RESOLUTION
RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL - ORR
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 29, 1993, the Board did approve an Improvements
Agreement According to Policy Regarding Collateral for Improvements for Private Road
Maintenance with Ed Orr for a Minor Subdivision Final Plat approved on August 30, 1993,
concerning property described as part of the NE% of Section 32, Township 6 North, Range 66
West of the 6th P.M., Weld County, Colorado, and
WHEREAS, pursuant to said agreement, a Cashier's Check #13977, drawn on the First
National Bank of Greeley, in the amount of $10,825.00, was submitted to Weld County, and
WHEREAS, by Resolution dated December 22, 1993, a partial release of funds was
approved in the amount of $10,212.50, leaving a balance of $612.50 being held by Weld County,
and
WHEREAS, upon recommendation of the Department of Planning Services, the Board
deems it advisable to release the balance of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that collateral in the amount of $612.50, be, and hereby is, cancelled and
released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

SUBJECT: Orr Minor Subdivision --Release of Collateral
Ed Orr is requesting the release of $612.50 being retained by Weld County as collateral for the
construction of a private street known as Rocky Road in the Orr Minor Subdivision. All
requirements of the Subdivision Improvement Agreement have been met by the applicant. The
County Attorney's Office and Public Works Department have no objection to the release of
funds. Staff recommends that the County Commissioners approve the release of collateral to
Mr. Orr.

Release of Funds; Improvements Agreement for On
Planner Subdivision
At the request of David Miller, an employee of Mr. Orr's, I reinspected the site to verify two items
that needed to be resolved from my previous inspection on December 22, 1994. Additional road
gravel in the curve area was completed, and a drainage swell was constructed between Lots 3 and
4 to accommodate the drainage through the subdivision. Both items have been completed to my
satisfaction.
I have no conflict with releasing any roadway or drainage securities that may be held at this
particular time.

SUBJ: S-339, Orr Minor Subdivision; Request for release of funds
Dear Ed:
You requested release of funds held by the County in accordance with the Orr Minor
Subdivision Improvement Agreement recorded in November, 1993. Copies of this request were
forwarded to Assistant County Attorney Lee Morrison and Don Carroll of the County Public
Works Department for their review.
Don Carroll has inspected street improvements in the subdivision; a copy of his response is
attached. He is requesting that additional drainage and gravel work be completed prior to
release of the collateral.
If the work is completed as requested and if Lee Morrison sees no conflict with the release, we
will schedule this item on the County Commissioners' agenda for their approval. The
Commissioners' resolution authorizing partial release of funds for completion of the street
improvements was dated January 11, 1994. Therefore, the one-year retainage period by the
County will terminate on January 11, 1995, and we may act on the request any time after that
date.

On December 22, 1994, I visited the site at the request of the applicant to verify that all of the
improvements have been completed.
According to the plans and specification of the grading and drainage plan, the grass -lined
drainage swell between Lots 3 and 4 has not been constructed to accommodate drainage from
both sides of the cul-de-sac to drain water away to the south. On the road section, there are two
spots where the gravel has been lost in the curve area and the straight away section. About one
or two truck loads of gravel would cure this section.
These two items need to be addressed and completed prior to releasing the remainder of the
funds.

RE: Correction Plat of Orr Minor Subdivision

Dear Gloria,
This letter is to request a correction plat of the Orr Minor
Subdivision in order to correct one technical error in the approved
plat. It has recently been discovered that the North boundary line
of Lot 1 is off by a distance of 30 feet, for length of 198 feet.
This equates to 5940 sq. ft. which Lot 1 will be reduced by. Lot
1 is presently 2.91 acres and will be reduced by 0.14 acres,
reducing Lot 1 to 2.77 acres.
The existing physical pens on the property are already set at the
proposed correction to the plat. The error is only on the Plat,
and the correction will not affect any Public Rights of Way,
Utility Easements, or Accesses.
Please submit this request for a correction to the Board of County
Commissioners for their approval under Section 8.5 of the Weld
County Subdivision Ordinance. If you have any questions please
