HomeMy WebLinkAbout992796.tiff HEARING CERTIFICATION DOCKET NO. 99-68 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1242 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT(MEAT PROCESSING FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - STAN AND LORI WADDELL A public hearing was conducted on November 17, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 29, 1999, and duly published November 3, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Stan and Lori Waddell for a Site Specific Development Plan and Special Review Permit #1242 for an Agricultural Service Establishment (meat processing facility) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester stated the property is located three miles east of Nunn, several comments were received with referrals, the applicant has complied with the conditions required by the Planning Commission to be met prior to the Board of Commissioner hearing, and staff recommends deletion of Development Standard #25. Responding to Commissioner Geile,Trevor Jiricek,Weld County Department of Public Health and Environment, stated the applicant is subject to CAFO regulations even with one bird; however, there are more stringent regulations for facilities with 10,000 birds and the Board is hearing this case because of the slaughter and processing portion of this facility. Ms. Chester stated the applicant has changed the number of birds from time to time throughout the process, when they were trying to determine whether or not to try to obtain USDA approval; however,the 1,200 allowed as a Use by Right will be in line with what he is actually handling. Commissioner Geile clarified the applicant will not be allowed over 1,200 birds at any one time without amending the permit. Stan Waddell, applicant, gave a brief description of his proposal and stated he will not be handling over 10,000 birds per year. He stated he has two employees all the time, with a third one occasionally. Responding to Commissioners Baxter and Geile, Mr.Waddell stated he is processing for others and he understands that if over 1,200 birds are on-site at any one time he will need to amend the permit. He also requested Condition of Approval #2.B.1 be changed to allow him to have a concrete cistern instead of stainless steel. Responding to Chair Hall, Mr. Waddell stated he has already talked to an individual at the USDA. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Stan and Lori Waddell for a Site Specific Development Plan and Special Review Permit #1242 for an Agricultural Service Establishment (meat processing facility) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, with the deletion of Condition of Approval#2.B.1, and Development Standard#25, and renumbering the remaining Conditions and Standards. The motion was seconded by Commissioner Vaad. Commissioners Kirkmeyer and Vaad clarified the motion includes deletion of the Planning Commission Condition of Approval#4. On a call for the vote, the motion carried unanimously. This Certification was approved on the 22nd day of November, 1999.
