HomeMy WebLinkAbout970384.tiffBEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Jack Epple that the following resolution be introduced for passage with the addition of Condition of Approval #1e, by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: Z-501 NAME: Marilyn Taylor PLANNER: Todd Hodges rn t7 cr- • c. ^ ADDRESS: 7505 Weld County Road 39, Ft. Lupton, CO 80624 REQUEST: A PUD Change of Zone from A (Agricultural) to PUD (Planned Unit Development) fee an airpark with 39 hanger lots and one residential lot. LEGAL DESCRIPTION: A parcel located in Sections 30 and 31, T2N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: 1/2 mile south of Weld County Road 18; west and adjacent to Weld County Road 39. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 28.5 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 28.7 of the Weld County Zoning Ordinance as follows: a. Section 28.7.1.2 -- The request is consistent with the Weld County Comprehensive Plan. The proposed Planned Unit Development District is located within the referral area of the City of Fort Lupton and the Town of Hudson. The City of Fort Lupton reviewed this proposal and indicated no problems. b. Section 28.7.1.3 -- The uses allowed in the proposed PUD District will conform with the performance standards contained in Section 35.3 of the Weld County Zoning Ordinance. The existing residential structure and the flight tower is served by a well and a septic system. c. Section 28.7.1.4 --The residential and open space uses permitted by the Planned Unit Development District will be compatible with the future development of the surrounding area as permitted by the existing agricultural zoning and with the future development of the affected municipalities. Ft. Lupton reviewed this proposal and indicates no concerns. d. Section 28.7.1.5 -- Adequate water and sewer will be made available to the site to serve the uses permitted within the PUD District. The uses are existing that require the water and sewage disposal. The one existing residence and the tower are served by a well and individual septic systems. The hanger lots will not require additional water or sewage disposal. e. Section 28.7.1.6 -- Weld County Road 39 will provide access to the PUD District. The Weld County Department of Transportation reviewed this request and indicates that the roads providing access are adequate for this proposal. 970384 RESOLUTION, Z-501 Marilyn Taylor Page 2 f. Section 28.7.1.7 -- The Planned Unit Development District site is not located within the Flood Hazard or Geological Hazard Overlay Districts. The Army Corp of Engineers reviewed this proposal and indicate that this proposal will not require a Department of Army (DA) Permit. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: Prior to recording the Change of Zone plat: a. The applicant shall submit written evidence to the Department of Planning Services that this proposal meets the requirements of the Hudson Fire Protection District. b. The applicant shall submit written evidence to the Department of Planning Services that the existing well is permitted for the existing and proposed uses. c. The Change of Zone plat shall meet all requirements of Sections 28.5.2 and 28.5.3 of the Weld County Zoning Ordinance. The amended Change of Zone plat shall be submitted to Department of Planning Services for review and approval. e. Prior to recording the plat the application shall submit to the Department of Planning Services written evidence that an agreement has been made with Patina Oil and Gas Company concerning access and operations. 2. The PUD Change of Zone is conditional upon the following and that each be placed on the Change of Zone plat as notes prior to recording: a. The PUD District allows for an airpark with one (1) residential outlot including the runways and the control tower and thirty-nine (39) hanger lots. The PUD District shall comply with the PUD zone district requirements as set forth in Section 28 of the Weld County Zoning Ordinance. b. Water for the site shall be provided by an existing well and sewage disposal shall be provided by two (2) individual septic systems. c. The site shall maintain compliance, at all time with the requirements of the Federal Aviation Administration. The site shall maintain compliance, at all times, with the Hudson Fire Protection District requirements. e. The outlot area may be used for agricultural production provided that the production does not interfere with the airstrip and associated uses. f. Installation of utilities shall comply with Section 12 of the Weld County Subdivision Ordinance. 970284 RESOLUTION, Z-501 Marilyn Taylor Page 3 g. An airport employee shall be on duty during hours of operation. The employee shall be responsible for supervising the airport operation, including the administration and interpretation of all regulations and standards associated with this airpark. The Change of Zone plat shall be submitted to the Department of Planning Services within 30 days of approval by the Board of County Commissioners. Motion seconded by Cristie Nicklas. The existing permit allows a maximum of 80 aircraft and a total of 8 hangers on the site. 970384 Hello
