Subject: Resubdivision 407(redesign of lots 1-8 of Lupton Meadows Subdivision)
Dear Commissioners:
The attached application and submitted materials are concerning a request made by the property owners of
lots 1-8 of the Lupton Meadows Subdivision in care of Darrell Bearson. The request is to redesign lots 1-8
to correct an illegal land split that occurred when portions of lots 1-8 were conveyed differently from the
original plat and to vacate the portions of lots east of the river. The property is located north and adjacent
to Weld County Road 18 and east and adjacent to Weld County Road 25.
Based upon the submitted application materials and other relevant information regarding this request,the
Department of Planning Service's staff recommends conditional approval of this request.
This proposal is in compliance with Sections 7.3.6.1 through 7.3.6.12 as follows:
Section 7.3.6.1 That the proposed subdivision is located within an Urban Growth Boundary area as defined
and adopted in any approved intergovernmental agreement(s), or as defined in the Weld County
Comprehensive Plan.
This proposal is in the Urban Growth Boundary area of Fort Lupton. Fort Lupton reviewed this proposal
and indicated no conflicts.
Section 7.3.6.2 Compliance with the Weld County Comprehensive Plan and the zone district in which the
proposed subdivision is located.
The proposed redesign of lots 1-8 of Lupton Meadows subdivision is in compliance with the Weld County
Comprehensive Plan and the Agricultural zone district in which it is located. The proposal will correct an
illegal land split which occurred when portions of lots 1-8 were conveyed differently than the recorded plat.

Section 7.3.6.3 That comments received from referral agencies have been addressed, if applicable.
The concerns or comments of the referral agencies have been included within the conditions of approval.
Section 7.3.6.4 That definite provision has been made for water supply that is sufficient in terms of quantity,
dependability, and quality to provide water for the subdivision including fire protection.
No additional water is required with this proposal. The lots are existing and only the property lines are being
adjusted. The Fort Lupton Fire Protection District reviewed this proposal and indicated no conflict.
Section 7.3.6.5 That, if a public sewage disposal system is proposed,provision has been made for the system
and, if other methods of sewage disposal are proposed, evidence that such systems will comply with state
and local laws and regulations which are in effect at the time of submission of the subdivision.
The lots will be provided sewage disposal by individual septic systems. The Weld County Health
Department has reviewed this proposal and their comments are addressed in the conditions of approval.
Section 7.3.6.6 That streets within the subdivision are adequate in functional classification, width, and
structural capacity to meet the traffic requirements of the subdivision.
The lots are accessed from Weld County Roads 18 and 25. The Weld County Public Works Department has
reviewed this proposal and indicates no conflict.
Section 7.3.6.7 That off-site street or highway facilities providing access to the subdivision are adequate
in functional classification, width, and structural capacity to meet the traffic requirements of the subdivision
in accordance with the requirements set forth in Section 10 of this Ordinance.
The County roads providing access are county maintained.
Section 7.3.6.8 That facilities providing drainage and stormwater management are adequate.
Weld County Public Works Department reviewed this proposal and indicates no conflict.
Section 7.3.6.9 The subdivision will not cause an unreasonable burden on the ability of local governments
or districts to provide fire and police protection, hospital, solid waste disposal, and other services.
The lots are existing and are only being redesigned. The proposed redesign will not cause an unreasonable
burden on the ability of being served.
Section 7.3.6.10 The subdivision will not cause air pollution violations based on Colorado Department of
Public Health and Environment standards.
The Weld County Health Department reviewed this proposal and did not indicate a need to address air
pollution. The lots will not be exempt from the Colorado Department of Public Health and Environmental
Standards.

Section 7.3.6.11 The subdivision conforms to the subdivision design standards of Section 10 of this
Ordinance.
The Lupton Meadows Subdivision is a non-conforming subdivision that was recorded prior to the
implementation of the subdivision design standards of Section 10 in the Weld County Subdivision
Ordinance.
Section 7.3.6.12 The subdivision will not have an undue adverse effect on wildlife, its habitat, the
preservation of prime agricultural land, and historical sites.
The Colorado Division of Wildlife reviewed this proposal and through a phone conversation indicated no
conflicts. There are no known historical sites associated with this request.
Conditions of Approval
1. Prior to recording the plat:
A. The plat shall be amended to include the items required by the Utility Board, as follows:
(1) A fifteen(15)foot front utility easement shall be required on the north, south, and west lines of
this development(lots 1-8);
(2) The interior lot lines shall have the standard twenty (20) foot utility/drainage easement
apportioned equally on abutting properties.
B. The applicant shall submit evidence to the Department of Planning Services that any existing septic
system(s)which is not currently permitted through the Weld County Health Department has had an
I.S.D.S. Evaluation performed. In the event the system(s) is found to be inadequate,the system(s)
must be brought into compliance with current I.S.D.S. regulations.
C. The following note shall be placed on the plat:
Lots 1-8 shall maintain compliance with the Flood Hazard Overlay District at all times.
2. A plat shall be submitted to the Department of Planning Services for review and approval in compliance
with Section 7.2.6 of the Weld County Subdivision Ordinance. The applicant will be responsible for
paying any required recording fees associated with the plat.

A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on October 24,
1996, at 10:00 a.m. in the Conference Room of the Weld County Administrative Offices, 1400 N. 17th Avenue,
Greeley, Colorado.

LEGAL DESCRIPTION: Lots 1-8 of Lupton Meadows Subdivision
LOCATION: North and adjacent to Weld County Road 18; east and adjacent to Weld County Road 25.
Todd A. Hodges explained that this application is for a resubdivision in the Lupton Meadows subdivision. This
proposal is for the re-adjustment of the lot lines. This property was purchased and sold in a different
delineation than what the lots were actually platted as. Mr. Hodges explained that to bring these properties
into compliance the applicant had to apply for a resubdivision under the redesign section. The Department
of Planning Services' staff has no conflicts with this application.
Mr. Hodges explained that attached with this application was an amended recorded exemption and gave an
overview to the Advisory Board on how the applicant would be allowed this amended exemption if this
resubdivision was approved.
Sue Skaley asked if all the utilities were on this site. Mr. Hodges explained that he had spoke with the
property owner and that all the utilities should be existing and that they did not feel there would be a need for
anymore utilities.
Cody Woolridge asked if they would need to bring this application up to todays standards. Mr. Hodges
explained that this would be to the Advisory Board's discretion for this resubdivision. Mr. Hodges stated that
some of these lots have the same property owners and could have a residence placed on these lots. Mr.
Hodges explained that these lots are approximately forty acres in size.
Mr. Woolridge had concerns on lots three and four if they were subdivided. Mr. Hodges explained that the
property owners would need to go through the same process to subdivide. Access and utilities would be
reviewed at that time, or that it would be the Utility Board discretion to address all easements at this time. Mr.
Hodges felt that subdividing these lots would not be supported in the zoning standards due to the acreage
basis of these lots. The property owners would have to acquire municipal water through a water district, but
would still be allowed to put in a septic system.
The Utility Advisory Board agreed that they would be acceptable with the following Conditions of Approval:
I. A fifteen (15) foot front easement shall be required on the on the north, south and west lot lines of
this development.
2. The interior lot lines shall require the standard twenty (20) foot easement apportioned equally on
abutting properties.
Cody Woolridge moved to approve the utility easements with the Conditions of Approval to the Board of
County Commissioners. Sue Skaley seconded the motion. Motion carried unanimously.

The project has been reviewed in accordance with Section 404 of the Clean Water
Act under which the U.S. Army Corps of Engineers regulates the excavation and
discharge of dredged and fill material into waters of the United States including wetlands.
This letter is to inform you that the proposed activity, assigned number
199680968, will not require a Department of the Army (DA) Permit.
Although a DA Permit will not be required for the project, this does not eliminate
the requirement that other applicable federal, state, tribal, and local permits be obtained
as required.

redesign) on a parcel of land described as Lots 1-8 of Lupton Meadows Subdivision, Weld
County, Colorado
Dear Applicant:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Board of Commissioners for Wednesday,
October 30, 1996. This meeting will take place in the Weld County Centennial Center, 915 Tenth Street,
Greeley, Colorado. In addition, I have scheduled a meeting with the Weld County Utilities Advisory
Committee for Thursday, October 24, 1996, at 10:00 a.m. This meeting will take place in the Weld County
Administrative Offices, 1400 N. 17th Avenue, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the City of Fort Lupton Planning Commission for its review and comments. Please

the review process.
It is recommended that you and/or a representative be in attendance at each of the meetings described

Sometime on or prior to October 20, 1996, a representative from the Department of Planning Services will
be out to the property to post a sign adjacent to and visible from a publicly maintained road right-of-way
which identifies the hearing time, date, and location. In the event the property under consideration is not
adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on
the property_and post a second sign at the point at which the driveway (access drive) intersects a publicly
maintained road right-of-way.

The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. It is the responsibility of the applicant to contact the Department of
Planning Services office a few days before the date of the hearing to obtain that recommendation.
