HomeMy WebLinkAbout951291.tiffRESOLUTION RE: PROVIDE POLICY DIRECTION TO STAFF RESULTING FROM SPECIAL ELECTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 13, 1995, the voters of Weld County did approve a Home Rule Charter Amendment concerning the location and siting of correctional facilities, jails and prisons in Weld County, and WHEREAS, the Board has compiled a list of Policy Directions for staff, a copy of which is attached hereto and incorporated herein by reference. WHEREAS, after review, the Board deems it advisable to direct staff as detailed.in said document. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the attached document entitled Policy Direction be, and hereby is, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of June, A.D., 1995. Web 951291 CR0013 POLICY DIRECTION As a result of the passage of the amendment to the Weld County Home Rule Charter on June 13, 1995, dealing with the location and siting of correctional facilities, jails and prisons in Weld County, the Board of County Commissioners hereby gives the following policy direction to legal and administrative staff regarding related matters: 1. The Weld County Attorney is directed to prepare an ordinance implementing the provisions of Article XV, Section 15-5 of the Weld County Home Rule Charter. 2. The County Attorney is directed to prepare the necessary ordinance or c resolution olutifor on establishing a fee equal to the cost of a special election for any app siting of a facility covered by Weld County Home Rule Charter Article XV, Section 15-5 that chooses the option of requesting a special election for the siting of such a facility other than at a regularly scheduled countywide election in November of any given year. ome Rule Charter Article 3. Although the County Attoradvises that the jurisdictional undaries of the City of XV, Section 15-5 is .inapplicable within Greeley, the County Attorney is directed to prepare a ballot issue for the November 1995 general election with the question of whether a county jail shall be located and sited in Tract A of the Weld County Business Park, Greeley, Weld County, Colorado, in accordance Development with the (PUD) approved by the City of Greeley on April Planned Unit 4, 1995. 4. The Director of Finance and Administration is directed to inform the architect working on the county jail design, Bley and Associates, to delay release of any bid documents for the new county jail until after the November 1995 election. Bids will only be released if voter approval of the site is granted. 5. The Weld County Sheriff, and County and District Court judges shall be informed immediately that the construction of the new Weld County jail will be delayed at least one construction season pending voter approval of the jail site. 951291 CR0013 Hello
