Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Scott Ballstadt Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 20, 1997, and duly published August 28, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Kauffman Land and Development for a Site Specific Development Plan and Second Amended Special Review Permit #894 for a two -acre increase of an existing oil and gas support and service operation and contractor's shop for vehicle and equipment maintenance relating to those activities, as well as the construction of an addition to the existing shop building, the construction of an additional shop building, and the construction of a permanent office to replace the existing mobile home. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt stated the property was used for oil field support services from 1969 to 1989, at which time USR #894 was approved for decorative rock fabrication. In 1992, the permit was amended to the current use. Mr. Ballstadt stated the site is located within the Town of Firestone's Urban Growth Boundary and the Tri-Area Intergovernmental Agreement; however, since the proposal is for the expansion of an existing facility instead of a new facility, the annexation agreement is not necessary. Mr. Ballstadt also included language for proposed Condition of Approval #3.H requiring an additional ten feet of right-of-way reservation for future expansion of Weld County Road 19 since it is classified as a collector road. Molly Sommerville, Attorney, represented the applicant and stated in 1996 the three -acre site was separated from the larger parcel as Lot A of Recorded Exemption #1921. This amendment proposes to increase the site to five acres, add to the existing shop building, construct an additional 971986 PL0624 HEARING CERTIFICATION - KAUFFMAN LAND DEVELOPMENT (2ND AMENDED USR #894) PAGE 2 shop building, and replace the existing mobile home with a permanent office. Ms. Sommerville noted this proposed amendment does comply with Section 24.2.1 of the Zoning Ordinance, and stated Mr. Kauffman is willing to comply with all the proposed Conditions of Approval and Development Standards. In fact, she stated, some have already been completed and others are underway as personnel from Kauffman Land and Development have already met with Health Department staff regarding the drainage and air pollution standards. There being no public testimony offered concerning this matter, Commissioner Hall moved to approve the request of Kauffman Land and Development for a Site Specific Development Plan and Second Amended Special Review Permit #894 for a two -acre increase of an existing oil and gas support and service operation and contractor's shop for vehicle and equipment maintenance relating to those activities, as well as the construction of an addition to the existing shop building, the construction of an additional shop building, and the construction of a permanent office to replace the existing mobile home, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and the addition of Condition of Approval #3H. The motion was seconded by Commissioner Harbert, and it carried unanimously. This Certification was approved on the 15th day of September, 1997.
