RE: GRANT MOBILE HOME PERMIT #2018 - DALE AND MARTHA TURLEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 12th
day of August, 1996, considered the request of Dale and Martha Turley, 16423 Weld County
Road 20, Fort Lupton, Colorado 80621, for a mobile home to be used as a principal dwelling,
and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
W1/2 SW1/4 of Section 14, Township 2 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners, having heard the testimony, finds that
said request should be granted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Dale and Martha Turley for permission to place a
mobile home to be used as a principal dwelling on the above described parcel of land, which
was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and
hereby is, granted.

and water is provided by a domestic well (permit # 193332).
Parcel size: 80 acres, more or less
Access: The applicant has proposed an access to the property from WCR 20, west of
an existing access that serves the oil company.
Comments: Staff is recommending approval of this request. Other than the 70% of
surrounding property owner signatures, the applicant has met all other
requirements.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 40 acres described as the
SW1/4 of the SW1/4 of Section 14, Township 2 North, Range 66 West, 6th P.M.
4) The use of ground water from this well is limited to ordinary household purposes inside not more than three single
family dwellings, fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches,
and the irrigation of not over one acre of home gardens and lawns.
5) Production from this well is restricted to the Laramie-Fox Hills aquifer which corresponds to the interval between
630 feet and 915 feet below ground surface. Plain casing shall be installed and sealed to prevent production from
other zones.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit
Note: To insure a maximum productive life of this well,perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.
Note: The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer
may be less than the 100 years upon which the amount of water in the aquifer is allocated, due
to anticipated water level declines. ALA/F�4

application meets the approval criteria of Section 43 of the Weld County Zoning Ordinance, as amended,
and you have submitted a petition with the signatures of at least 70%of the surrounding property owners
who have no objection to your request,you will be notified that the zoning permit is approved. If the staff
determines that the application does not meet the approval criteria,you will be notified and asked to appear
