RESOLUTION
RE: APPROVE MINOR RESUBDIVISION, S #388 - BRUNO AVENUE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of
December, 1995, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of the Weld County Board of County Commissioners, do Todd Hodges, 1400 north
17th Avenue, Greeley, Colorado 80631, for a Minor Resubdivision, S #388, on the following
described real estate, to -wit:
Section 23, Township 1 North, Range 66 West of the
6th P.M., Weld County, Colorado
WHEREAS, Gloria Dunn, represented said applicant, and
WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides standards for
review of said Minor Resubdivision, S #388, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having been
fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.2.5 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 8.2 of the Weld County Subdivision Ordinance including
specifically:
a. The right-of-way has not been used for its intended purpose since the
recording of the approved plat.
b. Seventy (70) percent of the landowners adjacent to the proposed right-of-way
vacation have waived any objection to the vacation by signing a petition.
c. The vacation would be compatible with the surrounding area and uses, be
consistent with efficient and orderly development, be consistent with the
Weld County Comprehensive Plan, and would not deprive any parcel of
adequate access to a public road or street right-of-way.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of the Weld County Board of Commissioners for a Minor
Resubdivision, S #388, on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. Prior to recording the Minor Resubdivision map, any utility easement located in the
Bruno Avenue right-of-way shall be clearly delineated on the map.
2. The right-of-way shall be split in accordance with the provisions of Section 43-2-301.,
et. seq., C.R.S.
3. The Minor Resubdivision map shall be recorded in the Office of the Weld County
Clerk and Recorder. The map shall be prepared in accordance with the requirements
of Section 8.2.5.6 of the Weld County Subdivision Ordinance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 18th day of December, A.D., 1995.

Dear Commissioners:
The attached application and submitted materials are concerning a request made by the Board of
County Commissioners to staff for the vacation of Bruno Avenue right-of-way which is located
in Country Estates Subdivision. The request is to vacate the entire portion of Bruno Avenue
from the Public Service Company right-of-way on the west end to Weld County Road 35.
Based upon the submitted application materials and other relevant information regarding this
request, the Department of Planning Service's staff recommends conditional approval of this
request.
This determination was based on the following:
-The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
- The right-of-way has not been used for its intended purpose since the recording of the
approved plat.
-Seventy (70) percent of the landowners adjacent to the proposed right-of-way
vacation have waived any objection to the vacation by signing a petition.
- The vacation would be compatible with the surrounding area and uses, be consistent
with efficient and orderly development, is consistent with the Weld County
Comprehensive Plan, and would not deprive any parcel of adequate access to a public
road or street right-of-way.

Conditions of Approval:
1. Prior to recording the Minor Resubdivision map, any utility easement located in the
Bruno Avenue Right -of -Way shall be clearly delineated on the map.
2. The right-of-way shall be split down the center line and the vacated portions shall be conveyed to
the adjacent property owners.
3. The Minor Resubdivision map shall be recorded in the Office of the Weld County Clerk and
Recorder. The map shall be prepared in accordance with the requirements of Section 8.2.5.6 of
theWeld County Subdivision Ordinance.

Dear Applicant:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Board of County Commissioners for
Monday, December 18, 1995 at 9:00 a.m. This meeting will take place in the Weld County Centennial
_Center, 915 Tenth Street, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Town of Hudson Planning Commission for its review and comments. Please
call Judy Larson, at 303/536-9311 for information regarding the date, time and place of the meeting and the
review process.
It is recommended that you and/or a representative be in attendance at each of the meetings described
above in order to answer any questions that might arise with respect to your application.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Board of County Commissioners. It is the responsibility of the applicant to contact the
Department of Planning Services office a few days before the date of the hearing to obtain that
recommendation.
