Box 169 Sterling, Colorado 80751 RE: USR-540 Northern Colorado Brine Dear Mr. Boatright: The Department of Planning Services is in receipt of a letter from Ms. Jacqueline Johnson, on behalf of Northern Colorado Brine, requesting an extension of one year to the aforementioned USR-540. After consulting with legal staff and the Weld County Health Department, the Department of Planning Services has determined that the request for extension is a substantial change to the original Use by Special Review resolution and Certificate of Designation, and thus would require an amendment to both the existing USR and Certificate of Designation. An application for amendment would require the applicant to submit a new USR application and Certificate of Designation for review and consideration, including public hearings and review by the Colorado Department of Public Health and Environment. The procedure to amend an existing USR for Solid Waste Disposal Sites and Facilities is the same as a new application, including the application fee which is not to exceed $17,114.00. APR 301998 Department of Planning Services top Weld County Ca b v 1400 N. 17th Avenue Greeley, CO 80631 Re: USR 540-83-3; Northern Colorado Brine Dear Sir or Madam: We represent Northern Colorado Brine with regard to the above-referenced Use by Special Review. It is our understanding that the Certificate of Designation for the Northern Colorado Brine facility will expire on December 31, 1998. The purpose of this letter is to request an extension of one year, until December 31, 1999, to enable Northern Colorado Brine to identify and purchase property on which to develop an injection well disposal system. Mr. Cervi,who holds the USR,and his agent,Howard Boatright,expect to locate and purchase land suitable for an injection well disposal system within four to six weeks. They must then get the necessary permits, both from Weld County and from the Colorado Oil and Gas Conservation Commission. They anticipate that it will take them between four to six months to complete the permitting process. Thereafter, depending upon the availability of a drilling rig, they will drill the injection wells and perform the necessary testing, a process that will take approximately thirty to forty-five days. Finally,they will need six to eight weeks to move equipment from the current site at Northern Colorado Brine to the new disposal site. As you can see, it will take almost twelve months to accomplish the transfer from the current site to a new injection disposal facility. A one-year extension would enable Mr. Cervi to maintain the income from the current site during a period of time when he will be required to make substantial financial investments in the new site. Additionally, it will ensure that there is sufficient disposal capacity available to the oil and gas industry's operations in Weld County.
