Be it -resolved by the Weld CountyPlanning Commission that the application for: CASE NUMBER: S-380 NAME: Tri-City Ventures, L.L.C. ADDRESS: 6538 U.S. Highway34, Loveland, CO 80537 REQUEST: Site Specific Development Plan and Minor Subdivision Finallplat LEGAL DESCRIPTION: Lot A_cf RE -1610 in part of the NW4 of Section 8, T5N,'R67W of the 6tNP.M., Weld County, -Colorado. LOCATION: South ofandadjacent to Weld County Road B0, approximately 1/4 mile east of Weld County Road 15. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The -submitted materials are in compliance with the application requirementsofSection 4.4 of the Weld CountySubdivision Ordinance. 2. It is -the opinion ofthePlanning Commission that the -applicant has shown compliance with Section 4.5.9 of the Weld County Subdivision Ordinance as follows: The proposed Minorsubdivision Final Plat is consistent with the Weld CountyComprehensive Plan. The property is located within the Urban Growth Boundaries -of the Town of Windsor and City of Greeley. The Windsor and Greeley Planning Commissions have indicated that they have no objection to the proposal. Parcel -size and topography restrict the use of the site for agricultural production. The proposed Minor Subdivision Final -Plat is compatible with the -surrounding area of rural residential uses -and agricultural production. Definite provision has been made for a public water supply that is sufficient in terms of quantity, dependability, -and quality to provide water for the minor subdivision, including fire protection. Little Thompson Water District conditionally agrees to provide service to the proposed development. Provision has been made for individual septic disposal systems -for the Minor Subdivision which will be installedaccording to Weld County HealthDepartment regulations. Soil or topographical conditions which require specialprecautions have been identified by -the applicant; the proposed usesoftheseareas cante made compatible. -Streets within the Minor Subdivision willte adequate in functional-classific-ation, width and structural capacity to handle the traffic requirements oftheproposed use. Off -site street facilities providing access to the Minor Subdivision are adequate in functional _classification, width, and structural capacity to -meet the traffic requirements of theproposed use. Proposed access is from Weld County Road 60,a gravel -surfaced local road. 5511573 RESOLUTION, S-380 Tri -City Ventures, L.L.C. Page 2 Two accesses -to the Minor Subdivision will provide adequate access from Weld County Road 60 to internal streets knownas Willow Ridge Drive and Brookside Drive. No additional accesses to Weld County ROadMO will be created. The Minor Subdivision is not part of a minorsubdivision previously approved -by Weld County. Construction, maintenance, snow removal, and other matters pertaining to or affecting the road accessesand right -of -way -for the minorsubdivision will be the -sole responsibility of the resident land ownersMr developer. The minor subdivision will not cause -an unreasonable burden on the ability of local governments or districts to provide police -and fire protection, or other services. The Weld County Sheriffs Department has reviewed the proposal and has no conflict. Windsor/Severance Fire Protection District caniprovide service if certain conditions are met. The Utility AdvisoryCommittee reviewed the minorsubdivision final plat on June$, 1995, and conditionally -approved -the request. This recommendation is based, in part, upon a review of the -application materialssubmitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation forapproval is conditional upon the following: 1. Prior to recording the Minor Subdivision Final Plat: a) The Board ofiCounty_Commissioners shall approve the subdivision improvements agreement and the form of collateral. The security for the agreement shall be tendered and accepted by the Board_of County Commissioners for the subdivision improvements agreement. b) A completed _Utility Service Statement Block shall be placed on the plat. c) The road construction plan shall be amended to show 20 -foot radius, where possible, where Willow Ridge Drive -and Brookside Drive intersect with -Weld County -Road 60, and roadside drainage culvert -at Brookside Drive, as described in the memorandum dated May 25, 1995, from Don Carroll, Weld County Department of Public Works. d) A copy of the covenants approved by the Weld County Attorneys Office shall be ready to be recorded. e) The plat shall be amended to show the proposed equestrian trail and duck pond to be constructed on Tract -A. 0 The applicantshallprovide documentation to the Department of Planning Services indicating a willingness -to meet the five conditions required by the Little Thompson Water District, in a letter dated February 10, 1995, for the commitment of sixTesidential water taps. The conditions are: Payment of a $1,000 system impact fee per lot, due and payable upon the acceptance of the main line extension. All improvements to Water District facilities must conform to Water District specifications. 951673 RESOLUTION, S-380 Tri-City Ventures, L.L.C. Page 3 Applicant has the financial responsibility of extending the main water line from Weld County Road 60 to provide water service to the minor subdivision. Applicant is required to transfer one share of Colorado Big Thompson water for each lot added to the water system within the minor subdivision. Payment of a $2,000 fire hydrant fee for each hydrant added to the water system within the minor subdivision. 9) The applicant shall provide documentation to the Department of Planning Services indicating that all requirements of the State Division of Water Resources regarding the duck pond have met. 2. Prior to the Board of County Commissioners hearing: a) The applicant shall provide written documentation to the Department of Planning Services indicating that the Windsor/Severance Fire Protection District has approved fire protection plans for the Minor Subdivision. b) The applicant shall demonstrate that there is a legal right to consumptive use of the water in the duck pond. 3. The following notes shall be placed on the Minor Subdivision Final Plat: a) Uses permitted within the minor subdivision consist of E(Estate) uses as listed in the Weld County Zoning Ordinance and described in the application materials. b) Access to the lots within the minor subdivision shall be from Weld County Road 60. Two accesses to the minor subdivision, as shown on the plat, shall be allowed from Weld County Road 60. Lots 1, 2 and 3 shall access Weld County Road 60 from the west access known as Willow Ridge Drive; Lots 4, 5 and 6 shall access Weld County Road 60 from the east access known as Brookside Drive. No additional accesses shall be permitted. c) Little Thompson Water District shall provide water service to the minor subdivision. d) Sewer service shall be provided by individual septic disposal systems approved by the Weld County Health Department. e) All lots within the minor subdivision shall comply with the requirements of the Windsor/Severance Fire Protection District. f) The Minor Subdivision shall be composed of no more than six rural residential lots and one outlot known as Tract A, which is proposed as private common open space for use by lots owners. g) No permanent structures shall be built on Tract A. h) Tract A shall be owned and maintained jointly by Meadowbrook Farm Community Association. i) The two internal streets within the minor subdivision, known as Willow Ridge Drive and Brookside Drive, are private and shall be constructed with a 40 -foot right-of-way, and in all other respects shall be built to County standards. The streets shall be maintained by the homeowners association, lot owners or developer. j) No on -street parking shall be allowed within the Minor Subdivision. 951673 RESOLUTION, S-380 Tri-City Ventures, L.L.C. Page 4 k) Installation of utilities shall comply with Section 10 of the Weld County Subdivision Ordinance. I) Any work taking place in an existing wetland within the Minor Subdivision shall meet the requirements of the Department of the Army Corps of Engineers for permits pursuant to Section 404 of the Clean Water Act. m) No permanent structures shall be built on the Panhandle Eastern 50 -foot right-of-way easement for its pipeline. A minimum of 42-inchsover is required over the pipeline. n) A soils and foundation investigation report prepared by a qualified soils and foundation engineer shall be -submitted with each building permit application, in accordance with the Geotechnical Engineering Report prepared by Empire Laboratories, Inc.and dated October 20, 1994. The applicant is requesting a 40 foot right-of-way for each of the two interior streets of this minor subdivision, rather than the 60 feet which is the usual standard for county streets. According to Section 10.1 of the Weld County Subdivision Ordinance, all subdivisions except minor subdivisions must comply with the design standards, including road specifications, set forth in this section.. In response to a letter regarding this matter from Art Urich of Nelson Engineers, former Director of the Department of Planning Services Chuck Cunliffe verbally indicated that the 40 foot right-of-way streets as requested would be acceptable.
