APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards of Sections 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the
Weld County Individual Sewage Disposal System (ISDS) regulations.
Prior to recording the plat:
1) any existing septic system which is not currently permitted through the Weld County Health Department
will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the
system is found to be inadequate, the system must be brought into compliance with current I.S.D.S.
regulations.
2) all existing accesses to Lot A and Lot B shall be delineated on the plat.
3) the following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is located.
No additional accesses to Lot A or Lot B shall be allowed.
Prior to the issuance of building permits on Lot B, the applicant shall provide evidence of an adequate domestic water
supply for Lot B to the Department of Planning Services.
The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld

AMENDED RECORDED EXEMPTION NARRATIVE
This Amended Recorded Exemption is submitted concurrent with an application for
Subdivision Exemption. The purpose of the Amended Recorded Exemption and the
Subdivision Exemption is to change the boundaries of 2 existing rural residential
parcels that were originally created from the larger farm parcel in order to slightly
enlarge each residential parcel and align boundaries for a more uniform, usable
configuration. The end result will be a farm parcel with a cluster of residences in one
corner that have a clean, rectangular configuration, which are adjacent and contiguous,
and which will be a more manageable site for both farming and for rural residential use.
The applicants are Gary and Eileen Hladky and Mike and Theresa Ornelas, the
Hladky's daughter and son-in-law. The Hladkys have owned the property since 1971
when they purchased the original 80 +1- acres. Also in 1971, 2 parcels of one acre
each were created to provide separate sites for dwellings for family members,
specifically: the Hladky's and Mary Jane O'Gorman (Mrs. Hladky's sister) who was a
part owner at that time. Copies of surveys dated August 7, 1971 are attached to this
application to confirm creation of the parcels prior to 1972.Subsequently, the one acre
parcel originally owned by Mary Jane O'Gorman was sold and is now under separate
ownership. In 1992, a Recorded Exemption (RE-1386) was approved creating an
additional parcel of 1.263 acres for a homesite for the Ornelas'. All parcels are close to
one another, but have somewhat different boundary configurations and do not neatly
adjoin. At this time, the Hladkys and Ornelas' intend to align boundaries and create
consistency with the adjoining parcels. Mr. & Mrs. Hladky have placed their residence
on the market for sale and intend to build a new home on the larger parcel of land (now
Lot "B" of RE-1386).
This property line adjustment proposal via the Subdivision Exemption process and the
Amendment of the Recorded Exemption is allowed by the Weld County Comprehensive
Plan. This adjustment will change the configuration of the smaller lots from small sites
separated from one another and with odd boundaries to a configuration which aligns
the boundaries of all 3 parcels and makes them immediately adjacent to one another.
The parcels appear to be located within the 3 mile referral boundary of the City of Fort
Lupton, although not within the urban growth boundaries currently being considered by
Fort Lupton. The zoning of all parcels is "A" Agricultural and will remain so after the
proposed division. The proposed uses of rural homesite and associated farmland are
allowed under the provisions of this zoning classification.
The uses of the nearby and surrounding properties include a mix of municipal
development, farms, pastureland, and individual rural homesites. This adjustment will
be compatible with the existing uses and should pose no discernible effect on the
surrounding properties. No prime agricultural lands are being impacted by this
adjustment and none are being removed from agricultural production. To our
knowledge, the property is not located in a flood plain, geologic hazard area, or overlay
district. The larger parcel (Lot "B" of RE-1386) is irrigated with waters derived from the
w •
Fulton Irrigating Company which provides irrigation water for maintenance of surface
cover, alfalfa, other crops, and pasture.
The smaller parcel contains the Onrelas' existing residence. The larger parcel is used
as farmland and pasture. Access to all parcels is via existing accesses from Weld
County Road 18 1/2. No new accesses will be created. The lot line adjustments
proposed do not create any additional buildable lots.
The smaller parcel has an existing dwelling and is served by an existing domestic well
and a county approved septic system. Each of the other adjacent small parcels also
has its own well and a county approved septic system. The remaining larger parcel
(Lot "B") is large enough to accommodate a septic system and a permit will be obtained
for construction of same. The Hladky's have submitted an application for a well permit
on the larger parcel to the Division of Water Resources, a copy of which is provided
with this application. The Hladky residence parcel is served by a domestic well
permitted as #46169, the middle "exception" parcel is served by a domestic well
permitted as #144379, and the Ornelas parcel (Lot "A" of RE-1386) is served by a
domestic well permitted as #167252, copies of which are provided with this application.
Considering the location and existing uses, there should be minimal to no effect with
regard to sheriff and/or police protection, fire protection, road maintenance, or
increased traffic. The parcels are located within the Fort Lupton Fire Protection
District.
Preliminary lot plans are submitted with this application to delineate the proposed
changes. An engineering firm has been contacted to complete a survey of the
boundary changes and mylar plats which meet Weld County standards and
requirements which will be submitted for review and recording after this proposal is
approved.
We believe all issues have been adequately addressed for the confirmation of this
Amended Recorded Exemption. We thank you for your consideration of this matter and

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. The Environmental Protection Services Division of the Weld County Health
Department was unable to locate a septic permit for the septic system
located on the smaller parcel of this application. Any existing septic
system(s) which is not currently permitted through the Weld County Health
Department will require an I.S.D.S. Evaluation prior to the issuance of
the required septic permit(s) . In the event the system(s) is found to be
inadequate, the system(s) must be brought into compliance with current
I.S.D.S. regulations.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a residential site of 1.263 acres described as
lot 'A' of the recorded exemption no. 1309-21-3-RE1386, Weld County, being more particularly described on the
attached exhibit A.
4) The use of ground water from this well is limited to ordinary household purposes inside a single family dwelling
and the watering of the users noncommercial domestic animals. The ground water shall not be used for irrigation
or other purposes.
5) Production from this well is restricted to the Laramie Formation which corresponds to the interval between 70 feet
and 450 feet below ground surface. Plain casing shall be installed and sealed to prevent production from other
zones.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.
