HomeMy WebLinkAbout970569.tiffRESOLUTION RE: APPROVE CHANGE ORDER LETTER BETWEEN COMMUNITY CORRECTIONS BOARD AND COLORADO DEPARTMENT OF PUBLIC SAFETY, DIVISION OF CRIMINAL JUSTICE, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Change Order Letter between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, for the period commencing July 1, 1996, and ending June 30, 1997, with further terms and conditions being as stated in said letter, and WHEREAS, after review, the Board deems it advisable to approve said letter, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Change Order Letter between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said letter. CO 00215-5965 (903) 239-4442 FAX (303) 239-4491 Pursuant to paragraph 1.A.4 of the contract between the Department of Public Safety, Division of Criminal Justice (DCJI, and the Board of Commissioners of Weld County, on behalf of the Weld County Community Corrections Board, DCJ hereby notifies you that the maximum amount payable from the State under Contract # 97000000041, covering the period July 1, 1996 through June 30, 1997, is hereby increased by $68,211. These additional funds are for community correctional services and may not be used for administrative expenses. The maximum amount payable for: 1) Diversion non-residential placements not to exceed an average of $5.12 per day per offender is hereby increased by S 68,211 to a new total of S 146,701. The per diem rates remain unchanged. The effected lines of paragraph 1 .A.2 of Contract #97000000041 shall now read: " S 146.701 for diversion non-residential placements at no more than 5257.00 per month per offender, not to exceed an average of 35.12 per day per offender." This amendment to the contract is intended to be effective March 18, 1997, but in no event shall this amendment be deemed valid until it shall have been approved by the State Controller or his designee. As you know, in response to requests for additional Community Corrections program funds for the current fiscal year, the Department of Public Safety's Division of Criminal Justice vigorously pursued and gained additional funding through the Supplemental Budget Process. It has been the position of the Division of Criminal Justice, since the inception of this process, that additional administrative funds will not be included in the amended contracts made as a result of the availability of supplemental funds. However, some Boards have asked us to modify this position. The Director of the Division, pursuant to statute, may review, accept, amend, or reject, at his sole discretion, any request for additional administrative funds. In order for a request for administrative funds to be considered, the following conditions must be met. 1) Any Board requesting additional administrative funds must account for the expenditure of administrative dollars received under the original contract. The accounting must be in the form of a verified audit, or a verified and detailed financial summary, and be submitted under the signature of the Community Corrections Board Chairperson. In this instance, verified means attested to and signed by the Board Chairperson; an independent audit by an outside agency is not required. 2) Any Board requesting additional administrative funds must provide convincing documentation and arguments that exigent circumstances created the need for more administrative dollars. 3) The requested amount of administrative funds, not to exceed 5% of the total of your requested funds, must be made in the form of a detailed and verified budget (attested to and signed by the Board Chairperson) Home Page: wwwstate.co.us/gov_dir/cdpsrdcj.Mm E -Mail: wwoodwar@safety.state.co.us 970569 that specifies exactly how the administrative funds will be used during the remainder of the fiscal year (through June 30, 1997). 4) Any request for additional administrative money from the supplemental appropriation shall be made within 10 working days of your receipt of this letter. The request must be in writing, and signed by the Community Corrections Board Chairperson. Boards not wishing to make a request for administrative funds may sign and return the enclosed Change Order Letter. By signing and returning the Change Order Letter, without a request for administrative funds as set out above, any boards who may have indicated a prior intention to expend additional administrative funds, contrary to the stated policy position of the Division, acknowledge that they will not use any of the awarded funds for such administrative purpose. We appreciate the support of the local Community Corrections Boards and the local programs in our efforts to obtain additional program funds for community corrections. We believe the additional funds enhance our ability to meet the service needs of community corrections clients in your local community and throughout the state. Baxter, Chair, Board of County Commissioners FROM: Jan Allison Spangler, Administrative Assistant SUBJECT: Change Order Letter, Division of Criminal Justice The Weld County Community Corrections Board has received a Change Order Letter from the Division of Criminal Justice. This Change Order is for the contract between the Department of Public Safety, Division of Criminal Justice and the Board of Commissioners of Weld County on behalf of the Weld County Community Corrections Board. This is in regard to the Diversion Non-residential placement funding increase of $68,211. I have attached a cover letter dated March 18, 1997 from Edward J. Camp, that will provide additional information. I am respectfully requesting that the Board of Commissioners add the signing of this Change Order to their meeting agenda for March 31, 1997.
