HomeMy WebLinkAbout952445.tiffAR 4711 33 RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #388 - BRUNO AVENUE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of December, 1995, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of the Weld County Board of County Commissioners, do Todd Hodges, 1400 north 17th Avenue, Greeley, Colorado 80631, for a Minor Resubdivision, S #388, on the following described real estate, to -wit: Section 23, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, Gloria Dunn, represented said applicant, and WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision, S #388, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.2 of the Weld County Subdivision Ordinance including specifically: a. The right-of-way has not been used for its intended purpose since the recording of the approved plat. b. Seventy (70) percent of the landowners adjacent to the proposed right-of-way vacation have waived any objection to the vacation by signing a petition. c. Prior to recording the Minor Resubdivision map, any utility easement located in the Bruno Avenue right-of-way shall be clearly delineated on the map. 2. The right-of-way shall be split in accordance with the provisions of Section 43-2-301., et. seq., C.R.S. 3. The Minor Resubdivision map shall be recorded in the Office of the Weld County Clerk and Recorder. The map shall be prepared in accordance with the requirements of Section 8.2.5.6 of the Weld County Subdivision Ordinance. The request is to vacate the entire portion of Bruno Avenue from the Public Service Company right-of-way on the west end to Weld County Road 35. Based upon the submitted application materials and other relevant information regarding this request, the Department of Planning Service's staff recommends conditional approval of this request.
