of these procedures. In brief, some of these
procedures might involve conservation easements, TDRs, outright County land purchases
financed by impact fees, GOCO or other grants, sales tax, property tax special district mil levy,
etc.
We appreciate the referrals to the St. Vrain Rural Impact District of applications to Weld
County Planning Services for land use changes and development. We hope the Board , the
Planning Commission and the Dept. of Planning Services will consider the proposals in
this letter in determining the merits of this application for revision of the MUD area,
subsequent development of that additional area if the revision is approved and future
development of other land in the MUD district.

urbanization should proceed only through growth adjacent to municipalities as required by States
statues.
2. That Weld County government actively pursue a program of [a] investigating procedures for
retaining land in its agricultural use or natural state in order to establish a balance between
development and the agricultural/natural character of the area, [b] establish criteria for this
balance, and [c] formally provide for implementation of these procedures. In brief, some of these
procedures might involve conservation easements, TDRs, outright County land purchases
financed by impact fees, LOCO or other grants, sales tax, property tax special district mil levy,
etc.
We appreciate the referrals to the St. Vrain Rural Impact District of applications to Weld
County Planning Services for land use changes and development. We hope the Board , the
Planning Commission and the Dept. of Planning Services will consider the proposals in
this letter in determining the merits of this application for revision of the MUD area,
subsequent development of that additional area if the revision is approved and future
development of other land in the MUD district.

Subject: Hamlin application to increase size of MUD district
Ladies and Gentlemen: RECEIVED
There are a number of issues the Board should consider with respect to further amending
ordinances 147 and 191 for the purpose of again increasing the size of the Mixed Use
Development district. Some of these issues were stated in my letter of February 16, 1998
with reference to the Douthit application. Hopefully, repetition of them, as pertains to this
case, will be more persuasive with the addition of further arguments for denial of the subject
application.
1. The Hamlin property is adjacent to the Town of Mead planning area. In accordance with
the mandate of the Municipal Annexation Act, that urbanization should proceed under the
jurisdiction of municipalities, application should be made to Mead for annexation and zoning
for development. The two IGAs between the County and the Towns of Firestone, Frederick,
Erie [pending] and the City of Dacono whereby owners seeking to develop land are required
to seek an annexation agreement with the appropriate municipality indicates the Board is
aware of and wishes to comply with the intent of the Statute. There appears to be no reason
that this procedure should not apply to the Town of Mead irrespective of the absence of a
formal IGA.
2. An argument is made in the application that inclusion of this property is needed to support
the St. Vrain Sanitation District, as it is currently operating at less than 30% of its capacity.
With the implementation of the impending development of the numerous projects in Firestone,
Frederick and the MUD area, it is apparent that the District's facilities will soon exceed
capacity. Otherwise, how can it be justified that the District is actively pursuing land
acquisition as site for increasing its treatment capabilities. County support and intervention is
no longer needed for the survival of this District. It must plan and coordinate its operations
with the surrounding municipalities to accommodate growth.
3. It is becoming all too apparent the County is unable to support with services the
developments in the MUD district. Neighboring municipalities are continuously called upon to
answer calls the County sheriff's dept. is unable to respond to in a timely and adequate
fashion. The surrounding municipalities, in particular the City of Longmont, must supply
social, cultural, service and shopping facilities without any provision for or support by Weld
County, developers, employers or residents in the MUD district. This lack of support
inconceivably extends to County government's failure to reach agreement with the area school
district to guarantee developer contribution of land or cash in lieu to reduce the impact on the
school system of growth in the area as have the local municipalities. The subject application
admits to this dependence on neighboring communities for all the services not available in the
MUD area.
4. As indicated above, County government is unnecessarily usurping the statutory role of
municipalities in urban development under Weld County auspices and at the same time not
providing the services and infrastructure to support this growth.
If the Board decides pursue amending the above ordinances as requested in the application, it
might consider the following:
1. Several representations have been made in the application as to future development of the
property. These include lot size [variously described as low and medium density], use,
provision for open space, trail systems, infrastructure, and timing for development. To insure
that these assurances are implemented as proposed, they should be made conditions of any
approval of amending the subject ordinances.
2. County government should closely examine the alleged necessity, alternatives and
circumstances of the applicants participation in the new sewer line project feasibility as an
argument for increasing the MUD district.
It is hoped that the BOCC will accept these comments as constructive input in their
consideration of this application and the future of the MUD in general.
