Prior to recording the Site Plan Review plat, the applicant shall address the following to the Department of Planning Services' satisfaction: a. The plat shall be amended to delineate the following: 1) The parking area for the parcel shall be redesigned to accommodate the sixteen (16) foot wide access easement extending north to south adjacent to the east property line. This easement provides access to Patina Oil&Gas to service their operations on Outlot "J" and will provide access to future landholders should Patina Oil & Gas cease operations. This easement is delineated on the Final Plat, First Filing for Vista Commercial Center. (Dept. of Planning Services) 2) In accordance with Section 2.6.3.1 of the Mixed Use Development Plan, that states "ten percent (10%) of the parking area shall be landscaped if the lot contains ten (10) or more spaces." Your parking requirement is for twelve (12) spaces based on the information provided in your application materials; the plan submitted has delineated nineteen (19) spaces. (Dept. of Planning Services) 3) In accordance with Section 2.6.3.2 2 of the Mixed Use Development Plan, earthen berms with tree and shrub plantings shall be used to screen parking lots from view of the roadway. (Dept. of Planning Services) 4) In accordance with Section 2.6.3.4 of the Mixed Use Development Plan that states "trees planted in the parking area should either be in bays or planting islands of at least five feet by five feet (5' x 5')." (Dept. of Planning Services) 5) The service and storage area shall be screened in accordance with Section 33.4.3.2 of the Weld County Zoning Ordinance and Section 2.6.3#5 of the Mixed Use Development Plan which states, "loading, service, or storage areas must be screened with an opaque screen that is an integral part of the building architecture. Chain link fencing with slats or pallets are not an acceptable screening material. Plant material shall be used to soften the appearance of the screen". (Dept. of Planning Services) 6) Appropriate landscaping of a lot that abuts a public or private road right-of- way in accordance with Section 2.6.4 #2b of the Mixed Use Development Plan (Ordinance 191). (Dept. of Planning Services) 7) The applicant shall adhere to all applicable standards addressed under the American for Disabilities Act(ADA), specific to parking, ramping, and ingress and egress of all man doors. (Dept. of Planning Services) 8) The applicant shall place a typical cross-section of the parking lot on the plat and identify the depth of base and concrete or full depth concrete according to the Weld County Subdivision Ordinance, Sections 10.2.3 and 10.2.4., Geometric Design Standards and Road Structures. (Dept. of Planning Services) 9) The plant material or mulch for the area occupying the perimeter of the property shall be described on the plat. The applicant shall describe the maintenance plan for this area. (Dept. of Planning Services) 10) As described in Section 2.6.2#4 of the MUD Ordinance, the applicant shall delineate an opaque visual screen on the south, west and east sides of the property to mitigate the potential negative impact to the surrounding property. The applicant shall augment the visual screening should it be determined that the screening is not effective once the equipment is on site. (Dept. of Planning Services) 11) The low profile free standing monument sign shall be constructed in accordance with the Design Standards of Section 2.8.4.3.f which states, "momument signs shall have an enclosed, solid base or structural base with the base at least three-fourths the wifth of the widest past of the sign face. An enclosed or solid sign base shall not be required if the lower edge of the sign face is not higher than one foot above finsihed grade. Monument signs shall be on-premise signs, the sign area shall not exceed twenty-five (25) square feet, and the sign shall not exceed five (5) feet in height above the average adjacent grade, if located within fifteen feet from the street right-of- way. For each addtional two feet of setback from the street right-of way, one additional foot may be added to the height of the sign to a maximum of eight feet." (Dept. of Planning Services) 12) The applicant shall adhere to the lighting standards, in accordance with Section 23.2.1.21.6 of the Weld County Zoning Ordinance (Ordinance 89, as amended). (Dept. of Planning Services) 13) The trash receptacle south of and immediately adjacent to the building shall be screened. This shall be delineated on the Site Plan. (Dept. of Planning Services) 14) The applicant shall delineate the location of the proposed transformer in the parcel. (Dept. of Planning Services) 15) The applicant shall delineate concrete pads at the west ingress/egress doors from the building. All concrete pads shall be a minimum of three feet by three feet in size. (Dept. of Planning Services, Building Inspection) 16) In accordance with Section 23.2.1.3 addressing Storm Water Drainage,Vista Commercial, First Filing, has completed the master drainage plan. The applicant shall provide evidence explaining how the storm water runoff will be handled. The calculations provided for storm water runoff were for Lot 7. The applicant shall provide calculations for storm water runoff for Block 3, Lot 6. (Department of Public Works) 17) In accordance with Section 23.2.1.16.11 addressing Traffic Circulation and Parking, the applicant shall delineate the location, dimensions, design of parking spaces, and inside walks. The applicant has indicated that a fifteen- inch (15") reinforced concrete drainage pipe is already in place. The access grade is less than five (5) percent, and the flared radius' will be forty (40) feet. The parking lot shall be paved with four-inch (4") thick concrete. The parking detail identifies employee parking and handicap parking. A two space turn-around has been provided for fire trucks and emergency equipment at the rear of the property. All parking areas and turn-arounds shall be properly striped. (Departments of Planning & Public Works) 18) As per your conversation with LuAnn Penfold of Mountain View Fire Protection District, the building footprint shall be moved twenty feet north of the south property line. Further, the building shall be reduced in size to accommodate the turning radius requirements for the Mountain View Fire District, as stated in their referral of December 15, 1999, that states the inside diameter turning radius is a minimum of thirty-five (35) feet and the outside turning radius is a minimum of forty-eight (48) feet. (Departments of Planning & Public Works) 19) In accordance with the American Disabilities Act, a ambulatory / non- ambulatory access shall be provided between the building and Skyway Drive. This walkway shall be kept clear of vehicles, and be clearly marked. The walkway shall adhere to ADA standards, and shall be delineated on the plan. (Departments of Planning & Public Works) b. The applicant shall include in the Landscape Plan the following information: 1) An installation schedule which specifies when the landscaping will be installed on site. (Dept. of Planning Services) 2) A Plant Material List specifying the Botanical and Common names of all plant material to be installed; the size of the plant material at installation and whether the plant material is to be containerized or B&B. (Dept. of Planning Services) 3) A landscape maintenance schedule which specifically states who will perform maintenance and that maintenance is on-going and shall not end upon final acceptance by the Department of Planning Services. (Dept. of Planning Services) c. The following notes shall be placed on the plat: 1) In accordance with the Weld County Zoning Ordinance, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the commercial or industrial zone districts until a Site Plan Review has been approved by the Department of Planning Services. (Dept. of Planning Services) 2) The application does not propose any portion of the site to be leased to another party. In the event that a portion of the building is proposed to be leased to another party in the future, the applicant shall submit a copy of the lease agreement and information regarding the proposed use of the leased portion to the Weld County Attorney's office, Weld County Building Inspection Department, Mountain View Fire Protection District and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. (Dept. of Planning Services) 3) There shall be no parking or staging of trucks allowed on Skyway Drive. (Public Works Dept.) 4) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-101, C.R.S., as amended), shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Health Dept.) 5) No permanent disposal of wastes shall be permitted at this site. (Health Dept.) 6) Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. (Health Dept.) 7) Fugitive dust shall be controlled on this site. (Health Dept.) 8) The maximum permissible noise level shall not exceed the light industrial limit of 60 db(A), as measured according to 25-12-102, Colorado Revised Statutes. (Health Dept.) 9) Adequate toilet facilities shall be provided for the public and employees. (Health Dept.) 10) The facility shall utilize the St. Vrain Sanitation District for sewage disposal. (Health Dept.). 11) The facility shall utilize the Left Hand Water District for domestic water service (Health Dept.) 12) If applicable, all pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. Reference 25-8- 205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. (Health Dept.) 13) Landscaping materials as indicated in the approved landscape plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. (Dept. of Planning Services) 14) All structures, including signs, on site must obtain the appropriate building permits. (Dept. of Planning Services) 15) The site shall maintain compliance with the Weld County Mixed Use Development (MUD) standards at all times. (Dept. of Planning Services) 16) The site shall maintain compliance with the Weld County Planned Unit Development (PUD) standards at all times. (Dept. of Planning Services) d. The applicant shall submit evidence to the Department of Planning Services that all conditions and requirements as indicated in the district's letter dated December 13, 1999 have been met. The applicant shall submit evidence to the Department of Planning Services that final approval has been received from the Mountain View Fire Protection District. The applicant shall submit evidence to the Department of Planning Services that all Left Hand Water District conditions and requirements as indicated in the district's letter dated November 17, 1999 have been met and service to the lot has been obtained. I have reviewed your information with the Transportation Impact Committee. On September 8, 2000, after looking at this information, and factoring in the date of effective dates for the Transportation Road Impact fee, the committee unanimously concurs that your property is not exempt from the Transportation Road Impact Fee requirements. According to Ordinance 211, all building permits issued after December 1, 1999 do require Impact Fee participation. It does appear that the Department of Planning Services did send you correspondence on November 23, 1999; however the information specifically pertains to a Site Plan Review Application. Furthermore, your Site Plan Review Application was not completed until, February 2, 2000. The issuance of building permits is contingent upon appropriate landuse approval, and in your case, appropriate landuse approval could only be rendered after a Site Plan Review had been approved. Additionally, you submitted Building Permit BC-0000806 on 8-21-2000 more than six months after the effective date of this ordinance. While evidence is not available to suggest whether or not you were notified of the possible ordinance change. The Board of County Commissioner's conducted three hearings for the Transportation Road Impact Fee Ordinance. The first reading was September 22, the second, October 18, and the final reading on November 3 and continued to November 17, 1999. At this time the Board of County Commissioner's publically announced their intent to enter into the Southwest Weld Service Area Impact Ordinance. Should you had applied for a building permit any time during this hearing process, then would have been exempt, however the ordinance is specific in its effective date (on receipt of building permits from 12-1-99). Carl Schaal Page 2 The calculation for your proposed building is based on an office classification of 800 square feet and for a warehouse of 9000 square feet. The total amount due for your Transportation Road Impact Fee is $12,212. This fee has been accessed based on the information provided by your Approved Site Plan Review. While there are no provisions in the Transportation Road Impact Fee Ordinance 212 to waive any building permit fees, once the ordinance has been enacted, you do have the option to apply for a transportation study. After receipt of the transportation study information the committee can compare your transportation analysis with transportation system now employed by the ordinance to determine if a consistency of fee requirement has been met. In the second filing of the site plan, received 3-21-2000, the applicant has delineated a sidewalk adjacent to the east side of the building. This walk runs the entire length of the structure. The applicant shall demonstrate how the man doors, overhead doors are accessed with this new walk. The applicant has removed the walk from the east side of the building. Further, the applicant shall delineate how access to the handicapped ramp is gained given the location of handicapped ramp to parking stall. Per ADA standards, access shall not be gained via the entrance drive, as this is a vehicle only zone. This pathway shall be kept clear of vehicles, and be clearly marked. Through the planning and development of the Vista Commercial Center ("Vista"), Patina was asked to change its access route to the Well and the associated production facilities from the existing road along the south line of Vista to a route through Lot 6 of Vista. Patina was not and is not opposed to an alternative access route to the extent that the alternative route is reliable and sufficient for Patina's heavy equipment and said alternative route does not create additional costs to be borne by Patina. The Fire District does not object to the request provided the requirements of the Fire District can be met. In accordance with the 1994 Edition of the Uniform Fire Code, the Fire District will make the following comments with regard to the project: • The building appears to be about 9,800 gross square feet of type II-N construction and not protected with an automatic fire sprinkler system. In accordance with Appendix III-A of the Uniform Fire Code, the required fire flow for the building is 2,000 gallons per minute, measured at a residual pressure of 20 pounds per square inch. This fire flow will need to be provided by a minimum of two fire hydrants. All hydrants used to meet the required water supply shall be within 600 feet of the building as measured along approved fire apparatus access routes around the exterior of the building; and, at least one fire hydrant shall be located such that it is within 450 feet of all portions of the building. Based on previous flow tests conducted in the area, the Fire District will recognize that the required fire flow is available. • The Fire District understands the building is going to be moved 10 feet to the north to provide a fire apparatus turn-around. After reviewing the revised site plan (the faxed copy), I am concerned that the required turning radii from the proposed turn-around may not be met. The turning radius of a fire apparatus access road shall be a minimum of 35 feet inside diameter and 48 feet outside diameter. If fire apparatus can clear the building making the turn out of the turn-around, fire apparatus access and the means for the turning around of apparatus is acceptable. • If any building occupant uses, stores or handles flammable or combustible liquids; or hazardous materials, information on the type and quantities of these materials will need to be submitted to the Fire District for review so further building and storage requirements may be addressed. The list should identify the names of the chemicals and the maximum quantities to be stored.
