Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: .. Due to the prime agricultural soils on Lot B, the applicant shall delineated the proposed building envelope on the plat. B. In accordance with Weld County Public Works Ordinance #180, Lot A shall utilize one of the existing residential /agricultural access points. Whenever multiple accesses to a single level parcel exist and additional accesses are requested, one or more existing accesses shall be removed, minimizing new accesses and utilizing the existing access. No circle drives or additional accesses shall be granted. Lot qq -310� B shall utilize the existing residential/agricultural access. The access will be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. These roads will be graded and drained to provide all weather access. -C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. D. WCR 86 is designated on the Transportation Plan Map as a collector road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. /The plat shall be delineated to show 40 feet right-of-way from center line. E. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance(Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the issuance of a building permit on Lot B of the recorded exemption, the applicant for the building permit shall be required to submit to the Department of Planning Services, evidence that the lots has an adequate water supply of sufficient quality, quantity and dependability. 4) Prior to the release of building permits on Lots A or B, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and recorded exemption number. 5) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 6) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should the applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, this case will be forwarded to the Board of County Commissioners with a recommendations for denial. Water supply statements addressing the following: a. Domestic Use; Domestic water from North Weld Water District is currently being utilized for Lots A and B. b. The property is currently supporting approximately 32 acres of alfalfa hay. There are 3 steers, 1 dairy cow, and 6 dairy heifers on the property at this time. There is a residence located on Lot A with existing road access from WCR 86. The Collins Lateral Ditch runs along the north side of the property. 4. The reason for the proposed amended recorded exemption with an explanation how each lot will be used. The purpose is to move the east boundary of lot A, 117 ft to the east. This will allow lot A to utilize the outbuilding improvements which are • better suited to be used by the house on lot A without taking productive • • farmland away from lot B. One of the main reasons lot A would benefit • from the inclusion of the outbuildings is its position in respect to the other house on lot B. Lot A is closer in proximity to the barn and corals, also the west side of the main barn has a three car garage which faces the house on lot A. 5. A description of the location, sizes, and present use of the area where the proposed new lot(s) will be created. Lot A is approximately 2.5 acres in size and is located at present Recorded Exemption 0551-31-3-RE 1219 on WCR 86 which is a paved road. Lot B is approximately 38.9 acres. 6. A statement describing any unique physical characteristics on the site, if applicable. There are no unique on site physical characteristics to either Lot A or B. 7. A statement indicating that all proposed or existing structures will or • do meet minimum setback and offset requirements for the zone district in which the property is located. All structures meet the minimum setback and offset requirements for the zone district. 8. A statement indicating whether the applicant is willing to place a conservation easement on the property to maintain farm production or open space. A conservation easement is not applicable to this proposal. 9. A statement indicating whether a building envelope will be designated on any of the lots. A building envelope is not applicable as buildings currently exist on both Lots A and B. S 10. A statement explaining how the proposal is consistent with the Weld • County Comprehensive Plan and any adopted municipal plan, and any approved intergovernmental agreement(s), if applicable. This proposal, pending approval, takes no "prime" agricultural land out of production. The proposal adjusts the boundaries of Lot A to better utilize present outbuildings. The larger parcel, Lot B, is being left in agricultural production, therefore this proposal is consistent with the Weld County Comprehensive plan. The site is not located within any adopted municipal plan or intergovernmental agreements; however, it is located within the referral boundaries of the Town of Pierce and the Town of Ault. 11. A statement explaining how the proposed uses will be compatible with existing surrounding land uses. The current surrounding land uses comprise of residential/agricultural lots to the north, south, east, and west. The town of Pierce lies approximately two miles to the northwest and the Town of Ault lies • approximately two miles to the southwest. The existing and proposed uses of the property will be identical to the existing uses of the surrounding properties, which include limited livestock production, cropland, pasture, and gardening. 12. A statement explaining how the proposal is consistent with the intent of the district it is located within as expressed in the Weld County Ordinance, as amended, and the Weld County Comprehensive Plan. This proposal is consistent with the intent of the agriculture zone district in the fact that the purposed amendment will combine the associated with lot A. The recorded exemption is a tool that was created to split off existing improvements or non-productive portions of a property and maintain the Agriculture zoning. 13. A statement explaining how the proposal is consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance, Section 1.3. This proposal is consistent with efficient and orderly development by • allowing more efficient use of the property. This proposal is not located • within wooded terrain or within any of the overlay districts, as delineated • on the maps adopted by Weld County. This proposal preserves the existing agricultural uses and promotes the most productive agrarian use of the property while safeguarding the interests of the public and the property owner.
