RE: ACTION OF THE BOARD CONCERNING A SITE SPECIFIC DEVELOPMENT PLAN
AND SPECIAL REVIEW PERMIT#1211 FOR AN INDUSTRIAL USE (RECYCLING
FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - MARY ROBERTS AND
JEREMIAH WICKHAM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 12th day of May, 1999, at 10:00 a.m. for
the purpose of hearing the application of Mary Roberts and Jeremiah Wickham, 2324 Elmira
Street, Aurora, Colorado 80010, requesting a Site Specific Development Plan and Special
Review Permit #1211 for an Industrial Use (recycling facility) in the A (Agricultural) Zone District
for a parcel of land located on the following described real estate, to-wit:
Part of the SW% of Section 31, Township 1 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing on May 12, 1999, the Board deems it advisable to continue
said matter to May 17, 1999, at 10:00 a.m., to allow the applicant adequate time to provide
documentation of ownership, and
WHEREAS, at said hearing on May 17, 1999, the applicant was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be denied for the following
reasons:

1. That the uses which would be permitted will not be compatible with the existing
surrounding land uses in accordance with 24.4.2.3 of the Weld County Zoning
Ordinance.
2. That there is not adequate provision for the protection of the health, safety and
welfare of the inhabitants of the neighborhood and the County in accordance
with Section 24.4.2.7 of the Weld County Zoning Ordinance. This is in large part
because there is a lack of clarity as to who is responsible for agreeing to and
meeting the Operation Standards and Conditions of Approval of the proposed
Use by Special Review Permit and whether the party appearing before the Board
had authority to speak on behalf of the applicant. Also the party before the Board
expressed the financial inability to operate under the current financing for the
property.

3. The application is not consistent with the Section 24.5.1 of the Weld County
Zoning Ordinance, Design Standards namely that the applicant was unable to
demonstrate compliance with those standards.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Mary Roberts and Jeremiah Wickham for a Site
Specific Development Plan and Special Review Permit#1211 for an Industrial Use (recycling
facility) in the A (Agricultural) Zone District on the above referenced parcel of land be, and
hereby is, denied.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of May, A.D., 1999.
