RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST GAIL MILLER (GOMEZ) FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Gail Miller (Gomez), VI #9900116, is allegedly in violation of the Weld
County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of July, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Gail Miller (Gomez), property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 13, 1999, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Gail Miller (Gomez) to remedy the violation of the Weld
County Building Code Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until September 13,
1999, to allow adequate time for the property owner to bring the subject property into
compliance.

June 21, 1999 Contact was made with Gail's Mom. Message was left for Gail. She also mentioned
that Gail didn't get off work until 3:30 p.m. and because I was only available in the
mornings, it would be difficult for Gail to get in contact with me to discuss her options.
June 22, 1999 Gail returned my call in the afternoon and left a message on my voicemail. She
mentioned that she was still having some financial problems and would need a little
more time to complete the inspections. She also mentioned that it would be hard for
both of us to get in contact with each other due to our different time schedules.
June 24, 1999 Contact was made with Gail's Mom. I recommended that Gail attend the hearing to
discuss her situation with the Board of County Commissioners. Message was left for
Gail regarding the scheduled hearing.
June 24, 1999 Contact was made with Gail. She returned my call from work. I explained everything
to her and told her that my recommendation was for her to attend the board meeting
scheduled for July 13, 1999 to explain her financial situation and to discuss her options.
She will be attending the meeting on the 13th of July, 1999.
June 24, 1999 Scheduled Hearing Letter was sent out by Joe Mendez.

The property referenced above remains in violation of the Weld County Building Code Ordinance. I
have scheduled a meeting with the Board of County Commissioners on July 13, 1999 , at 10:00 a.m.
to consider the violation occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance to answer any questions
the Board of County Commissioners might have about the violation. This would be a prime
opportunity for you to explain your financial situation and to request an extension to complete the
necessary inspections and to close out this violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation if
you or a representative are not available. Our records indicate that you were made aware of the nature
of the violation, the action necessary to correct the violation, and that you were given sufficient time to

however, we have no discretion in this matter. If you fail to correct this violation by April 24, '.999, it will
be scheduled for a hearing before the Board of County Commissioners to consider whether to refer this
violation to the County Attorney's office for legal action.
