HomeMy WebLinkAbout990838.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI #9900046 AGAINST DONALD AND KATHLEEN HUGHES FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado. pursuant to Colorado statute arid the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Donald and Kathleen Hughes, VI #9900046, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, on the 13th day of April, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Donald and Kathleen Hughes, property owners, were present at said hearing, and WHEREAS, at said hearing of April 13, 1999, the Board of County Commissioners determined the property is now in compliance, and deemed it advisable to dismiss said matter. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #9900046 against Donald and Kathleen Hughes be, and hereby is, dismissed. February 26, 1999 Meeting between Kathleen Hughes, Ben Patton, Planner and Sharyn Frazer. Mrs. Hughes stated that they are currently living in the smaller existing house and have overflowed into the detached garage. She agreed to vacate the smaller house upon issuance of the certificate of occupany on the new residence. She stated she would like to move her daughter into the smaller house at that time. Ben Patton explained that she would be able to apply for a recorded exemption to divide an acre that would allow her daughter to reside in the smaller house, however they would not be eligible for another recorded exemption until October. (Original exemption approved 10-12-94). February 26, 1999 Thirty day letter sent. April 1, 1999 Site inspection conducted by Frank Piacentino, Building Inspector. It appears that all of the residences are being lived in. The final inspections and the certificate of occupancy has not been issued at this time. April 2, 1999 Letter sent to Mr. and Mrs. Hughes scheduling them to appear before the Board of County Commissioners at the violation hearings on April 13, 1999, at 10:00 a.m. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties.
