MP y o L V 5- 11_Q &;.P. a (Decision No. 18096) • _ BEFORE THE PUBLIC UTILITIES COLTISSION I - OF THE STATE OF COLORADO • IN THE MATTER OF THE APPLICATION OF ) - THE BOARD OF COUNTY COIJISSIONE S OF ) _ ;7FESZD COUNTY,_ COLCRADO,_FOR .RELOCATION ) , _ _ _ _ OF A LADE-CROSSING OVER THE .TRACK of.. )- THE UNION PACIFIC RAILROAD-COMPANY AT ) - APPLICATION NO. 5808 DOVER STATION TO -A POINT OF INTERSEC- ) TION OF THE NORTH LINE OF.SECTION 6, ) TOWNSHIP 9, RANGE 66 WEST WITH-SAID ) RAILROAD TRACK. -- - • - ) January 8, 1942 - STATEMENT By the Commissions On November 21, 1941, the Board of County Commissioners of Weld County, Colorado, filed in application with the Cownission,for tho relocation of the grade crossing across the tracks-af the Union-Pacific Railroad .COMpany at a station known as Dover, Colorado, to a point where the/north line of Section 6; Township 9, Range 66 West of the 6th P. M.- intersects the main line track of said railroad. The application alleged that the Commissioners wore making the appiica- tion in compliance with a petition signed by numerous residents of. the adjacent communities of Dover and which they had favorably-considered. Said petition was attached to application and set out as reasons for a change in location of the grade crossing at Dover 'that the change was necessary to have the crossing on'the line of the public highway-between U. S. Highways Nos. 85 and 87 and extending along the north lino of said Township No. 9, Range 66 West of the Gth P.14. so as • to avoid the necessity for persons traveling on said public highway to make a detour one—half mile south to the present crossing at Dover station. It was -claimed this change in location would be a great convenience to the farmers and ranchers in that section of the-state and would also be a great convenience to tourists using the said connecting public highway. A copy of the application was' duly served onthe Union Pacific Railroad Company, and on December 8, 1941, the Commission received from the General /a;, 1 `l`6 • Attorney' for the railroad company an answer to the application, copy of. which was -sent to the County Attorney of Weld County. The answer stated that the Company would have no objection to the relocation of said crossing as desired, provided that, the Company would not have to bear any of the expense involved in the change in location of crossing and also that the County provide and maintain-an adequate • thoroughfare for ingress and egress to and from industries located on the east side of the track at the Dover station. - . ' A reply to the aforesaid letter was received from the County Attorney . by the. Commission on December 15, 1941, advising the Commission that the County Commissioners of Weld County accepted the stipulation of the Company as to the • provisions for adequate public thoroughfares to the industries located on the past side of the track at Dover. station.- No mention uas made in this letter of • the matter of the-necessary expense required to bake the change in the location of the crossing as desired, but ae the change in location of the crossing is entirely for the convenience' of the public, as stated in the petition and application, it is understood that the County does not cuestion its responsibility in this. At any rate, that would be the opinion of. the Commission and will be so specified in the order. The Commission, therefore, finds that the proposed change in location of - the grade crossing at Dover station,in: a public convenience and necessity and sine it appears that all concerned in matters involved in the .change are in agree- ment, the Commission -will, without any further proceedings, make its order accord- ingly. O RDER - IT ,IS THEREFORE ORDERED, That in compliance with Section -29 of the Public Utilities Act, an. amended, a-change-in--the- location of the grade crosdinj—at the Dover station of the Union Pacific Railroad -CompPny to a point -whore-the north line of Section Six (6), Township Nine (9), Range Sixty—six (66) , West of the 6th P. U. intersects the main line track of said railroad, be, and the same is hereby, per— ' -- witted -to be made as desired; provided, however, that prior to the opening of the said grade crossing to public travel in the new location, it shall be -constructed_ in accordance with the Commission's plans and specifications as provided in Case No. 879. - - - /OFi/57/ f3 • IT IS FURTHER ORDERED That the County of Weld, Colorado, shall betr, all the expense incident to the aforesaid change in location of said crossing. We the undersigned citizens and tax-payers of the District of Dover, Colo . humbly reguest that your honorable board consider the question of opening or extending the road now running. to the Rail Bond tracks from the West , on the South line of Section 31 and North line of Section f-11-BG , with a -Rai high-way over Fast . This will do away with the present danger at the crossing now used North of the Section rouse , and also the delays caused by freight trains stopping on this present crossing, and holding up traffic some time for ten or fifteen minutes .
