RE: GRANT CHANGE OF ZONE#498 FROM PUD(CRYOGENIC RESEARCH FACILITY)TO
A (AGRICULTURAL) - DONALD AND BETTY MINCH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 8th day of May, 1996, at 10:00 a.m. for the
purpose of hearing the application of Donald and Betty Minch, 17076 Weld County Road 5, Mead,
Colorado 80542, requesting Change of Zone #498 from PUD (cryogenic research facility) to
A (Agricultural) for a parcel of land located on the following described real estate, to-wit:
The S'/2 SW% of Section 27, Township 4 North, Range 68
West of the 6th P.M., Weld County, Colorado
WHEREAS, Donald Minch, applicant, was present at said hearing, and
WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides standards for
review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Weld County
Planning Commission and, having been fully informed, finds that this request shall be approved for
the following reasons:
1. The applicant has complied with all the application requirements listed in Section
21.7 et seq., of the Weld County Zoning Ordinance.
2. The request is in conformance with Section 21.6 of the Weld County Zoning
Ordinance as follows:
a. The proposed Change of Zone is consistent with the intent of the Weld
County Comprehensive Plan Agricultural Goals and Policies, as amended.
In 1987 the property was zoned PUD to allow for a cryogenic research
facility. This facility was only developed on the property located directly
north of the subject property. The subject property is currently in agricultural
production. Staff feels that the Change of Zone to agricultural is consistent
with the Agricultural Goals and Policies as stated in the Weld County
Comprehensive Plan, as amended.
b. The use allowed on the subject property by granting the Change of Zone will
be compatible with the existing surrounding land uses which are
predominately agricultural in nature.

c. Adequate water and sewer service can be provided to this property. Water
service can be provided by Little Thompson Water District and sewer can
be provided by septic systems.
d. Existing Weld County Road 7 provides access to the property which is
adequate to meet the requirements of the uses which would be allowed in
the Agricultural Zone District.
e. The subject property is not located in an overlay district.
f. The proposed rezoning will not interfere with the present or future extraction
of commercial mineral deposits located on or under the property. Mineral
resource development is a use allowed by Special Review in the Agricultural
Zone District.
g. The soil conditions on the site are such that they do not present moderate
or severe limitations to construction of structures or facilities proposed for
the site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Donald and Betty Minch requesting Change of Zone#498
from PUD (cryogenic research facility) to A (Agricultural) on the above referenced parcel of land
be, and hereby is, granted subject to the following conditions:
1. The applicant shall submit a new plat map meeting the criteria for application
requirements as stated in Section 21.7.2 of the Weld County Zoning Ordinance, as
amended.
2. The Change of Zone plat shall be submitted to the Department of Planning Services
within 15 days of approval by the Board of County Commissioners.
3. Prior to the release of residential building permits the applicant shall submit
evidence to the Department of Planning Services that the concerns stated in a letter
dated March 26, 1996, from Celia Greenman, Geologist, Colorado Geological
Survey, regarding the post-construction damage due to settling or swelling caused
by alluvial gravels present in the area have been addressed.
4. No construction shall take place in the drainageway located in the southwestern
corner of the property as stated in a letter dated March 26, 1996, from Celia
Greenman, Geologist, Colorado Geological Survey. This area shall be shown on
the plat.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 8th day of May, A.D., 1996.
