1/ How is this proposal consistent with the Weld County Comprehensive Plan?
This proposal will contribute to the economic development of Weld County/ The
property is not presently being used for any purpose/ It can only be accessed via adjacent
Wyoming property that belongs to this property owner/ The land cannot be practicably
developed for agricultural or industrial use/ The property immediately abutts the
Wyoming state line; the closest municipality is Nunn, CO/ There are no proposed future
developments in the surrounding area/ There is an abandoned, structurally unsound cinder
block and wood barn that will be removed for construction of a modern facility/ As a
commercially zoned property, it will provide an outlet for Colorado artists, craftsmen, and
wholesalers to sell their products/ Overall Colorado Lottery sales will signifcantly increase
due to this property's critical location/
2/ How does this proposal meet the intent of the zone district it is located in?
This rural property is located in an agricultural zone district/ Proposed use will not
interfere with and will not be incompatible with agricultural activities/ There will be
minimal impact upon local public services and negligible impact upon Weld County
taxpayers/ Proposed use cannot reasonably be located in a municipality, urban growth
boundary area, or the I-25 mixed -use development corridor; this will result in
underutilization of existing property/
3/ How is this use compatible with future development as stated in the Weld County
Comprehensive Plan? If yes, how?
The proposed use will allow economic development in a location where agricultural
development of any kind is unfeasible/ It is consistent with traditional development along
heavily travelled highways (Highway 85)/
4/ What type of uses surround this site? Is this request compatible with surrounding uses?
Within Weld County there is pasture and one residence surrounding this site/
Across the state border into Wyoming there is one nightclub, one proposed restaurant, and
two residences -- all owned by the applicant for this Use by Special Review/
5/ Is this property located within a Flood Hazard zone, Geologic Hazard zone, or Airport
Overlay zone, and does it meet these special requirements?
This property is not located within any of the identified zones/

6/ What efforts have been made to conserve productive agricultural land?
The property being considered for special use is not presently, nor will it be, used for
agriculture/
7/ How will public health, safety and welfare be protected?
There will be no activities, equipment or materials that will create any hazards for
the public/ The facility will be constructed in compliance with all applicable building, fire,
health, and safety codes/ Security of personnel and property will be provided on a
continuous basis/
8/ What will the site be used for?
A gift shop and Colorado Lottery ticket sales/
9/ How close is this site to other residential structures?
1500 feet/
10/ How many people will be employed at this site and what hours will they work?
There will normally be two people employed at any one time; this could drop to one
during slow periods and increase to three during busy periods/ Operating hours will be
from 6:00 AM to 12:00 midnight/
11/ How many people will use this site?
275 people per day by the end of the first year/
12/ What type and how many animals, if any, will be on this site?
There will be no animals on this site/
13/ What type and how much, if any, operating and processing equipment will be utilized
on site?
There will be no special equipment employed at this site/
14/ What type and how many structures will be erected (built) on this site?
One general purpose wood framed building/ Exterior treatment will probably be
stucco or some other material that will create a Southwestern look and Tit in well with
surrounding property while maintaining a rural character/

15/ What kind (type, size, weight) of vehicles will access this site and how often?
Most vehicles will be normal personal vehicles of customers and employees
(compact, medium, and large automobiles averaging 2500 Ibs) and, on an infrequent basis,
UPS or similar delivery trucks/ There will be parking available across the border in
Wyoming for large trucks/
16/ Will this site use a septic system or public sewer facilities?
The Weld Co Dept of Environmental Health has approved use of a septic system
immediately adjacent to this property in Wyoming/ The building will have a restroom for
employees and a janitorial closet/ Public facilities will be available in the Wyoming building
(approximately 7 feet distance between the gift shop and adjacent building connected by a
covered walkway)/
17/ Are you proposing storage or stockpile of wastes on this site? If so, what is the size and
type proposed?
No/
18/ How often will debris, junk, or waste be disposed of? By what means?
Weekly collection by disposal company (Flyte Sanitation) already contracted by
property owner for existing adjacent business/
19/ How long will it take to construct this site and when will construction begin?
Construction will take approximately 4 months/ Construction will begin as soon as
possible after issuance of Special Use Permit/
20/ Explain the proposed landscaping plans and erosion control measures associated with
this site/
Landscaping will consist of adding appropriate trees and shrubbery to enhance
appearance/ There is no need for special erosion control measures on this property; an 18"
drainage culvert will be added on adjacent property by the same land owner/ Land
development will basically consist of necessary grading for the facility, parking lot, and
access road/
21/ Explain any proposed reclamation procedures when termination of the Special Review
use begins/
There are no significant changes to the land that require a reclamation plan/
Improvements are expected to be permanent/

This is a private business enterprise that will display a unique collection of local art,
craft, and gift items (gift shop) and will serve as an ideal location for increasing Colorado
Lottery income by increased sales to Wyoming residents/
