RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOHN AND NORMA HOGARTH FOR VIOLATION OF
THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, John and Norma Hogarth, VI #9600271, are allegedly in violation of the
Weld County Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of February, 1998, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, John and Norma Hogarth, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until March 13, 1998, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against John and Norma Hogarth to remedy the violation of the
Weld County Building Code and Zoning Ordinances, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties, with an instruction for delay of action upon such referral until
March 13, 1998, to allow adequate time for the property owners to bring the subject property
into compliance.

CASE SUMMARY
October 2, 1995 Letter sent to the property owner addressing the need for zoning and building code
compliance.
October 3, 1996 Complaint referred to Julie Chester, Zoning Compliance Officer.
November 6, 1995 Building permit and certificate of compliance were applied for a mobile home, blocked
and tied, to be used as a principal dwelling.
September 12, 1996 Letter sent to property owner requesting him to schedule the remaining inspections and
final the permit.
December 5, 1997 Violation letter sent addressing the following required inspections: electric, plumbing,
skirting, steps and landings, water service, gas and mechanical.
January 30, 1998 Progress inspection of the property. Property is still in violation./
January 30, 1998 Letter sent to property owner notifying of impending violation hearings scheduled
before the Board of County Commission on February 10, 1998 at 10:00 a.m.
The mobile home without final inspections is in a state of disrepair and still located on the property, therefore is
a violation of Sections 43.2.7.5 and 43.2.7.8 of the Weld County Zoning Ordinance and Sections 20.9.1.1,
20.9.3, and 70.4.2 of the Weld County Building Code Ordinance. To bring the property into compliance the
mobile home will have to be brought into compliance or removed from the property.
The Department of Planning Services also recommends that the County Attorney authorize legal action against
any other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled a
meeting with the Board of County Commissioners on February 10, 1998 at 10:00 a.m. to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, first floor,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation, and that you

Dear Mr. Hogarth:
The Weld County Building Code Ordinance requires that the installation of mobile homes be
completed within 180 days of the date of issuance of the building permit. The Building Permit
issued for this property has not had the final inspection called for or completed within the
required 180 day period.
This violation can be corrected by calling for and passing the final inspection for the following
items: electric, plumbing, skirting, steps and landings, water service, gas and mechanical.
It is the intention of this office to assist and cooperate with you without imposing undue
hardships, however, we have no discretion in this matter if you fail to correct this violation by
calling for the final inspections for this mobile home. You have until January 4, 1998, to correct
this violation. Failure to do so will result in this office scheduling the violation before the Board
of County Commissioners to consider whether to refer the violation to the County Attorney's
office for legal action.

Dear Mr. Hogarth:
The Depailnient of Planning Services staff reviewed your letter along with the Weld County Zoning
Ordinance ( Section 42.2.7 )and determined that the use of the existing mobile home as a
recreational budding and the addition of a second mobile as a principle residence will require the
submittal, review, and approval, of a certificate of compliance for an accessory structure. The
placement of the second mobile on the property will also require obtaining a building permit and
complying with the installation standards of the Weld County Building Code Ordinance. All offsets
and setbacks must be met on both structures and the accessory structure may not be used on any
basis as a dwelling or as overnight or temporary housing for any person. Electricity is the only utility
which is permitted to be connected to the accessory structure. I have enclosed a copy of the
certificate of compliance for your review and submittal.

I,the undersigned, understand and agree to the conditions of this Zoning Permit which are as follows:
1. Only one zoning permit for a manufactured home or mobile home used as an accessory structure may
be issued per legal lot at any one time by the Department of Planning Services.
Further, I,the undersigned, meet the following conditions which are required to be eligible for this permit.
2. The applicant must obtain a building permit for the manufactured home or mobile home and must
comply with all installation standards of the Weld County Building Code applicable to manufactured
homes or mobile homes. Electricity is the only utility which is permitted to be connected to the
