RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JACKIE R. WEBB FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jackie R. Webb, VI #9700135, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 18th day of November, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jackie R. Webb, property owner, was not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Jackie R. Webb to remedy the violation of the Weld County
Zoning Ordinance, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified party.

The two campers are still located on the property and appear to be used as overnight or temporary
housing and there is a noncommercial junkyard still located on the property, therefore is a violation
of Sections 31.2, 31.2.1, 31.2.16, 31.3.9 and 43 of the Weld County Zoning Ordinance. To bring
the property into compliance the campers must not be used for any overnight or temporary storage
and the noncommercial junkyard must be removed from the property or screened from all adjacent
properties and public rights of way.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

SUBJECT: Webb, 1930 Railroad Diagonal Street
As requested, an inspection was conducted on September 4, 1997 of 1930 Railroad Diagonal Avenue in
Weld County near the Town of Evans by Troy Swain of the Weld County Health Department's
Environmental Protection Division. Julie Chester of Weld County Planning Services was also present
during the inspection and the following observations were made:
People appear to be living in the campers.
There was no water connection to the campers and sewage/liquid wastes were not being discharged.
The "residents" of the campers stated that they are using her sisters home across the street to take showers
and to use the toilet.
Based on the above inspection findings this situation does not pose a threat to public health and/or the
environment at this time, however the Environmental Protection Division will work closely with Planning
to monitor the situation. If you have any questions regarding this matter, please feel free to contact me at

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.1, 31.2.16, 31.3.9 and 43 of the Weld County Zoning Ordinance. This is not a use allowed by right
in the Agricultural zone district.
The violation can be corrected by removing the Recreational vehicles being used as dwelling units from
the property. The derelict vehicles and other miscellaneous items must also be removed from the
property or screened from all adjacent properties and public rights of way. If screening is to be used to
conceal the noncommercial junkyard, a detailed screening plan must be submitted to and approved by the
Department of Planning Services prior to installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from September 3, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter. Please call or write the
Department of Planning Services' office.
