We are absolutely against the expansion of the existing Hirsch Dairy and the continuance of his expansion proposal hearing. There are already numerous problems with the existing dairy that Mr. Hirsch cannot or will not fix. We feel that since Mr. Hirsch is not following his original plan he cannot be trusted to follow a new plan with even more cattle to manage. Mr. Hirsch and his attorney are asking for a continuance because they were unaware of the major health and safety issues involved, but these issues have been in question since Mr. Hirsch's first application. Mr. Hirsch has continued to flagrantly violate the law by pumping manure and waste water. According to his original plan, Mr. Hirsch is supposed to dispose of all manure and waste water on his property. However, the Hirsch Dairy continues to truck manure off his property. The amount of trucks on county road 78 has caused horrible road conditions. A gravel road can simply not handle Or the amount of traffic caused by the dairy now. The trucks also drive so fast that they endanger the lives of our children and animals and especially anyone driving over the narrow hill near the dairy. Had Mr. Hirsch followed his original plan this would not have been a problem for two reasons, the manure would stay on his property, and the access road to the dairy would be on county road 23, not county road 78. Mr. Chilson in his letter to you asks for basic fairness to Mr. Hirsch because he was not notified of the hearing date and was not aware of the health implications. He also had a prior long standing commitment of such magnitude that he simply could not be present for the August 20th hearing. We are available for this meeting because we arranged in advance by taking off time from work due to the gravity of this problem. We are well aware of the health concerns and we have presented the commissioners with pictures showing blowing dirt, flies, and the pumping of his manure pit onto county roads 23 and 78. Mr. Hirsch, Mr. Chilson and the Commissioners should be well aware of these health violations. Mr. Hirsch, his attorney, and his financial backers, continue to play the system. This expansion was the next step after their original Dairy was accepted. Mr. Hirsch has not done anything to correct his existing violations; how can you begin to believe that he will correct his future violations, which will be more frequent and of greater magnitude because of intended expansion. Mr. Hirsch, told my neighbor, that he would make life so miserable for my family, that T would give him my property. Mr. Hirsch's hired hand told another neighbor "I am pumping the pit tonight, so go call the health department you son-of-a-bitch." Their total disregard for the law dishonors the legal system and the Weld County Commissioners. Hodges Dear Mr. Hodges: This letter is regarding expansion of the Hirsch Dairy. We feel that this permit should not be granted due to the following problems. There is already a problem with disposal of waste which has been being pumped off of the dairy itself and onto other properties. The smell, flies and dust make it very unpleasant to live here at times and are a major health concern. The road conditions due to dairy traffic are very poor and the speed of manure trucks are a danger to everyone. According to the letter that you have forwarded to us from the health department, the waste will be disposed of on sight. There are several incidents that have been witnessed of the waste from the pond being pumped across the road and onto other properties. The manure has been trucked off of the property to other locations. This shows us that Mr. Hirsch is unable to follow his own plan for dealing with the waste. The extra traffic from the dairy has created poor road conditions on 78 and the truck traffic is a problem due to the speed at which they travel (mainly manure hauling trucks). We have asked that they slow down but have received no consideration. We signed a petition to allow three mobile homes at the dairy (there are four) and were told by Hirsch at that time that the main entrance would be off of Rd. 23 which it is not. We were also shown plans in which the pond was to be located further north but it was placed right across the road to the east of a residence. If it was not economically feasible for this dairy to operate with the maximum allowed animal units per acre then why was it built in an area that already has two dairies, two cattle lots and a large sheep lot within a one mile radius of where the Hirsch dairy was built. There is also a large concentration of farm and private homes in this area. It would have been better placed further north or east where land is not at such a premium but city water is still available. 962i 8 EXHIBIT In the first two years of operation the health and safety of surrounding property owners is at risk. We believe that as tax paying citizens in Weld County we should receive help from the County, not more meetings. Mr. Hirsch has demonstrated his contempt for our health and safety. In two years he could not follow his own plan for 850 head. 2000 head will be too large of a risk for our family and neighbors. We see this as very poor planning on the part of Mr. Hirsch, his financiers and the county to allow this to happen and certainly do not want it compounded by increasing the animal units allowed. We were not allowed a voice when this dairy was allowed to be placed here but we thank you for allowing us to be heard now. The stench does not allow us to open our windows on most days .The lights force us to keep our curtains down at night in order for us to sleep. The Weld County Commissioners have allowed our property value to dramatically decrease and the quality of our life style to diminish. Lastly, The odor and dust of the dairy is permeating our clothes, cars, and home. Increasing the size of the dairy will only magnify all of these problems. Living in a rural area does not mean we must give up our right to a clean healthy environment that we have enjoyed for twenty years, yet an expansion would exacerbate the present problem. Must Weld county continue to be the agricultural dumping ground of the United States? If so, why must this dumping take place next to existing homes? We own the 80 acres and home directly east and contiguous to Mr. Hirsch's dairy operation and oppose his request for the following reasons: 1 . Mr. Hirsch has already demonstrated total disregard for his adjacent property owners by misleading us from the onset . We were deceived about the exact location of the dairy operation and livestock placement, as well as ingress and egress to the facility. Mr Hirsch indicated that the cattle and three trailer homes would be located further to the north and west of our home, reducing any nuisance they might cause. We were told the entrance would be on County Rd. 23, an oil road, rather than on County Road 78, a gravel. road . There has been a tremendous increase in the amount of traffic thereby adding to the increased dust we already have from his existing feedlots, not to mention an increased safety hazard from speeding traffic and road damage from large trucks. 962U.'3. town " "This thing takes a lot of cash flow." We believe the facts are that he put in a small dairy employing "use by right" with a facility capable of handling a large dairy herd which would , according to Mr. Hirsch, "cash flow" (See exhibit D) or be readily saleable to an outside investor. The irony of all this is that Mr. Hirsch moved from Fort Collins, was granted the right to put in a dairy, and was given the opportunity to turn the country into an experience compared to living in the city with filth, noise, lights and traffic. What was once our hard earned dream has become our worst nightmare. Please take into consideration the information we have provided before ruling on Mr. Hirsch`s request. The Smith Lateral is located (among other places) in the West Half of said Section 24, runs in a general North to South direction, and runs through the Hirsch Dairy. Specifically, the dairy does have various structures, pens and manure detention and waste water structures which are located both on the East side and West side of the Smith Lateral. The waters in the Smith Lateral are delivered to said lateral for the benefit of the shareholders of the Water Supply and Storage Company. The waters enter the Smith Lateral from the Collins Lateral which is located North of the Hirsch Dairy property. The Hirsch Dairy was constructed during 1994 and 1995 . The Smith Lateral provides irrigation waters generally commencing during March of each year and ends by the middle of September during each year. During both 1995 and 1996 the Hirsch Dairy has discharged manure and manure runoff water into the Smith Lateral at more than one location. Manure and manure water have entered the Smith Lateral immediately West of the Hirsch dry manure stockpile, and manure waters have also entered the. Smith Lateral from a hay field located immediately East of the dairy barn and mobile homes. Depending on rainfall and snowfall, the runoff has been considerable in some cases and minor in other cases . However, during the Spring of 1996 the President of the Smith Lateral estimated that approximately five tons of manure and straw were removed from the Smith Lateral immediately adjacent and South of the Hirsch Dairy facilities. The source of the straw and manure in the Smith Lateral is the Hirsch Dairy operation. October 3, 1996 Page 2 Additionally, the Hirsch Dairy has been responsible for at least three other off-site discharges. In August of 1995 the Weld County Department of Health did observe process waste water discharging off the property, into the barrow ditch and eventually reaching the Larimer and Weld Irrigation Canal. In July and August of 1996 photographs were taken of process waste water discharging off of the property into the barrow ditch and entering property and waters immediately West of the Hirsch Dairy in section 23 . Obviously, this facility is not operating as a non-discharge facility in light of process waste water discharges as well as runoff directly into the Smith Lateral from those facilities and structures located East of the Smith Lateral. The Confined Animal Feeding Operation Regulations as amended in July of 1992 at Section 4 .8 . 2 (4) provide a definition of a concentrated animal feeding operation. In this definitional section a concentrated animal feeding operation is defined if one or more criteria are met. In this case the Hirsch Dairy operation meets the criteria of both (b) (i) and (b) (ii) . The (i) definition is met due to the fact that the process waste water flows into a manmade lagoon, waters are then pumped out of the lagoon and on at least three occasions waters have been discharged into waters of the State and onto surrounding properties. The (ii) definition is met due to the fact that the Smith Lateral runs waters of the State which originate North of the facility, and the Smith Lateral runs right through the Hirsch Dairy facility. Due to the past two years experience of the Smith Lateral Company, it is necessary that the Hirsch Diary facility be determined to be a concentrated animal feeding operation. It is absolutely necessary that this dairy operation be brought into compliance with the regulation applicable to concentrated animal feeding operations in all aspects . Allowing this facility to operate under best management practices is a violation of Colorado law and allows the dairy operation to jeopardize the health, safety and welfare of all neighbors and users of the waters from the Smith Lateral Ditch. We request immediate action to bring this facility into compliance with the Concentrated Animal Feeding Operation Regulations . Accordingly, I am enclosing herewith a copy of the letters forwarded to Mr. Hirsch, dated November 24, 1996, and December 2, 1996, from the Colorado Department of Public Health and Environment. As you will note in the December 2, 1996,letter the Department acknowledges that Mr. Hirsch has misrepresented information to the Department, and the Department has determined that Mr. Hirsch's actions constitute a "flagrant violation" of the Concentrated Animal Feeding Operations Control Regulation. You will also note that the Department has determined that the waste management plan as submitted through November 13, 1996, does not provide suitable evidence that the containment pond was built according to the regulations and is in "significant noncompliance".
