HomeMy WebLinkAbout971013.tiffBEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Cristie Nicklas that the following resolution, with the deletion of Condition of Approval #2d, and changes to Condition of Approval #3b, be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: S-418 APPLICANT: Flatiron Structures Company do Quinlan Construction Inc. PLANNER: Gloria Dunn ADDRESS: 5540 Central Avenue, Boulder, Colorado 80301 REQUEST: A Site Specific Development Plan and Planned Unit Development Final Plan foi• C-3 Commercial) uses. LEGAL DESCRIPTION: Lot 2 of RE -1201 in part of the W2 SW4 of Section 11, T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: East of and adjacent to I-25 Frontage Road; north of Weld County Road 22. PARCEL NUMBER: 131311000067 be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 28.9 of the Weld County Zoning Ordinance, as amended. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 28.13.1 of the Weld County Zoning Ordinance, as amended, as follows: a. Section 28.13.1.1 The proposal is consistent with the Weld County Comprehensive Plan. The applicant has demonstrated that the proposed P.U.D. Final Plan meets the Mixed Use Development, Planned Unit Development and Commercial goals and policies of the Weld County Comprehensive Plan. b. Section 28.13.1.2 The P.U.D. Plan conforms to the approved P.U.D. District in which it is proposed to be located. The subject property shall be required to maintain compliance with the standards of Sections 28 and 32 of the Weld County Zoning Ordinance, as amended, as well as the requirements of Ordinance 191. In addition, the utility plan for the P.U.D. was conditionally approved by the Weld County Utility Coordinating Advisory Committee on March 13, 1997. c. Section 28. 13.1.3 The uses, buildings and structures which would be permitted shall be compatible with the existing or future development of the surrounding area as permitted by the existing zoning, and with the future development as projected by the Comprehensive Plan or master plans of affected municipalities. The proposed P.U.D. Final Plan is compatible with the future development as permitted by the P.U.D. District and plans of affected municipalities. The City of Longmont, Town of Mead and the Tri-Area Planning Commission reviewed the request and have no objection to the land use as proposed. 971013 RESOLUTION, S-418 Flatiron Structures Company, do Quinlan Construction, Inc. Page 2 d. Section 28.13.1.4 P.U.D. Plan conforms with the Performance Standards outlined in Section 35.3 of the Weld County Zoning Ordinance, as amended. Prior to the development of Lots 1, 3, and 4 of the Flatiron P.U.D., completion of a Site Plan Review application as set forth in Section 23 of the Weld County Zoning Ordinance, as amended, will be required. e. Section 28.13.1.5 There will be compliance with Section 50, Overlay Districts, of the Weld County Zoning Ordinance, as amended. The property is not located within any of the Overlay Districts. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. Prior to approval of the Improvements Agreement According Policy Regarding Collateral for Improvement by the Board of County Commissioners, the agreement shall be amended to identify Flatiron Structures Company LLC as the entity responsible for installation and maintenance of the landscape materials listed in the agreement and as shown on the landscape map. 2. Prior to recording the P.U.D. Final Plan plat: a. The Board of County Commissioners shall review and approve the Improvements Agreement According Policy Regarding Collateral for Improvements (Private Road Maintenance) including the form of collateral. The security for the agreement shall be tendered and accepted by the Board of County Commissioners. b. The Flatiron P.U.D. Covenants shall be approved by the Weld County Attorney's Office and be ready for recording in the Office of the Clerk and Recorder. c. The P.U.D. Final Plan plat shall be amended as follows: I. Interior lot line utility easements, minimum total width of twenty (20) feet apportioned equally on abutting properties, shall be shown on Lots 1, 3 and 4, as required by the Utility Coordinating Advisory Committee. II. The landscape map shall clearly identify the easement and detention pond areas for use as open space on the site. The mylar copy shall delineate the species, number and location of landscape materials to be installed by the property owner at the entrance to the P.U.D., as required in Sections 28.11.4.2 through 23.11.4.7 of the Weld County Zoning Ordinance, as amended. 3. Prior to the release of any future building permits within the Flatiron P.U.D.: a. Evidence that all requirements of the St. Vrain Sanitation District, as stated in a letter from Lee Lawson dated February 3, 1997, have been satisfied shall be provided to the Department of Planning Services. -371410 RESOLUTION, S-418 Flatiron Structures Company, c/o Quinlan Construction, Inc. The property owner/developer shall have an off -site road agreement addressing construction of public improvements on the east I-25 Frontage Road reviewed and approved by the Colorado Department of Transportation and the Weld County Attorneys Office. The agreement and form of collateral shall be accepted by the Board of County Commissioners and security tendered. 4. The following notes shall be placed on the P.U.D. Final Plan plat prior to recording: a. The uses permitted within the P.U.D. Plan for Flatiron Structures Company include 4(four) lots for C-3 (Commercial) uses which comply with P.U.D. District requirements and as described in the application materials. b. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended. c. Central Weld County Water District shall provide water service to all uses within the Flatiron P.U.D. d. St. Vrain Sanitation District shall provide sewage disposal to the Flatiron P.U.D. e. Installation of all utilities shall comply with Section 10, Design Standards, of the Weld County Subdivision Ordinance, as amended. f. All uses within the Flatiron P.U.D. shall maintain compliance with the Mountain View Fire Protection District requirements. g. A 30 (thirty) -foot shared access easement (Book 1246, Reception No. 02193215, 9/29/89) from I-25 Frontage Road shall provide ingress and egress to the property. h. The cul-de-sac within the Flatiron P.U.D. is private and shall be built to County standards. The cul-de-sac shall be maintained by the lot owners or developer. i. All uses within the Flatiron P.U.D. shall maintain compliance with the Colorado Department of Transportation requirements . j. All uses within the Flatiron P.U.D. shall maintain compliance at all times with the Department of the Army, Corps of Engineers requirements and standards. k. All development shall be subject to the P.U.D. District requirements as set forth in Z-495, approved by the Board of County Commissioners on July 12, 1995. I. The Flatiron P.U.D. shall comply with signage and setback requirements as set forth in Ordinance 191 and Section 42.3 of the Weld County Zoning Ordinance, as amended. m. Prior to the development of any lot within the Flatiron P.U.D., a Site Plan Review application shall be submitted to and approved by the Department of Planning Services and all conditions met, in accordance with Section 35.4 of the Weld County Zoning Ordinance, as amended, and Ordinance 191. 971013 RESOLUTION, S-418 Flatiron Structures Company, do Quinlan Construction, Inc. Page 4 n. In accordance with the submitted application materials, open space/landscape area per lot shall be equal to (meet) or exceed: Lot1: 26% Lot 3 18% Lot 4 23% o. All requirements of the St. Vrain Sanitation District regarding completion of the sewer line shall be met prior to the release of any future building permits within the Flatiron P.U.D. Prior to the issuance of each building permit, the Flatiron P.U.D. Architectural Control Committee shall provide a letter to the Department of Planning Services indicating its approval of the proposed structure. All construction on site shall meet the requirements of the Weld County Building Inspection and Public Works Departments, the Weld County Zoning and Subdivision Ordinances, as amended, and the approved covenants. 5. The P.U.D. Final Plan plat shall meet all requirements of Section 28.11.5 as set forth in the Weld County Zoning Ordinance, as amended, and be submitted to the Department of Planning Services within 30 days of approval by the Board of County Commissioners.
