AND NANCY VROOMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2291, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #2291 was submitted by D. and Nancy Vrooman, 25303 Weld County Road 53, Kersey, Colorado 80644, for property which is located in part of Lot B of Amended Recorded Exemption #659, being part of the NEY SE% of Section 29, Township 5 North, Range 64 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 5.5 acres and 4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2291 submitted by D. and Nancy Vrooman be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for the proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. The applicant shall submit a sketch of the existing septic system in relation to the proposed lot line to the Weld County Health Department. The applicant shall submit evidence of Health Department approval to the Department of Planning Services. B. In accordance with Weld County Public Works Ordinance #180, Lot A shall be granted on residential/agricultural access from the 40-foot utility, ingress and egress easement. No additional access to Weld County Road 53 will be allowed. Lot B shall utilize the existing residential and agricultural access point. C. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the Zone District in which the property is located. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits on Lot A, the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The 10 acre parcel is located west of and adjacent to Weld County Road 53 and approximately one mile south of Weld County Road 54-1/4. The parcel of land under consideration is the total contiguous land holdings of the applicant. Based upon submitted information, referral agencies, and the governing mechanism of the County, the Department of Planning Services' staff has determined that the applicant has not provided sufficient justification and recommends this request be denied. The applicant is requesting to divide a parcel which has already been involved in two recorded exemption applications (RE-659 and AmRE-659). Staff believes the applicant is proposing an evasion of the intent of the recorded exemption process by creating multiple lots without utilizing the appropriate subdivision process. This application, if approved, would contribute additional residential lots to the Agricultural zone district, resulting in urban scale development as defined by Section 2.21 of the Weld County Subdivision Ordinance. Staff has the following concerns: 1. The applicant has not demonstrated that this application is consistent with efficient and orderly development in accordance with Section 1.3 of the Subdivision Ordinance. This is the 8th request for a recorded exemption in the East'%of this section, two of which (RE-860 and RE-1030) were denied by previous BOCC resolutions. The parcel in question is currently 70 acres less than the minimum lot size, having already been divided several times as follows: • 2/10/83-the 80 acre parcel described as N1/2 SE1/4 was divided into 2 - 40 acre parcels without utilizing the recorded exemption process • 1/30/84- RE-659 was approved, dividing the eastern 40 acre parcel into 2 - 20 acre parcels • 4/18/84 - AmRE-659 was approved, reducing the size of Lot B of RE-659 to 10 acres, the remainder to be included with adjacent property • Present- RE-2291 is requesting that Lot B of AmRE-659 (10 acre parcel) be divided into Lot A (4 acres) and Lot B (5.5 acres) q2 590 The granting of another recorded exemption would result in yet another residential lot in the agricultural zone district. 2. Section 10.5.10 of the Weld County Subdivision Ordinance states, "A flag lot configuration shall be avoided when possible." This application proposes a flag lot configuration. 3. The applicant has failed to comply with the A(Agricultural)zone district intent. This parcel is located outside of an Urban Growth Boundary Area. Continued division of this parcel emphatically opposes the intent of the A(Agricultural)zone district. The potential to interfere and encroach upon the agricultural activities of this area is evident. The A (Agricultural) zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not to be continually decreased for residential development. The Agricultural zone policies discourage the conversion of agricultural land for residential uses within an area located outside of an urban growth boundary. The intent is to eliminate incompatibilities that exist and minimize costs to Weld County tax-payers. 4. Weld County Comprehensive Plan R.Policy 3 states, "Weld County should encourage a compact form of urban development by directing residential growth to urban growth boundary areas and to those areas where urban services are already available before committing alternate areas to residential use." 5. The conflict between rural and urban activities is evident in this request. When an urban growth pattern is established without regard to long range comprehensive planning the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban sprawl areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict and competition with agricultural areas. The Department of Planning Services'staff recommendation of denial for this request is based upon the application's inconsistency with Section 1.3 and 10.5.10 of the Weld County Subdivision Ordinance, which ensures orderly and efficient subdivision development within the county, the Agricultural zone district of the Weld County Zoning Ordinance, R.Policy 3 and conflict with A. Goals 1, 3, 4, 6, 7, and 9 of the Comprehensive Plan, which define appropriate development goals and policies within the Agricultural zone district. Scattered residential development in rural areas necessitates an increased demand for roads and bridges, police and fire protection, education facilities, utilities and other services. The cost of providing services and the conflicts between rural and urban land uses can be reduced if development is encouraged within urban growth boundary areas or are adjacent to existing municipalities. The Department of Planning Services' staff requests that the Board of County Commissioners consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld County Comprehensive Plan. "The applicant is requesting to divide a parcel which has already been involved in two recorded exemption applications (RE-659 and AmRE659). The parcel in question is currently 70 acres less than the minimum lot size, having already been divided several times. . ." We have owned our lot since 1984, and we have never divided it. Our lot was created by RE 659, approved in January 1984,which divided the east half of the southeast quarter into two twenty acre parcels. The west half of the southeast quarter constituted a separate forty acre parcel. Prior to RE 659, there was one buildable lot in the east half of the southeast quarter. After RE 659 there were two. In April 1984, RE 659 was amended by reducing the southern twenty acre parcel to ten acres (our parcel) and increasing the west half of the southeast quarter to fifty acres. No new buildable lots were created by this amendment. 2. ". . . the applicant is proposing an evasion of the intent of the recorded exemption process by creating multiple lots without utilizing the appropriate subdivision process." The Subdivision Ordinance, Section 11.2.1 states: The recorded exemption is a subdivision process used to divide a lot, not located in an approved subdivision, into two separate lots. We are proposing to divide our ten acre lot,which is not in an approved subdivision, into two parcels of approximately five acres each. We do not know what the staff believes would be the appropriate subdivision process. It would not be feasible for us to do a minor subdivision on this property. 3. "This parcel is located outside of an Urban Growth Boundary Area." Our parcel is located within the secondary urban growth boundary of the Town of Kersey. The Town provided a letter stating that our application created no negative impact on its growth plan. g8/S90 5 . "The potential to interfere and encroach upon the agricultural activities of this area is evident. The A (Agricultural) zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not to be continually decreased for residential development " Although our ground is zoned "A," it is not prime agricultural land. It is dryland pasture grass and sage, and there is no irrigation water with the property. We currently graze one horse and one mule, and we have to supplement their feed daily with alfalfa hay and grain. The division of our parcel will not result in any change in the agricultural use of our land. In fact, it should be easier for two families to maintain parcels of 5.5 and 4 acres than for one family to maintain all 10 acres. Also, there is not any crop farming immediately adjacent to our property. Most people in the area use their land just as we do. 6. "Weld County Comprehensive Plan R. Policy 3 states, 'Weld County should encourage a compact form of urban development by directing residential growth to urban growth boundary areas and to those areas where urban services are already available before committing alternate areas to residential use. '" Public water and electricity are already available on our property. Our home is served by a septic system, and the proposed second lot is adequate in size for septic. We are not creating any new road access. The fire department has provided a letter supporting our application. Also, Weld County School District RE-7 has specifically stated, in a letter submitted to the Department of Planning Services, that there is already a bus stop serving our parcel and that they do not see a significant impact on school facilities from our request. 7. "When an urban growth pattern is established without regard to long range comprehensive planning the outcome lacks the essential elements of long term desirability. " Residential growth has been occurring in this area for many years. There have been at least 7 recorded exemptions approved since 1996 within one mile of our property. In addition, there are two subdivisions nearby. The urban growth pattern is already established in this area. Our application meets all of the standards of Section 11 .8 of the Subdivision Ordinance, and it will cause no significant change to the existing area. Just this year, the county has approved four recorded exemptions in the area, including one in the quarter section just north of our property which was virtually the same as our application in terms of its impact on the area. Our Board of Education reviewed the Vrooman's request and found it not to be in conflict with our interests. The following paragraphs explain what we reviewed to come to that decision. The essence of the request is to divide the roughly 9.5 acres they own at that location into one 4 acre parcel to be sold as a new building site and to have the remaining 5.5 acre parcel with their current house and outbuildings to be the second parcel. As we reviewed this request we looked at the fact that there is already a bus stop at the lane going west past the Vrooman property and accommodating other property further to the west. Therefore it did not require an additional bus stop and both parcels are within the 1/4 mile lane requirement of our school district so it does not require a bus to leave WCR 53. In November of 1997, our school district passed a bond issue because of increased growth within the area and because of one existing residential development in progress and one that was in the talking stages. Our Board of Education is of the persuasion that all developers, whether it be the developer of an 80 acre annexed area or a 4 acre recorded exemption such as the Vroomans or a 5-7 acre recorded exemption from the corner of a pivot sprinkler, should be dealt with in a like manner. Until the school district gets an IGA approved by the Town of Kersey, we feel it is unfair to assess the Recorded Exemptions in the rural areas and not the developers within the town limits. We wish to address each of the major issues raised by the planning staff. 1. Intent of the Recorded Exemption Process. The planning staff stated that we were "proposing an evasion of the intent of the recorded exemption process by creating multiple lots without utilizing the appropriate subdivision process." To the contrary,we believe the recorded exemption is the appropriate process in our circumstance. Section 11.2.1 of the Subdivision Ordinance states: The recorded exemption is a subdivision process used to divide a lot, not located in an approved subdivision, into two separate lots. That is exactly what we are seeking to do. Furthermore,we are seeking the recorded exemption for the purpose of creating a lot for a single family residential building site, one of the purposes approved in the Ordinance. The planning staff also stated that the parcel in question had been divided several times. In fact, we have owned our parcel since 1984, and we have never sought to divide it. In 1984, there were two 40 acre parcels. One of those parcels was divided into two 20 acre lots by recorded exemption, thereby increasing the buildable lots from two to three. Then, later that year, the recorded exemption was amended. One lot was reduced to 10 acres -that is the lot we purchased. The remaining 10 acres were added to the second 40 acre parcel. No new building sites were created as a result of this amendment. 2. Flag Lot Configuration. We also take issue with the planning staffs representation that we are proposing a flag lot configuration. We are proposing a common access easement from WCR 53. The access already exists,and it is already used by two other properties west of our parcel. No new access to WCR 53 will be required by our application. g EXHIBIT 3 . Intent of the Agricultural Zone District. Although our ground is zoned "A," it is not prime agricultural land. It is dryland pasture grass and sage, and there is no irrigation water with the property. We currently graze one horse and one mule, and we must supplement their feed daily with alfalfa hay and grain. The division of our parcel will not result in any change in the agricultural use of our property and will not create any incompatibilities with the agricultural uses in the area. For the most part, all of the agricultural activity adjacent to our property is similar to ours - grass for pasture which supports very few animals. We think that our land would be easier to manage if two families were taking care of smaller parcels as we are proposing in our application. 4. Urban Sprawl. The planning staff suggests that the division of our parcel will result in urban sprawl. However, the comprehensive plan of the Town of Kersey states that: "From the perspective of preserving prime agricultural land, it is preferable for Kersey to expand south where the soils are sandy and not well suited to agricultural use." Our land is located in an area that Kersey has designated as a low density residential area, and it provided a letter stating that our application created no negative impact on its growth plan. Furthermore, within a two mile radius, there are at least two subdivisions as well as numerous recorded exemptions. In 1998, the county has already approved four recorded exemptions within one mile of our property; there have been at least seven since 1996. Although one additional residence may have some minor effect on the demand for services, we do not understand how, given the existing demand, our request differs in impact from the other recorded exemptions which you have approved. Public water is available; electricity is available; and the new lot will be of more than adequate size for a septic system. Additionally, the fire department has no objection to our application, and Weld County School District RE-7 has specifically stated, in a letter it submitted to the Department of Planning Services, that there is already a bus stop serving our parcel and that they do not see a significant impact on the school facilities from our request. Just one year ago, the planning staff approved a recorded exemption on property less than one mile north of our property. At that time, the staff found none of the conflicts which it now states exist with our property, even though there is virtually no difference between the impact of our application and the one which was approved. We have reviewed the Recorded Exemption Standards set forth in Section 11 .8 of the Subdivision Ordinance.
