Environmental Protection CASE NUMBER: USR-1163 NAME: Amen, Todd & Rhonda Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. There shall be no disposal of liquid or solid wastes at this location. 2) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 3) Fugitive dust shall be controlled on this site. 4) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 5) Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current Individual Sewage Disposal System regulations. 6) If applicable, a spillage retention berm shall be required around any fuel tank. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 7) All potentially hazardous chemicals must be stored and handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. 8) The facility shall utilize the existing public water supply. 9) The application materials indicate that a shop building will be constructed on -site. The materials also indicate that restroom facilities will not be provided within the shop building, and that employees will use the restroom facilities within the existing home. According to Section 3.1 of the Weld County I.S.D.S. Regulations: "The owner of any structure where people live, work, or congregate shall insure that the structure contains an adequate, convenient, sanitary toilet and sewage disposal system in good working order." Also, Section 3.17 which states: EXHIBIT 4V "No person shall construct or maintain any dwelling or occupied structure which is not equipped with adequate facility for the sanitary disposal of sewage without endangering the public health. Adequate facilities is defined as being within 200 feet and under the same ownership." 972277 Shani L. Eastin USR-1163 Page 2 Therefore, a restroom facility shall be provided in the shop building which is sewed by a permitted septic system. In addition, this system shall be designed by a Registered Professional engineer. 10) There shall be no washing of equipment at this site. SM/vh2572 9%2277 Wi�Yc COLORADO MEMORANDUM TO: Shani Eastin, Current Planner DATE: August 11, 1997 FROM: Don Carroll, Project Administrator h9� SUBJECT: USR-1163, Todd & Rhonda Amen The Weld County Public Works Department has reviewed this proposal; the following requirements are recommended to be a part of any approval: COMMENTS: The existing access point is located at the intersection of 35th Avenue and 49th Street. This sight distance is adequate for the facility. There is a 30 foot ingress/egress easement to access the facility and a one-way lane crossing a private bridge to the main gate. The site is fenced, and the gate was locked. There were numerous trees, which blocked a visual inspection from the outside. I have researched the dedicated right-of-way south of the "T" intersection on the east side of Section 35. The Clerk to the Board's record indicate that there is no dedication in Section 35 at this location. There is a 30 -foot dedication in Section 36, the adjacent section. The applicant has indicated that there is a 30 -foot ingress/egress easement already in place to the facility. REQUIREMENTS: The applicant needs to indicate on the mylar the traffic circulation plan to accommodate the additional truck traffic. When physical changes to the site are proposed, specifically concrete slabs and buildings, etc, an explanation of how the water will be displaced will be required. Indicate on maps and calculations showing how the storm water retention facilities will be designed to retain the storm water run-off in excess of the historical flow from the undeveloped site. The storm water detention facility on developed sites are designed to handle a 100 -year storm and release retention water at a rate not to exceed a five-year storm falling on an undeveloped site. The property in question does not comply with The City of Evans comprehensive plan, which identifies this area as low density residential and open space. Upon inspection, staff observed the property to be well concealed from 49th Street and the closest residential dwelling. When comparing the proximity of the Hill -N -Park lagoons and Gas Plant to this location, the usr request doesn't seem so intense. Also, there are many high tension power lines in the area, that may deter future single-family residential development from occurring in the area of the flood plain. The Public Works Staff would like to include a stipulation to the approval. First, that there are no future trees planted within 25 feet of the centerline of the Evans Ditch, and that 25 feet of right- of-way be dedicated to the City of Evans along this property for ditch access and maintenance purposes. Any questions regarding the ditch can be directed to Earl Smith, Director of Public Works. The planning staff at the City of Evans feels that the storage of the equipment would not adversely affect the surrounding area at this time, if the current screening of the property is maintained. To ensure proper maintenance of the ditch, we would request that Weld County accepts our recommendation as stipulations to the approval of this special permit. The Planning Commission reviewed this proposal at the August 26, 1997 meeting. At such time, the Commission agreed with the planning staffs recommendation to forward a comment of "no objection" to Weld County. This conclusion was base on the project location being outside of the Greeley Long Range Expected Growth Area, size of the site, low number of vehicles involved, and the seemingly insignificant impacts associated with the use.
