RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DUFFIE E. JOHNSON FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Duffle E. Johnson, VI #9700001, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, a public hearing was held before the Board of County Commissioners on
12th day of August, 1997, at which time the Board deemed it advisable to continue said matter
to September 9, 1997, at 10:00 a.m., and
WHEREAS, at said hearing on September 9, 1997, Duffle E. Johnson, property owner,
was present, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until November 11, 1997, to allow adequate time for the property
owner to remove or adequately screen the noncommercial junkyard on the subject property to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Duffle E. Johnson to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until November 11,
1997, to allow adequate time for the property owner to bring the subject property into
compliance.

According to the Weld County Zoning Ordinance manufactured homes used as accessory to
the farm are temporary uses and must meet and maintain specifc standards. All zoning
permits for accessory to the farm use are temporary. The manufactured home shall be
removed from the property upon the cessation of the use of the manufactured home as
an accessory use (46.2.3.4).
The Weld County Zoning Ordinance is specific when it provides standards allowing for an
accessory, to the farm use; of these standards three are related to the agricultural use of the
site. The manufactured home will be occupied by persons customarily employed at or
engaged in the operation of the use where the manufactured home is located
(46.2.3.1.1), the manufactured home is necessary for the effective and economic
operation of the use and /or protection of the agricultural use (46.2.3.1.2) and the
manufactured home will not be used as an income source by the applicant for rental to
persons not principally employed upon the lot (46.2.3.1.3).
Because there is a limited number of animals located on the property, as of August 1997, ten
cows and several chickens, and because there appears to be very limited agricultural use, we
find it very difficult to substantiate the need for the accessory use. Therefore, we recommend
that the accessory structure be brought into compliance either by its removal or by converting
the use to a principal structure. A principal structure may be achieved by apply for and
receiving a recorded exemption. Should the applicant seek the recorded exemption process he
needs to beware that the recorded exemption must be evaluated based upon the standards as
set forth in the Weld County Subdivision Ordinance.

I, the undersigned, understand and agree to the conditions which follow:

The noncommercial junkyard is still located on the property and there is also a mobile home that
was allowed as an accessory to the farm that is not be substantiated at this time, therefore is a
violation of Sections 31.2, 31.3, and 31.3.9 of the Weld County Zoning Ordinance. To bring the
property into compliance the noncommercial junkyard must be removed from the property or
screened from all adjacent properties and public rights of way. The mobile home that is on the
property must be substantiated as an accessory to the farm or removed from the property.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have
scheduled a meeting with the Board of County Commissioners on August 12, 1997 at 10:00 a.m. to
consider the violations occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street,

questions the Board of County Commissioners might have about the violations.

Subject: Site Follow-up Inspection - Duffle Johnson's Property
Based on a complaint from a surrounding property owner, Julie Chester, Zoning Compliance Officer, and I did
a site visit on March 25, 1997. Information submitted to us from the surrounding property owner concerned the
construction of an addition to the principal residence on the property. Upon inspecting this site, the applicant
was in the process of building an enclosure to a cellar/basement type of construction underneath the house. The
approximate size of the entire structure is approximately 50 square feet. I informed Mrs. Johnson that a building
permit is needed for the construction.
Julie and I then inspected the rest of the site, looking for any type of indication that the property was in the
process of clean up. There had been quite a bit of work contributed, thus far, for the clean up of the property.
There were several piles located on the property containing tires and building materials. It was evident that the
residents of the property were trying to bring the site into compliance. There is still a concern regarding the
evidence of the grain bins located on the western side of their property and no obvious effort has been
contributed to getting rid of this material. The overall site looked much better than it had since my prior site visit.
There were no animals located on the property at this time, with the exception of three dogs.
Julie and I also drove by the accessory to the farm structure, which is located on the same site. It appears that the
structure is being lived in at this time and steps and landings are located in the front of the structure, as well as
the back of the structure. Based on prior research, we do know that we have not issued a final inspection for the
accessory to the farm permit, which I did mention to Mrs. Johnson that it would need to be taken care of.

I spoke to Mr. Guttersen today, January 30, 1997, concerning the Johnson violation on an adjacent
property. I conveyed to Mr. Guttersen that the Board of County Commissioners granted Mr. Duffle
Johnson six months to bring the property into compliance with the noncommercial junkyard
standard, as stated in the Weld County Zoning Ordinance. I also told Mr. Guttersen that at the end
of six months the Board of County Commissioners will readdress the issue of the accessory to the
farm permit. Mr. Guttersen was very upset with this information and said that he truly believes that
he was being discriminated against by our department and stated once again that Keith Schuett
specifically told him that he would not be able to do an accessory to the farm. Mr. Guttersens
contention is the fact that Mr. Johnson is able to do something that our department previously told
him that he could not do. I informed Mr. Guttersen that I didn't have any documentation to
substantiate the fact, that Keith Schuett disseminated that information to him. I told him that if he
had any information that I could look at that I would be more than happy to do so.
Mr. Guttersen was incredibly upset, particularly with two Commissioners (Kirkmeyer and Hall), and
felt the decision that the Board of County Commissioners made was based on personal issues and
Mike's standing in the community.
I told Mr. Guttersen that we would be diligent in this case and that we have to treat all cases the
same. Should he have any concerns with the cleaning up on the property, we would go out and
follow up on those issues. I explained to Mr. Guttersen that if he needed my assistance on this
case, I would be more than happy to go out and look at the case. Mr. Guttersen said that he would
probably visit with Commissioner Webster, and I concurred that he was very upset and perhaps
Commissioner Webster could provide further clarity about the Board's decision.
After I spoke to Mr. Johnson at 8:00, he did call back after 9:00 and wanted to make sure that we
would supply him with any additional correspondence pertaining to this case. As per a letter
requested by Mr. Guttersen's Attorney, we have already made an obligation to do this and that
information will be submitted to Mr. Guttersen in a timely fashion.

Dear Mr. Johnson:
On January 27, 1997, the Board of County Commissioners considered your request for an accessory to the
farm permit for the property described above. The Board of County Commissioners also considered the letter
that you submitted to the Department of Planning Services, which specifically delineated the number of animal
units proposed for the property. In your letter you requested that the Board of County Commissioners grant
18 months to two years. to clean up the property. After discussion, the Board of County Commissioners
decided to grant you six months in which to get your property in compliance with the Weld County Zoning
Ordinance. In regard to validating the accessory use to the farm, the Board of County Commissioners
concurred that after the six month extension period for the noncommercial junkyard, they will address the
accessory to the farm permit. At this time, they will specifically consider the number of animal units and
agricultural uses on the property, and the need for the full-time caretaker.
The Department of Planning Services has been instructed by the Board of County Commissioners to review
the accessory to the farm permit in six months, which will be June, 1997. At this time, a staff person from the
Department of Planning Services will visit the site to determine whether or not the property has met
compliance with the Weld County Zoning Ordinance, especially regarding compliance with the accessory to
the farm use and present this information to the Board of County Commissioners.

Department of Planning Services staff prior to installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have six months
from January 27, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

46.23 Accessory Farm Use
46.2.3.1 One MANUFACTURED HOME in the A District as an ACCESSORY FARM
USE may be permitted upon a determination by the Department of Planning
Services that:
46.2.3.1.1
• 46.2.3.1.2
The MANUFACTURED HOME will be occupied by persons customarily
employed at or engaged in the operation of the USE where the
MANUFACTURED HOME is located.
The MANUFACTURED HOME is necessary for the effective and economic
operation of the USE and/or protection of the agricultural USE.
46.2.3.1.3 The MANUFACTURED HOME will not be used as an income source by the
applicant for rental to persons not principally employed upon the LOT.
46.2.3.1.4 Adequate water and sewage disposal facilities are available to the
MANUFACTURED HOME.
46.2.3.1.5 The MANUFACTURED HOME is not the first DWELLING UNIT on a parcel
of land. Where the MANUFACTURED HOME will be the first DWELLING
UNIT on a parcel of land, the MANUFACTURED HOME request shall follow
the application procedures under the provisions of Section 46.2.6 of this
Zoning Ordinance.
46.2.3.1.6 The applicant must obtain a BUILDING permit for the MANUFACTURED
HOME and comply with the installation standards of the Weld County
Building Code Ordinance.
46.2.3.2 The Department of Planning Services shall make its determination on the
basis of a signed statement by the applicant that the conditions of Sections
462.3.1.1 through 46.2.3.1.6 are met, upon information contained in the permit
application, and upon independent evidence as may be available or which
the staff may reasonably require.
46.2.3.3 A zoning pemrtfor more than one MANUFACTURED HOME in the A District
as an ACCESSORY USE may be issued only upon approval by the Board
of County Commissioners. The Board of County Commissioners shall
review the application for compliance with the criteria set out in Section
462.3.1 at a regularly scheduled meeting of the Board. The Board of County
Commissioners shall give notice of the application for a zoning permit and
the meeting date to those persons listed in the application as owners of
property located within five hundred (500) feet of the parcel under
consideration. Such notification shall be mailed, first class, not less than ten
(10) days before the scheduled meeting. Such notice is not required by
Colorado State Statute and is provided as a courtesy to surrounding property
owners (the surface estate). Inadvertent errors by the applicant in supplying
such fist or the Department of Planning Services in sending such notice shall
not create a jurisdictional defect in the permit process even if such error
results in the failure of a surrounding property owner to receive such
notification. The Department of Planning Services shall post a sign for the
applicant on the property in question indicating that a MANUFACTURED

HOME has been requested for the property, the meeting date and telephone
number where further information may be obtained. The sign shall be posted
at least' ten (10) days prior to the meeting date. The Board of County
Commissioners shall consider any testimony of surrounding property owners
concerning the effects of the MANUFACTURED HOME on the surrounding
properties. In addition, the Board shall consider compatibility of the
MANUFACTURED HOME with the surrounding area, harmony with the
character of the NEIGHBORHOOD, its effects upon the immediate area, and
the general health, safety and welfare of the inhabitants of the area and the
COUNTY.
46.2.3.4
46.2.4 Temporary Accessory Use During a Medical Hardship
46.2.4.1 MANUFACTURED HOMES may be allowed in the A District as a temporary
DWELLING UNIT in addition to the principal DWELLING UNIT upon the
issuance of a zoning permit by the Board of County Commissioners upon the
Board's determination that:
46.2.4.1.1 A medical hardship exists in which the person to be living in the
MANUFACTURED HOME requires the supervision and care of those
persons residing in the principal DWELLING UNIT on the property (or the
reverse).
46.2.4.1.2 That there is no reasonable alternative available to the applicant for the care
of a person who needs medical supervision, and
46.2.4.1.3 Adequate water and sewage disposal facilities are available to the
MANUFACTURED HOME.
46.2.4.2 The Board of County Commissioners shall review the application for
compliance with the criteria set out in Section 46.2.4.1 at a regularly
scheduled meeting of the Board. The Board of County Commissioners shall
give notice of the application for a zoning permit and the meeting date to
those persons listed in the application as owners of property located within

I received a call from Mr. Duffy Johnson and he had some questions regarding the fact that we did
not send an inspector out to look at his site. I spoke with Mr. Johnson and told him that we had
recently received some complaints about his property concerning the noncommercial junkyard, as
well as our department needing some further follow up information concerning the accessory to the
farm located on his property. Mr. Johnson was pretty combative, felt like no one in the department
had told him what his responsibilities are in relationship to the accessory to the farm permit. I
reminded Mr. Johnson that he did, in fact, sign the accessory to the farm permit. Standard Number
8 states "manufactured, mobile homes or accessory dwelling units as accessory farm uses are
temporary. The manufactured, mobile or accessory dwelling unit shall be removed upon the
cessation of the use of the manufactured, mobile or accessory dwelling unit as an accessory to the
farm use."
I told Mr. Johnson that he would need to provide us with information specifically delineating the
need to have the mobile home on site. Information that is necessary for us to make a
determination of use would need to include the number of employees (in this case one), the hours
of operation, the activities the person was proposed to be involved with, as well as a statement
indicating that the person does not have another job and is, in fact, principally employed. Mr.
Johnson was very upset at this point. He said he had been told that the permit was a "go" no
matter what. I have some concerns about somebody actually telling him that. He was also very
upset with the Health Department and the fact that "they charged money and all they did was walk
on his property". I told Mr. Johnson that I would be more than happy to continue to release permits
on his case should he wish to go ahead and proceed at his own risk. I did tell him should he not
be able to justify the use, the mobile home would have to be removed. At this point, Mr. Johnson
has advised me that he has chosen not to proceed with any more building inspections on the site
and would forward the appropriate documentation to me.

On December 31, 1996, I conducted a field check on a property described as 15065 Weld County
Road 90,as a follow up to a complaint. At this time,l found the site to be in violation of the Weld
County Zoning Ordinance in regard to the placement of a noncommercial junkyard. More
specifically, the site was full of building materials, yard debris, old machine parts, a dilapidated
vehicle and more.
This case will be turned over to Julie Chester for further action. In addition, the complaint I
received concerned the use of the blue, secondary mobile home on site as an accessory to the
farm operation. Further action needs to be given in regard to substantiating the use on the site.
I will send a letter to the property owner requesting further justification for the accessory to the
farm.

which this permit is granted. The Building Official or her/his agents are authorized to order the immediate cessation at any time a
violation or the adopted codes or regulations appears to have occurred. Violation of any of the codes or regulations may result in
the revocation of this permit.
Buildings must conform with the plans as submitted to the Department of Building Inspection. Any changes of the plans or lay out
must be approved prior to construction. Any changes in the use or occupancy of the building must be approved.
When the mobile home complies with the provisions of the Weld County Building Code Ordinance, the Building Official shall'issue a
Certificate of Final Inspection. The Certificate of Final Inspection shall be obtained no later than 180 days after the mobile home
is issued. Failure to obtain the Certificate of Final Inspection within the stated 180 day period will be sufficient reason to
consider the mobile home in violation of the Weld County Building Code Ordinance.
