RE: AUTHORIZATION OF ACCOUNTING TRANSACTIONS CONCERNING SOCIAL
SERVICES LITIGATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the County of Weld attempted to turnback Social Services programs in
accordance with Article X, Section 20, of the Colorado State Constitution, and
WHEREAS, the District Court Order to permit said action was reversed by the State
Supreme Court on June 5, 1995, and
WHEREAS, in previous years certain accounting and budget transactions were made based
upon the District Court ruling that now must be adjusted as a result of the Supreme Court ruling,
and
WHEREAS, the Director of Finance and Administration and Comptroller recommend that
the transaction to advance funds to the Social Services Fund in the amount of $920,440 from the
Contingency Fund in the amount of $440,948 and the Emergency Reserve Fund in the amount of
$479,492, be reclassified as a transfer of funds and not as an advance of funds, and
WHEREAS, the Director of Finance and Administration and Comptroller recommend that
the emergency reserve in the Emergency Reserve Fund in the amount of $800,000 be eliminated
by unreserving it.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, hereby concurs with the above recommendations and hereby authorizes the
above accounting transaction to be made in fiscal year 1995.
