CREATE TRAFFIC CONTROL UNIT:
WHEREAS, to comply with the provisions of the Federal Highway Safety
Act and in cooperation with the U. S. Bureau of Public Roads for the purpose
of achieving total uniformity of traffic control devices on all county roads,
and
WHEREAS, after careful consideration it was deemed necessary to
create a seperate unit known as the Weld County Traffic Control Unit, and
WHEREAS, each road district will contribute $15,000.00 toward the
expenses incurred for the remainder of 1969.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that the Weld County Traffic Control Unit be and the
same is hereby established with a budget of $45,000.00

RESOLUTION
WHEREAS, Donald E. Hergert, Route 2, Box 306-A, Greeley,
Colorado, has requested permission for expansion of a feedlot operation
on the following described property, to -wit:
A tract of land located in the Northwest Quarter
(NW4) of Section Seventeen (17), Township Six (6)
North, Range Sixty-six (66) West of the 6th P.M. ,
Weld County, Colorado, containing 20 acres, more
or less, and
WHEREAS, the said requested expansion of an existing feedlot
operation is located in an agricultural zone as set forth by the Weld
County Zoning Resolution, and
WHEREAS, according to Section 3. 3 (3) (c) of the Zoning Resolution
of Weld County, said feedlot operation or any expansion thereof may be
authorized on the approval of the Board of County Commissioners of Weld
County, and

RESOLUTION
WHEREAS, Niwot Sanitation District, 1035 Coffman Street,
Longmont, Colorado, has requested permission for the installation of
a 2000 population equivalent aeration oxidation pond facility on the
following described property, to -wit:
The East One Thousand Feet (1,000') of the
SE4 of the SW. of Section Seven (7), Town-
ship Two (2) North, Range Sixty-eight (68)
West, of the Sixth Principal Meridian,
Weld County, Colorado, and
WHEREAS, the said requested aeration oxidation pond facility
is located in an agricultural zone, as set forth by the Weld County Zoning
Resolution, and
WHEREAS, according to the Zoning Resolution of Weld County,
said aeration oxidation pond facility may be permitted on the approval of
the Board of County Commissioners of Weld County, and
WHEREAS, the Weld County Planning Commission has recom-
mended that such aeration oxidation pond facility be denied by Resolution
dated May 21, 1969, a copy of which is attached, and made a part hereof
by reference, and
WHEREAS, the Board of County Commissioners has carefully
considered the petition and the recommendations of the Weld County
Planning Commission filed with the Board, and having carefully weighed
the same, finds as follows:
1. That said Sanitation District is located in
Boulder County, and any aeration oxidation
pond facility should be installed in Boulder
County;
2. That said Sanitation District, being located
in Boulder County, is a Boulder County
problem, and same should be subject to
Boulder County regulations;

Notice is hereby given that the Board of County Commissioners
of Weld County, Colorado, sitting as a Board of Equalization,
will meet in their office in the Weld County Courthouse, Greeley,
Colorado, beginning on the 2nd Monday, the 14th day of July, 1969,
to hear appeals from determinations of the County Assessor and will
continue said hearing from day to day until Thursday, the 31st day
of July, 1969.
Colorado Revised Statutes, 1963, Chapter 137-2-35 provides: -
In all cases where the complaint of the taxpayer has been overruled
by the County Assessor, the taxpayer may take an appeal from his
decision to the Board of County Commissioners, sitting as a Board
of Equalization of the County wherein the property is assessed.
Such petition or appeal shall describe the property claimed to
be unjustly or erroneously assessed, the sum at which it is assessed,
its true cash value and state what is a just. assessment thereon
compared with other like property, such petition shall be verified
by the petitioner or someone in his behalf, and on the written grounds
of the refusal of the Assessor shall be attached to and accompany
said petition.

BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that the Weld County Nursing Home Policy, as compiled by the Superintendent
in accordance with instructions from Medicare, shall and the same is hereby approved
and the Chairman is authorized to sign policy.

3. That investigation shows the inhabitants of
the immediate vicinity of the area whereat
said facility is sought to be installed, are
unanimously opposed to the installation of
such facility;
4. That further investigation shows that there
are locations as good, or better, in Boulder
County for the installation of such a facility;
5. That no good reason has been given by the
Sanitation District as to why said installation
should be in Weld County, rather than in
Boulder County;
6. That each of the preceding findings, in and
of themselves, and independent of each other,
constitutes a separate and individual ground
for denial of the application for the installation
of the facility.
NOW, THEREFORE, BE IT RESOLVED, that the petition of
the Niwot Sanitation District, 1035 Coffman Street, Longmont, Colorado,
requesting permission to locate a 2000 population equivalent aeration
oxidation pond facility on the land indicated above, be, and it hereby is
denied, upon each of the grounds set forth in the Board's finding therein.

APPOINTING ROBERT J. ANDERSON
ALTERNATE MEMBER
WELD COUNTY MUNICIPAL AIRPORT BOARD:
WHEREAS, on June 5, 1962, the Board of County Commissioners of Weld
County, Colorado, together with the Council of the City of Greeley, resolved to
organize the Weld County Municipal Airport thereby creating the need for a Weld
County Municipal Airport Board; and
WHEREAS, as stated in paragraph two of the aforementioned resolution,
the County Commissioners and the City Council shall alternate the appointment
of the seventh member of said Board; and
WHEREAS, it has been recommended that Mr. Robert J. Anderson of
2928 West 12th Street Road, Greeley, Colorado, be so appointed.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that Robert J. Anderson shall be and is hereby appointed

RESOLUTION
WHEREAS, the Board of County Commissioners of the
County of Weld, State of Colorado, has long been concerned with the
problem of the control of forest and prairie fires in Weld County, and
WHEREAS, Weld County is obligated to control all fires
on forest and prairie lands within said County, and.
WHEREAS, there is an immediate need for a volunteer
fire department in northeast Weld County, and
WHEREAS, such a volunteer fire department has been
established under the name and title of the PAWNEE VOLUNTEER
FIRE DEPARTMENT, with headquarters at Grover, Colorado, and
WHEREAS, the Colorado State Forest Service is agreeable
to furnish fire fighting equipment to WELD COUNTY and the PAWNEE
VOLUNTEER FIRE DEPARTMENT, in accordance with an Equipment
Agreement, a copy of which is attached herewith, and
WHEREAS, it is desirous and in the best interest of Weld
County, to have such fire fighting equipment made available to it.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, Weld County, Colorado, that said Equipment
Agreement with the Colorado State Forest Service, a copy of which is
attached hereto, and made a part hereof by reference, be, and it
hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it
hereby is authorized to execute the Equipment Agreement as submitted,
and to make the same effective forthwith.

REQUEST PERMISSION TO PARTICIPATE
IN PROGRAM: 1969 FLOOD DISASTER:
Commissioner Billings offered the following resolution and moved
its adoption:
WHEREAS, during .the month of May, 1969, Weld County suffered excessive
damage from heavy rains and floods to its road system, and
WHEREAS, Public Law 875 provides funds to expedite the reconstruction,
repair, and restoration of County Highways damaged or destroyed by said flood,
and
WHEREAS, the Board believes it to be in the best interests of Weld
County to participate in said program.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that a request is hereby made for permission to
participate in the program covered by Public Law 875, 81st Congress: (42 U.S.C.
1855-1855g) for restoration of Weld County Roads.

CONTRACT AGREEMENT
THIS AGREEMENT made this 25th day of June, 1969 by and between
WELD COUNTY, COLORADO, acting herein by and through its Board of
County Commissioners, who are duly authorized to act for and in behalf
of said Weld County, Colorado, hereinafter called the OWNER, and
EAGLE ENGINEERING CO., INC., a Colorado Corporation, licensed to
operate under the laws of Colorado, hereinafter called the ENGINEER.
WHEREAS: the OWNER desires to employ the ENGINEER to render engineering
services for the improvement, repair and/or replacement of bridges,
roadways, culverts, etc., damaged by recent floods in Weld County,
Colorado, and further to aid any and all County Offices requiring
assistance in design, inspecting, contracting and accounting, in order
to comply with the requirements of the Office of Emergency Planning,
hereinafter referred to as the OEP, and
WHEREAS, the ENGINEER agrees to perform the various professional services
required for the above named improvements,
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That for and in consideration
of the mutual covenants and promises between the parties hereto, it is
hereby agreed that the ENGINEER shall furnish engineering services and
the OWNER shall make payment for same in accordance with the terms and
conditions set forth hereinafter.

A. The ENGINEER hereby agrees to furnish and perform the various pro-
fessional services required as follows:
1. Provide complete general and detail plans, specifications and
detailed estimate of cost.
2. Prepare forms for construction proposals, advertisements, con-
struction constracts and bonds, subject to the approval of the
OWNER.
3. Receive and tabulate proposals, report same to the OWNER, and
assist in awarding contract for construction.
4. Furnish general supervision of the construction including line
and grade surveys as the constructions progresses, to assist
in a correct interpretation of the plans and specifications
and to safeguard the OWNER against defects and deficiencies on
the part of the Contractor.
5. Furnish and perform the supervision of work of inspection bureaus
and laboratories in the inspection and tests of material,
entering into the construction of the improvements; receive and
pass upon by approval or rejection all reports by such labor-
atories or bureaus on the material tested for use. The cost of
all such tests and inspections by laboratories or bureaus to be
paid for by the OWNER.
6. Receive, review and certify to the accuracy of all requests for
payment under the OEP Program. Tabulate and certify final pay
estimates to the OWNER.
7. Assist in the preparation of all correspondence by and between
the OWNER and OEP, and assist in the preparation of all forms
as required by the OEP for initial, partial, and final payment.
8. Provide any and all technical information as required at meetings
with the OWNER and OEP as well as attend meetings as requested
and required by the OWNER.
9. Provide any additional investigations, studies, and reports,
preliminary general plan or plans, approximate estimate of
cost and all necessary conferences with the OWNER in regard to
construction.
B. The OWNER hereby agrees to pay the ENGINEER as compensation for
such engineering services, a fee based on the hours worked in accordance
with the Fee Schedule shown below. The OWNER further agrees to pay the
ENGINEER on a monthly basis, upon presentation of a statement showing
the type of work performed with the hours and rates shown thereon.

C. It is further mutually agreed by the parties hereto:
1. That the above fee schedule shall include all travel, insurance,
out -of -office expense, telephone and telegraph costs, and profit.
2. That the total fee paid the ENGINEER shall not exceed the per-
centage fee as shown on curve "B" as published by the American
Society of Civil Engineers, page 18, of the Manual of Engineering
Practices.
3. That the ENGINEER shall have complete authority over all con-
struction, inspection, and negotiations as they pertain to
existing and future construction as required to fulfill the
requirements of the OEP and to protect the OWNER.
4. That any drawings and specifications used are instruments of
service and as such the original documents, tracings, and field
notes are and remain the property of the ENGINEER whether the
work for which they were prepared be executed or not, and shall
not be used by the OWNER for any other project or construction.
5. That all questions in dispute under this agreement shall be
submitted to arbitration at the choice of either party hereto.
6. That the OWNER and ENGINEER each binds himself, his partners,
successors, executors, administrators and assigns, to the other
party to this agreement. Except as specified above, neither the
OWNER nor the ENGINEER shall assign, sublet, or transfer his
interest in this agreement without the written consent of the
other party hereto.
IN WITNESS THEREOF, the parties hereto have affixed their hands and seals

WHEREAS, pursuant to law, the Board of County Commissioners
of Weld County, Colorado, has been vested with the responsibility for
the maintenance of the general accounting records of Weld County, and
WHEREAS, it is the further duty and responsibility of the Board
to appoint a person to manage and maintain such accounting records, and
WHEREAS, heretofore, and up to July 1, 1969, such duties were
performed by the Weld County Clerk and Recorder, and
WHEREAS, said Weld County Clerk and Recorder has, in the past,
been most efficient in the management and maintenance of the accounting
records of the County, and

adopting a schedule of County road specifications and necessary bonding
requirements in connection therewith, and
WHEREAS, Scott Realty, Greeley, Colorado, posted a Bond in
the sum of $ 2,500.00 guaranteeing construction of a road in
Westridge Subdivision, 2nd Filing, along the south line in Section 15,
Township 5 North, Range 66 West of the 6th Principal Meridian, Weld
County, Colorado, and
WHEREAS, it has been determined that said road and/or roads
have been constructed in compliance with the Weld County road specifica-
tions, and
WHEREAS, it has been recommended that the road and/or roads
so constructed by Scott Realty be accepted and made a part of the County
Road System.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that the $ 2,500.00 Bond

No. 1468, and Government Agency Lease Agreement, all attached

WHEREAS, it is the further desire of the Commissioner in

WHEREAS, as provided by said Statute, the Board of County Commissioners

On May 27, 1969 I withdrew the application of Monfort Feed Lots,
Inc. for approval of a part of Section 9, Township 4 North, Range
66 West of the 6th Principal Meridian in Weld County, Colorado for
consideration as a commercial feed lot.
Since that date, the Monforts have reconsidered the withdrawal of
their application, and have advised me to initiate such action as
the Commissioners desire for the reconsideration of our original
application. It is our desire that the Commissioners consider the
original application based upon the previous proceedings before the
Weld County Planning Commission and the public hearing held by the
Weld County Board of County Commissioners.
The Company expects that the initial construction will be deferred
pending new financial arrangements. We would appreciate having your
approval of the location at the present time so as to enable us to
move forward with our plans.

WHEREAS, a public hearing was held on Wednesday, May 21, 1969, at
2:30 P. M. in the District Court Room, Weld County Courthouse, Greeley,
Colorado, for the purpose of hearing the petition of Monfort Feed Lots, Inc.,
Greeley, Colorado, requesting approval of site for a commercial feed lot
operation on the following described property, to -wit:
Section 9, Township 4 North, Range 66 West of the 6th P. M.,
Weld County, Colorado, including other adjacent properties in
the immediate vicinity that may be included into a contemplated
general feed lot operation, and
WHEREAS, the petitioner was present and represented by counsel,
and
WHEREAS, there was some opposition to the change of zone and said
opposition was represented by counsel, and
WHEREAS, the Board of County Commissioners heard all the testimony
and statements from those present, and
WHEREAS, the said requested commercial feed lot operation is in an
agricultural zone as set forth by the Planning Commission of Weld County,

WHEREAS, according to Section 3.3 (3) (a) (b) (c) of the Zoning
Resolution of Weld County, said commercial feed lot operation may be auth-
orized upon the approval of the Board of County Commissioners of Weld County,

WHEREAS, the Weld County Planning Commission has recommended that
this commercial feed lot operation be approved by a Resolution dated May 7, 1969.

of solid and/or liquid waste disposal in Weld County, and
WHEREAS, Weld County is obligated to bring the whole county into
compliance with the law, so as to promote the health, safety, prosperity,
security and general welfare of the inhabitants of Weld County, and
WHEREAS, there presently is no solid and/or liquid waste
management system in Weld County, providing for the location, regulation,
collection, storage and/or disposal of waste, and
WHEREAS, the cost to establish a solid and/or liquid waste
disposal system in Weld County is so great that same cannot be considered
or justified at the present time, and
WHEREAS, there is an immediate need for a solid and/or liquid
disposal system in Weld County, and

WHEREAS, Weld County Landfill, Inc., a Colorado corporation,
is agreeable to provide and operate certain dumps in Weld County, in
accordance with Agreement, a copy of which is attached herewith, and
WHEREAS, it is desirous and in the best interest of Weld County,
that its inhabitants be provided access to certain certified dumps in Weld
County, in order that all solid and/or liquid waste shall be properly
disposed of.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that said Agreement with Weld
County Landfill, Inc., a copy of which is attached hereto and made a part
hereof by reference, be, and it hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute the Agreement as submitted, and to make the same
effective forthwith.

WHEREAS, a public hearing was held on Wednesday, July 2, 1969,
at 2:00 o'clock P.M., in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing a petition of the Weld
County Planning Commission, requesting a change of zone from "I" Industrial
District to "A" Agricultural District, of a parcel of land described as follows:
The West Half of the Southwest Quarter (WZ SW4)
and the West Half of the East Half of the Southwest
Quarter (WI- E2 SW4), except the South 330 feet
thereof, in Section 6, Township 1 North, Range 67
West of the Sixth Principal Meridian, Weld County,

RESOLUTION OF THE WELD COUNTY BOARD OF RETIREMENT
WHEREAS, by resolution passed January 29, 1969, the County Board
of Retirement of Weld County, Colorado, did create the Weld County Retire-
ment Plan, and
WHEREAS, as the result of certain suggestions made by the Internal
Revenue Service, it is determined that the following amendments to the Weld
County Retirement Plan as adopted on January 29, 1969 are hereby made, to -
wit:
NOW, THEREFORE, BE IT RESOLVED:
1. Delete Section 7. 3 in its entirety.
2. Amend Section 8. 2(a) in its entirety to read as follows:
"(a) Joint and Survivor Benefit Option. A benefit which
provides reduced monthly Retirement Benefit payments
during the Retired Member's life, and upon his death
after retirement, continues payments in the same or
a lesser amount to a designated Beneficiary during
the life of such Beneficiary; provided, however, that
the designated Beneficiary for any joint and survivor
benefit elected under this Section 8. 2(a) must be the
Member's spouse."
3. Amend Section 10.2 by adding the following two sentences at the
end of this Section:
"However, in order to receive the refund of his Accumu-
lated Contributions, the Member must sign the application
form that is provided by the Retirement Board for this pur-
pose. The Accumulated Contributions shall be refunded to
the Member within sixty (60) days after the Member signs
the application form. "

4. Amend the second paragraph of Section 14.3 in its entirety
to read as follows:
"Notwithstanding any other provision hereof, if the
Internal Revenue Service fails to grant initial qualifi-
cation of this Plan under the provisions of Section 401(a)
of the Internal Revenue Code, the Trustee or Insurance
Company shall return all contributions, together with the
pro rata share of income, less expenses, to the Members
who have contributed the same, and to the County. There-
upon, this Plan shall terminate. "
5. Amend Section 14. 6 by inserting "non -transferable" prior
to the word "annuity" as it appears in the fourth line of this
Section.

FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF JOHN G. WERKHEISER
The petition of John G. Werkheiser, 2002 First Avenue, Greeley,
Colorado, requesting a change of zone from "R" Residential District to
"M -H" Mobile Home District, of a parcel of land described as follows,
to -wit:
Lots 7 and 8 in the Southwest Quarter (SW4) of
Southwest Quarter (SW4) of Section 9, Town-
ship 5 North, Range 65 West of the 6th P. M.,
Weld County, Colorado, containing 10. 00 acres,
more or less,
came on for hearing on Wednesday, June 25, 1969, at 2:00 o'clock P. M. ,
and the Board of County Commissioners of the County of Weld, having
heard the testimony and evidence adduced upon said hearing, and having
considered the testimony, evidence, and recommendations of the Weld
County Planning Commission filed with said Board, and having carefully
weighed the same, now makes the following findings:
1. The evidence discloses that the applicant failed to sustain the
burden of proof as to the need for a change of zone, or that the present
zone is erroneous, or that circumstances warrant a change of zone at
this time.
2. The evidence shows that the inhabitants of the immediate
vicinity of the area sought to be re -zoned are predominately opposed
to the change of zone.
3. The evidence discloses that the present zoning is compli-
mentary to the surrounding area.
4. The evidence shows that a tract of land containing five acres,
more or less, immediately to the west of subject property, has already
been zoned"M-H, and that petitioner has shown no need for this additional
area to be re -zoned.
5. That each of the preceding findings in and of themselves,
and independent of each other, constitutes a separate and individual
ground for denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, has heard the application of John G. Werkheiser, 2002 First Avenue,
Greeley, Colorado, for a change of zone from "R" Residential District to
"M -H" Mobile Home District, of a tract of land for a proposed mobile home
trailer park, said area being more particularly described as follows:

NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
having examined the said application and the other qualifications of the applicant

only at retail at said place, and do hereby authorize and direct the issuance of
said license by the Chairman of the Board, attested by the County Clerk and Recorder
of Weld County, Colorado, good for one year from the date of issue unless revoked,
according to law provided, however, that said license shall be issued upon the

sell beer under said license will be conducted in strict conformity to all laws

CONCERNING RETAIL 3.2 FERMENTED
MALT BEVERAGE LICENSE OF
OREL C. MILLER AND DONALD E. McKAY
The application of Orel C. Miller and Donald E. McKay for
retail 3. 2 fermented malt beverage license (for consumption both on and
off premises) came on for hearing June 30, 1969, at 2:00 o'clock P. M.,
and the Board of County Commissioners of the County of Weld, having
heard the testimony and evidence adduced upon said hearing, and having
considered the testimony, evidence, petitions and remonstrances filed
with said Board, and having carefully weighed the same, now makes the
following findings:
1. The evidence discloses that the applicants failed to sustain
the burden of proof, as to the reasonable requirements of the neighborhood.
2. The evidence discloses that one of the partners is not a
Colorado resident, within the meaning of the Statutes.
3. The evidence shows that there presently is another 3. 2 beer
outlet in the area described as the neighborhood, where beer is sold,
although not for consumption on the premises.
4. The evidence shows that the area is very sparsely populated,
and there is no showing that there has been any substantial increase or
change in population in the neighborhood since the last 3. 2 license was
issued.
5. The evidence shows that most of the expected patronage of the
business would be college students, teen-agers and residents of other
areas, and there is evidence that prospective patrons now have the oppor-
tunity to patronize similar establishments within a reasonable distance from
said proposed location.
6. The desires of the inhabitants of the immediate neighborhood
of said proposed location, as evidenced by personal testimony and petitions,
are predominately opposed to the issuance of the license.
7. That each of the preceding findings, in and of themselves, and
independent of each other, constitutes a separate and individual ground for
denial of the license.

ROAD NO. 37 ALONG THE NORTH SIDE OF MONFORT
FEED LOTS, IN WELD COUNTY, COLORADO.
WHEREAS, a multitude of complaints have been made to the
Board of County Commissioners of Weld County, Colorado, that motor
vehicles habitually are being driven at speeds greater than is reasonable
and prudent along that part of said Highway, being in Weld County, and
known as County Road No. 66, between U. S. Highway No. 85 and County
Road No. 37, along the North side of Monfort Feed Lots, and all inter-
sections of streets and roads therewith, and
WHEREAS, said Board is authorized by the Statutes of the State
of Colorado to regulate the speed of vehicles, and
WHEREAS, said Board, pursuant to such complaints, has
determined upon the basis of engineering, traffic investigations and a
special speed survey, that any speed along or over said portion of said
road or highway, and at all intersections of other roads therewith, in
excess of the following, to -wit:
Westbound traffic:
From U.S. 85 to approximately . 25 mile west
of U. S. 85 - 45 M.P.H.
From approximately . 25 mile west of U.S. 85 to

LEASE AGREEMENT
THIS AGREEMENT made and entered into this 15th day of July, 1969,
between the CITY OF GREELEY and THE COUNTY OF WELD acting by and
through its agent WELD COUNTY NICIP L AIRPORT BOARD, hereinafter
referred to as Lessor, and � aO,%
hereinafter referred to as Lessee, WITNESSETH:
That for and in consideration of the rental herein agreed to be paid by
Lessee to Lessor and the covenants and agreements herein agreed to be kept
and performed, Lessor hereby leases to Lessee, for the term hereinafter
designated, the following described property:
1. A space at the Weld County Municipal Airport being a portion of
the new Terminal Building designated Space Forty-six on the plat of said
airport, more particularly described as the West Twenty-five Feet (W 25')
of said building being an area approximately 25' x 30', a storage room in
said Terminal Building located immediately east of the entrance on the south
side of said building; gasoline concession for the sale of aviation gasoline at
the northwest corner of the new Terminal Building; and concession for
installation of food and beverage dispensers in the room marked "Concession
Area" located in said Terminal Building.

2. The to m of this lease shall be from the 15th day of July, 1969, to
and until the 1.t day of 't , and Lessee agrees to pay Lessor as
rent for the term aforesaid the sum of Six Hundred Dollars ($600. 00) payable
in equal monthly installments of One Hundred Dollars ($100. 00) each, in
advance, commencing on the 15th day of July, 1969, for the above designated
lease property.
3. It is agreed that Lessee shall be entitled to sell aviation gas from
the location at the northwest corner of said Terminal Building and Lessee shall
be entitled to use the underground storage tanks in the selling of aviation
gasoline belonging to Lessor without additional charge; Lessee further agrees
to pay Lessor the sum of Three Cents ($0. 03) for each gallon of gasoline
delivered to Lessee at said pumps and payments therefor shall be made to
Lessor on or before the 15th day of each month following delivery per Lessee's
invoices in accordance with Operating Policy as adopted by said Board. Lessee
shall have the right to use Lessor's existing underground tanks in their present
location at said airport.
4. Lessee agrees that he will not assign this Lease Agreement without
the written consent of the Lessor; and Lessee agrees that the main entrance to
Terminal Building, lobby and pilot ready room shall be open to the public and
lighted at all times.
5. In consideration of this lease and the nominal rental charged Lessee
therefor, Lessee agrees that Lessor shall not be responsible to Lessee for
any damages to Lessee, his property or employees arising from the storage
of planes, by floods, windstorms, fires, conditions of flight field, or flight
facilities, or the use of the airport by other persons.
6. Should Lessee fail, refuse or neglect to pay the rent as herein
provided, or should Lessee breach any other of the terms and conditions of
this agreement, Lessor shall become entitled to repossess the demised premises
at its first and former estate, upon giving to Lessee notice of such breach in
writing, either served upon Lessee personally or mailed to him at the above
address or by posting the same on the demised premises at least ten days in
advance. If at the end of such ten-day period following the service of said
notice, such breach has not been remedied and Lessee should refuse to vacate
said premises, Lessor may use such remedy as it may deem fit under the
circumstances to repossess the same, with or without process of law.
7. The Lessee agrees to maintain the demised premises in a clean and
presentable condition at all times and such interior maintenance will include
painting, floors, light bulbs, and restroom facilities. Lessee will at the
•
expiration of this lease surrender and deliver up said premises in as good
order and condition as when the same was entered upon, loss by fire,
inevitable accident or ordinary wear excepted.
8. Lessee shall pay all electricity, including lighting and appliances
as presently installed in the premises; and Lessee shall further furnish at
his own expense janitorial supplies and labor necessary for the operation and
maintenance of said Terminal Building.
9. The Lessee agrees that prior to any alteration to the interior or
exterior of said Terminal Building, including installation of signs, written
,
approval of the Board shall be obtained, and Lessee further agrees that all
vending machines installed or placed in the concession area shall have prior
written approval of the Board.
10. It is mutually agreed, that if after the expiration of this lease the
Lessee shall remain in possession of said premises and continue to pay rent,
without any express agreement as to such holding, then such holding over shall
be deemed and taken to be a holding upon a tenancy from month to month.
11. Lessee agrees to furnish service on a fair, equal and not unjustly
discriminatory basis to all users thereof.
12. Lessee agrees to charge fair, reasonable, and not unjustly
discriminatory prices for each unit or service, provided, that the contractor
may be allowed to make reasonable and nondiscriminatory discounts, rebates,
or other similar types of price reductions to volume purchasers.
13. Lessee agrees that in the operation and use of the Weld County
Municipal Airport he will not on the grounds of race, color, or national origin
discriminate or permit discrimination against any person or group of persons
in any manner prohibited by Part 15 of the Federal Aviation Regulations.
14. Lessee agrees that nothing herein contained shall be construed to
grant or authorize the granting of an exclusive right within the meaning of
Section 308 of the Federal Airport Act of 1958.
15. This agreement shall be subordinate to the provisions of any
existing or future agreement between Weld County Municipal Airport and the
United States, or any proper agency thereof, relative to the operation or
maintenance of the airport, the execution of which has been or may be required
as a condition precedent to the expenditure of Federal funds for the development
of the airport.
16. Lessee agrees to abide by the provisions of the Weld County
Municipal Airport Operating Policy adopted September 24, 1962, and revised

in 1965 and as may be amended and/or revised in the future and which is made
a part hereof by reference.
17. The provisions of this Lease Agreement shall be binding upon an
inure to the benefit of the heirs, executors, administrators, successors and
assigns of the respective parties hereto.

2500 lin. ft. of steel piling.

WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has long been concerned with the problem of
flood control in Weld County, and
WHEREAS, there is an ever-present danger of disastrous flood
damage to County property, and to property of the inhabitants of Weld
County, unless action is taken immediately to clean, improve and repair
present river channels on both the South Platte and Cache la Poudre Rivers,
and all tributaries thereof; and
WHEREAS, it is evident that the future potential flood damage will
affect Adams, Boulder, Larimer, Morgan and Weld Counties; and
WHEREAS, time is of the essence, and the cost of establishing
a flood control district, or districts, and providing the necessary funds
therefor is prohibitive, and not feasible or desirable at the present
time; and
WHEREAS, money is needed to purchase bulldozers, draglines and
other heavy equipment, for the purpose of improving, cleaning and repairing
present river channels in said Counties; and
WHEREAS, all of said Counties, in the interest of obtaining immediate
relief from future potential disastrous floods, are willing to provide the
necessary labor and expenses for the operation of such heavy equipment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that Weld County join with its
neighboring Counties of Adams, Boulder, Larimer and Morgan, and do
whatever is necessary to improve, clean and repair the South Platte and
Cache la Poudre river channels, and all tributaries thereof, within the
said Counties.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute agreements. contracts and other legal documents with
its neighboring Counties, for the purchase and/or lease of the necessary
equipment to be used therefor.
