Michael Croissant We have conducted an initial review of the submitted materials associated with this USR application. It appears that there will be four(4)retention basins associated with the facility. However, all four of these basins are located outside of the proposed permit area. It is our opinion that the retention basins should lie within the permitted area. The retention basins must be designed to meet certain specifications and if not managed appropriately could pose a threat to both the environment and surrounding properties. Thus they should be subject to review with this permit. Therefore, we recommend that either the applicant amend the permitted area or the retention basins be designed so that they lie within the permitted area. We have divided the recommendation into conditions of approval and development standards. We recommend that the applicant meet the following conditions prior to recording their plat: 1) The facility shall demonstrate that the surface water control plan, prepared by Acklam Associates, dated September 12, 1997, has been constructed. At a minimum, the facility shall submit for approval as-built drawings of the drainage features and the retention structures to the Weld County Health Department. 2) All five (5) monitoring wells shall be installed as described in the June 1997 Groundwater Monitoring Plan,prepared by LT Environmental. Evidence of installation shall be provided to both the Weld County Health Department and the Colorado Department of Public Health and Environment. 3) A dust abatement plan shall be submitted to the Weld County Health Department for review and approval. The facility shall have sufficient water available to implement dust control as required by the Weld County Health Department. 4) A fly abatement plan shall be submitted to the Weld County Health Department for review and approval. 5) An odor abatement plan shall be submitted to the Weld County Health Department for review .and approval. 6) The facility shall provide evidence to the Weld County Planning and Health Departments that an appropriate financial assurance mechanism has been secured in accordance with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). We recommend that the following conditions be incorporated as development standards: 1) The Weld County Health Department, Weld County Planning Department, and the Solid Waste Section of the Colorado Department of Public Health and Environment shall be notified in EXHIBIT 981538 /0 H. Michael Croissant Page 2 writing of any new materials (other than manures/bedding and wood chips) proposed for composting. Written approval to proceed with composting shall be obtained from the Weld County Health Department and Colorado Department of Public Health and Environment prior to receipt of the new material. Submittal information shall include operational procedures and storage procedures. All materials considered for composting shall meet current and future regulatory requirements for that specific material. No dead animals shall be composted on site. 2) Any portable fueling equipment shall be kept within a bermed area. The berm shall be lined and designed to contain 120% of the total tank capacity contained within the bermed area. 3) The facility shall have adequate equipment to dewater each retention structure. Each retention structure shall be dewatereed to a level that restores the full runoff storage capacity within a 15- day period following each storm event. 4) No stockpiling of raw material such as manure/bedding, food waste, biosolids, or any other approved putrescible material shall be allowed on site. All raw, uncomposted material shall be placed in windrows unit within 72 hours upon receipt at the facility. Windrows shall be no larger than 8-feet in height and 20-feet in width. This is not meant to include the temporary stockpiling of finished compost. In the event processing units, other than windrows, are to be incorporated at the site, a detailed description of the unit and processing requirements shall be provided to the Weld County Health Department for review and approval. The description shall include literature and other examples that demonstrate the unit is an effective composting process. 5) All windrows shall be turned a minimum of every ten(10) days. This shall not include bulking agents such as wood chips, grass clippings, etc. and liquids stored within approved closed storage tanks. 6) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7) No permanent disposal of wastes shall be permitted at this site. 8) Waste materials shall be handled, stored,and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 10) An individual sewage disposal system is required if any type of an office facility is located on the site for the facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. A vault system shall be acceptable. If a vault is installed, pumping 981538 H. Michael Croissant Page 3 records shall be kept for review. A portable toilet facility shall be provided and maintained on site until such time a permanent individual sewage disposal system is installed. 11) The facility shall operate in a manner to control flies in accordance with its approved fly abatement plan. Additional fly control measures shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints and, in the judgement of the Health Officer, there exists a fly condition requiring abatement. In the event the facility creates nuisance conditions as the result of excess flies, at the request of the Health Officer,the facility shall develop a method of tracking and recording the dates that record the following activities: a) The date each load of manure is delivered to the site; b) The date each load of manure is placed in windrows; c) The date each windrow has been turned; d) The date the manure has been removed from the facility. The method of recording shall be approved by the Health Officer. These records shall be provided at an interval as determined by the Health Officer, until the Health Officer determines that the facility no longer poses a nuisance. 12) Any solid waste as defined in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed of at an approved sanitary landfill. 13) The facility shall have on site and available to the Weld County Health Department, Weld County Planning Department, and Colorado State Health Department at all times the specific procedures to handle the following: a. hazardous materials received on site b. contamination or discharge of water from the site c. odors in excess of established limit d. flies determined to be a nuisance condition e. dusty conditions 14) The facility shall be operated in a manner that controls odor in accordance with its approved odor abatement plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional odor abatement measures shall be implemented at the request of the 981.538 H. Michael Croissant Page 4 Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold or, in the judgement of the Weld County Health Officer, there exists an odor condition requiring abatement. 15) The facility shall be operated in a manner to control fugitive dust in accordance with its approved dust abatement plan. Additional dust abatement measures shall be implemented at the request of the Weld County Health Department in the event it is determined that dust (that can be determined to be originating at the facility) is a nuisance condition. 16) The Special Review Permit site and facility shall be operated in compliance with any required Air Emission Permit approved by the Air Pollution Control Division of the Colorado Department of Public Health and the Environment. 17) A metal sign shall be posted at the facility entrance. the sign shall be a minimum of three feet in width and four feet in length. The sign shall state the following: a. name of operation b. type c. emergency phone numbers of the facility operator 18) The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) the facility shall also comply with any composting regulations promulgated Pursuant to the Solid Waste Act, Section 30, Article 20, Part 1, C.R.S. 19) In the event a residential home is constructed on the property, it shall be served by a individual sewage disposal system in accordance with the Weld County ISDS Regulations. 20) In accordance with the June 1997 Groundwater Monitoring Plan, prepared by LT Environmental, the facility shall submit a report summarizing the procedures and analytical results to the Weld County Health Department and the Colorado Department of Public Health and Environment after each sampling event. 21) After completion of background groundwater monitoring (as described in the June 1997 Groundwater Monitoring Plan,prepared by LT Environmental)an appropriate statistical method shall be selected and utilized to determine if an impact to groundwater has occurred. The statistical method must be approved by both the Weld County Health Department and the Solid Waste Unit of the Colorado Department of Public Health and Environment. 22) All aspects of the facility's groundwater monitoring plan and subsequent monitoring activities shall comply with Section 2.2 and Appendix B and all other applicable portions of the Regulations Pertaining to Solid Waste Disposal Sites and Facilities and any other applicable Rule or Regulation. 951539 H. Michael Croissant The Weld County Public Works Department has reviewed this proposal; the following requirements are recommended to be a part of any approval: COMMENTS: I spoke with the applicant to verify the access point to proposed WCR 35. He indicated they would utilize the existing access and not access onto WCR 12. In the second phase of the Buffalo Ridge Subdivision Improvements Agreement, WCR 35 will be extended south from WCR 12 The applicant, Mr. Croissant, has a signed agreement with Martin Brothers to improve the access point onto WCR 35, including a drainage culvert. This agreement was drafted as a part of additional right-of-way granted to provide a 60-foot access to Buffalo Ridge Subdivision. The extension of WCR 35 will be designated as a local paved road at full build out and will be maintained by Weld County. REQUIREMENTS: Storm Water Drainage: The Weld County Health Department will verify all calculations related to storm water runoff at this proposed site because of the ag related use. There is an existing access from WCR 35 to the proposed 10-acre composting site. Chester, Weld County Planner FROM: Platte Valley Soil Conservation District RE : Site Specific Development Plan and Site Plan Review for a Composting Facility, Case # RE-2214 With the assistance of the Natural Resources Conservation Service (NRCS) we have reviewed this application and have the following concerns : SITE CONDITIONS *************** At the time of our site visit, there was a considerable amount of blowing soil and compost due to moderate winds . This kind of erosion must be controlled by making sure that the compost is kept damp and that the alleys are also kept damp or are well compacted. Water from the existing well could be used for this purpose . We also noticed that the surrounding land was currently occupied by annual weeds which are not adequate protection against soil erosion. This land should be farmed to high residue crops under minimum tillage or revegetated to the enclosed grass mix to prevent soil erosion and control weeds . In any event, maintaining a "top cover" of rye must be avoided if the rye is allowed to go to seed. Rye is only suitable as a winter cover crop and must be destroyed before seed production to prevent it from becoming an established weed problem. BUFFALO RIDGE ************* Buffalo Ridge Estates, a major subdivision, is located to the southeast . Prevailing winds from the northwest will carry noise and odorous dust to this residential area if not prevented. In addition, this facility is highly visible from WCR 35 and Buffalo Ridge Estates . A dense windbreak of two offset rows of Rocky Mountain Juniper or Eastern Redcedar planted along the south and east sides of the facility would provide a visual screen and absorb noise . Additional rows planted along the north and west sides would control soil and compost blowing. Contact the NRCS for technical assistance in planning these windbreaks . 981538 981538 REVEGETATION ************ The applicant mentioned that the land may be revegetated to either landscape or reclaim the site . For this reason, we are including a native grass mix and instructions for planting. The berm that will be constructed to divert storm water will also need to be planted to prevent it from eroding. Use the enclosed mix for this purpose as well, but double the rates since the steeper slopes will make grass establishment more difficult . SOIL LIMITATIONS **************** If a septic system is installed on the Olney loamy sand soil, it will encounter moderate limitations from a slow percolation rate . Installation on any other soil will meet with severe limitations because of poor filter materials . While there are no limitations for house construction, there are moderate limitations for small commercial buildings because of slope on the Valent sand, 3% to 9% slopes, and the Vona loamy sand 3% to 9% slopes . Sincerely, ` Platte Valley Soil Conservation District 981538 RECOMMENDED PRACTICES FOR GRASS SEEDINGS COVER CROP: If possible, plant a cover crop of long season grain sorghum, or forage sorghum from mid-May to mid- June before planting grass during winter. This cover will hold the soil and grass seed in place while the grass becomes established. Mow the cover crop before physiological maturity is reached to a height of 12" to 18" to prevent sorghum seed from sprouting next summer. Seeding rates should be five to ten pounds per acre for forage sorghum or two to four pounds per acre for grain sorghum, with the higher seeding rates used on clayey soils. Planting should be done from northeast to southwest if possible, or west to east if not. PLANTING: Sometime between November 1 and April 30 when the ground is unfrozen, plant the grass 1/4 to 3/4 inches deep in 7" to 12" rows. Planting should be done from northeast to southwest if possible, or west to east if not. Use a grass drill equipped with an agitator box, depth bands, and double disc furrow openers with the drop tube placement directly between the disks. MULCHING: New seedings not planted into a cover crop should be protected by a mulch of 4000 lbs. per acre weed-free native grass hay crimped into the soil surface. Crimping the hay into the soil surface will help prevent it and the grass seed from blowing away. It will also slow evaporation which will leave more water for seed germination, and retard weed germination and growth. WATER EROSION: Mulching may not be enough to prevent erosion on steep slopes or in areas of periodic water flow. In these areas, install silt fences perpendicular to the direction of water flow. This will help to prevent water from building up enough force as it flows to wash out the mulch or grass seed. FERTILIZER: Because many weed species emerge before the grass will, any fertilizer applied will be utilized by the weeds, making them even more competitive. No fertilizer is recommended for native grass seedings in this area. WEED CONTROL: Until the grass seedlings have reached a five leaf growth stage mowing is the preferred method of weed control. Mowing off the tops of the grass plants should be avoided. Timeliness of any weed control option is essential. Contact Colorado Cooperative Extension Service for herbicide recommendations, or NRCS for the best time for mowing operations. Weeds will need to be controlled with mowing or herbicides until the grasses are established, usually the first four years after planting. Once established, the grass can withstand heavy traffic or grazing. RECOMMENDED GRASS SEED MIX FOR H.
