RESOLUTION
RE: APPROVE RELEASE OF COLLATERAL - PHASE 1 OF DOS RIOS ESTATES,
SECOND FILING, CIO JOYCE J. ALLELY(S #385)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 18, 1996, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements (Publicly
Maintained Roads) with Joyce J. Allely, for Phase 1 of Dos Rios Estates, Second Filing
(S #385), concerning property described as a portion of Section 34, Township 5 North,
Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, pursuant to said Improvements Agreement, an Agreement dated
February 26, 1996, among Norwest Bank Colorado, NA, the Weld County Board of County
Commissioners, and Joyce Allely, as an alternative form of collateral, for an amount up to
$63,507.00, was submitted to Weld County, and
WHEREAS, Don Carroll, Project Coordinator for the Weld County Public Works
Department, has conducted a visual inspection and recommends release of said collateral for
improvements completed, and
WHEREAS, upon recommendation of Lee Morrison, Assistant County Attorney, and the
Planning staff, the Board deems it advisable to release $44,880.16 of said collateral, in
accordance with the terms of said Improvements Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that $44,880.16 from the Agreement among Norwest Bank Colorado,
NA, the Weld County Board of County Commissioners, and Joyce Allely, be, and hereby is,
released for improvements completed in Phase 1 of Dos Rios Estates, Second Filing (S#385).
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

COLORADO DATE: October 28 , 1996
A request has been submitted from Lonnie Ochsner of Norwest Bank for Weld County to authorize release
of funds by the bank for completed improvements to Dos Rios Second Filing, Phase One. The completed
improvements for which a draw is being requested include construction of paved streets and fire hydrants.
Don Carroll of the Weld County Public Works Department has inspected the items and in his memorandum
of October 25, 1996, indicates that he has no conflict with the release of funds. Lee Morrison,Assistant
County Attorney, has advised that the release of funds would be in accordance with the terms of the
Improvements Agreement.
Staff recommends that the Board consent to draw on the construction loan in the amount of$44,880.16, as
requested by Norwest Bank, for improvements completed in Phase One of Dos Rios Subdivision, Second
Filing.

Subject: Request for Release of Collateral
At the request of the applicant (Joyce Allely), I performed a site inspection on Phase I
Improvements. The following items have been field verified to my satisfaction and may be released
from Exhibit "A" or Exhibit "A-1" dated June 29, 1996. The improvements are street grading, street
base, street paving, culverts, fire hydrants, and erosion control (straw bale dikes).
The remaining improvements on the Exhibit "A" have not been field verified or do not exist at this
time.
See the attached Exhibit "A" and Exhibit "A-1" for verification.

This agreement dated February 26,1996 between Norwest Banc Colorado,NA(The Bank);the
Weld County Board of County Commissioners(The County);and Joyce Allely(The Borrow)is
mutually recognized and agreed upon by all parties as of this date.This agreement is entered into as an
alternative form of collateral under the Weld County Improvements Agreement northing collateral An
mad improvements of the Dos Rion Estates Second Filing(Phase 1)development.

Norwest Bank Colorado.NA.agrees to unconditionally advance up to,but not exceeding, ---
$63,507.00 as per the Borrower's construction budget and approved plat,for the roads portion of the Dos
Rios Estates Second Piling(Phase 1)development.For disbursement control purposes,the Bank will
review the monthly progress of the road construction with a designated representative of the County and
will disburse for payment only idler the County has approved said disbursement.Any remaining
undisbursed drone of the$63,507 budgeted,will be available for construction of the roads should the
Borrower be in dathuit of the Weld County Improvements Agreement with respect to construction of the
roads.The Bank and Borrower understand the County will require an Irrevocable Letter of Credit for 10%
($6,400)as a contingency fund which will be available to the County for one year commencing on the day
the roads are accepted for temporary maintenance by the County.(Please provide the Bank with your
desired Letter of Credit format,and the stated terms under which said letter could be drawn.)
This agreement pertains only to the roads portion of the project,and all other loan funds
committed for this development will be disbursed as per the loan agreement entered into between the
Bank and Borrower.No other ccntmitmettta are implied by this agreement

As per our agreement with Weld County,Norwest Bank will disburse funds to pay for road
preparation and paving only after the County has given consent for said disbursements. This
work has been completed and Don Carrot with your office has indicated to me that this portion of
the project has been completed as per the County's requirement. I ant therefore requesting
approval to pay Rest Way Paving$44,880.16 as per the al NOW l bill,
Additionally,the project has gone as planned, with in budget, and only the phone lines remain to
be installed. All other work has been completed. If you need any additional information please do
not hesitate to contact me.
