HomeMy WebLinkAbout960366.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING PETITION FOR LOCAL IMPROVEMENT DISTRICT - ROTH SUBDIVISION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a Petition for a Local Improvement District was submitted to the Board by owners of property which is more particularly described in said petition, marked as Exhibit "A", a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to schedule a hearing to determine the intent to create Weld County Roth Subdivision Local Improvement District#1995-1 for April 24, 1996, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a hearing to consider the aforementioned Petition for a Local Improvement District be, and hereby is, scheduled for April 24, 1996, at 10:00 a.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of March, A.D., 1996. r. Webster 960366 SD0050 fx ; &Jr/9; Fiz-E Exhibit A PETITION FOR LOCAL IMPROVEMENT DISTRICT TO: Board of County Commissioners Weld County,Colorado P.O.Box 758 Greeley, Colorado 80632 We,the undersigned citizens of Weld County,who are owners of record of real property,propose to be assessed the costs of paving, and which property will benefit from improvement of: Rodney Street between Brian Avenue WCR 15, Steven Street between Brian Avenue and Gaylin Avenue, Gaylin Avenue between Rodney Street and WCR 76, Brian Avenue from the south line of Roth Subdivision,First Filing to WCR 76. situated in Weld County, Colorado,do hereby petition the Board of County Commissioners of the County of Weld, State of Colorado,for the formation of a local improvement district pursuant to the CRS,30-20-601,et seq. We represent that the real property listed in this petition(s)will be assessed more than one-half of the estimated $138,000 in costs proposed to be assessed to the local improvement district. Such improvement district is for the purpose of paving the above described streets and avenues. The specific improvements we wish to have constructed are as follows: Shape,grade, pave and shoulder the above described streets and avenues. We request that the following materials be used: Two inches of asphalt pavement, 24 ft.wide; and 4 inches of aggregate base course; and 4 ft. wide aggregate shoulders. The specific manner of assessments we recommend is as follows: The property owners be assessed equally per each of the 50 lots described as follows: Lots 1 and 2, 8 through 47, and 50 through 57 of Roth Subdivision, First Filing, as recorded under Reception Number 1534568 in the Weld County Clerk and Recorder's records We estimate the cost to be$2,760 per lot. xn.wpNeslengineerlroth.pet 960366 Petition for Local Improvement District Roth Subdivision Page 2 The specific manner of payment we recommend is as follows: The estimated$2,760 per lot be paid in full without interest, or over a 10-year period, at an interest rate of 6.25%, with the principal being divided into 10 equal annual payments, and the interest computed to the unpaid balance. We further understand and acknowledge that we are to be responsible, individually, for any grading or other adjustments to our driveways and culverts necessitated by such project. Do not sign this petition unless you are an"owner" of real property benefitting from the project and request to be assessed costs of the improvements. An owner is a person holding fee title to real property. You are an "owner" if you hold a contract to purchase real property,which obligates you to pay general taxes on that property.
