A public hearing was conducted on October 27, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tern Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Eric Jerman Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 13, 1999, and duly published October 16, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Hoshiko Farms, Inc., Go Thomas Selders, W.S.W., Inc., for Change of Zone#529 from the A(Agricultural) Zone District to the 1-3 (Industrial) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Eric Jerman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Jerman gave a brief description of the location of the site, and explained this Change of Zone is for property approximately one acre in size, located east of and adjacent to a site Big R Manufacturing uses for the manufacturing and storage of pipe. He explained W.S.W., Inc., owns Big R Manufacturing and is storing the pipes on property it does not own, and Hoshiko Farms has been farming property it does not own. This Change of Zone will allow the interested parties to exchange ownership of land and continue the existing uses under the appropriate zoning. Mr. Jerman stated both W.S.W., Inc., and Hoshiko Farms have applied for a Subdivision Exemption for adjustment of a lot line, which was approved by staff, and establishes ownership for both parties on the land they are currently using. Mr. Jerman stated Change of Zone #529 changes the zoning on the land now owned by W.S.W., Inc., from A(Agricultural)to 1-3 (Industrial) to allow the existing use. He further stated the land owned by Hoshiko Farms will be zoned Industrial; however, since the farming began prior to zoning, staff has established Non-conforming Use#328 on the site for the current agricultural uses. Mr. Jerman stated the proposal is consistent with the Weld County Comprehensive Plan, surrounding uses, and it will have a minimal impact on the surrounding uses. Dennis Hoshiko, applicant, reviewed the Conditions of Approval and stated they are the responsibility of W.S.W., Inc., therefore, he has no additional comments. Tom Selders, represented W.S.W., Inc., and stated he will submit an application for the site plan review to staff within the next few days. 992623 P,(, PL1339 HEARING CERTIFICATION - HOSHIKO FARMS, INC. Commissioner Kirkmeyer moved to approve the request of Hoshiko Farms, Inc., do Thomas Selders, W.S.W., Inc., for Change of Zone #529 from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 1st day of November, 1999.
