RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
VI #9900046 AGAINST DONALD AND KATHLEEN HUGHES FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado. pursuant to
Colorado statute arid the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Donald and Kathleen Hughes, VI #9900046, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, on the 13th day of April, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Donald and Kathleen Hughes, property owners, were present at said
hearing, and
WHEREAS, at said hearing of April 13, 1999, the Board of County Commissioners
determined the property is now in compliance, and deemed it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #9900046 against Donald and Kathleen Hughes be, and hereby
is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 13th day of April, A.D., 1999.

February 2, 1999 Initial compliant received. Too many residences located on the property.
February 22, 1999 Five day letter sent.
February 26, 1999 Meeting between Kathleen Hughes, Ben Patton, Planner and Sharyn Frazer. Mrs.
Hughes stated that they are currently living in the smaller existing house and have
overflowed into the detached garage. She agreed to vacate the smaller house upon
issuance of the certificate of occupany on the new residence. She stated she would like
to move her daughter into the smaller house at that time. Ben Patton explained that she
would be able to apply for a recorded exemption to divide an acre that would allow
her daughter to reside in the smaller house, however they would not be eligible for
another recorded exemption until October. (Original exemption approved 10-12-94).
February 26, 1999 Thirty day letter sent.
April 1, 1999 Site inspection conducted by Frank Piacentino, Building Inspector. It appears that all
of the residences are being lived in. The final inspections and the certificate of
occupancy has not been issued at this time.
April 2, 1999 Letter sent to Mr. and Mrs. Hughes scheduling them to appear before the Board of
County Commissioners at the violation hearings on April 13, 1999, at 10:00 a.m.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

a meeting with the Bcard of County Commissioners on April 13, 1999, at 10:00 a.m., to consider t the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, First Floor,
Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation; and that you

The uses on the above described property are being considered as a zoning violation of Sections 31.2, 31.2.1 and
31.2.2 of the Weld County Zoning Ordinance.
I hank you for meeting with us today to discuss this situation As I explained in the meeting, this is the notice that
we send at this point. If you will call me upon receipt of the certificate of occupancy for the new residence, I will
document that the other structures have been vacated. It is the intention of this office to assist and cooperate with
you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this
violation. You have 30 (thirty) days from February 26, 1999, to correct this zoning violation. Failure to do so
will result in this office scheduling the violation before the Board of County Commissioners.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of any
assistance in clarifying or answering questions concerning this matter.
