Chair 211 7th , day of the April term A D 1909 . ow 4 Greeley , Colorado , Monday April 12th, A D 1909 , Pursuant to adjournment of the 10th, the Board of County Commissioners of Weld County , Colorado, met in regular session at the -Court House in Greeley , Colorado , on Monday the 12th day of April A D 1909, there were present : - Hon. G; ) In the matter of the petition for the formation of the GREELEY-PUODRE IRRIGATION ' DISTRICT , and the organization of said District . R W DeVinny , Chairman of the Board , stated that the meeting had been called pursuant to the statute , for the purpose of canvassing the votes cast at the election held on Saturday , April 3rd , 1909 , in the proposed THE GREELEY-PU0DRE IRRIGATION DISTRICT , and the several divisions and voting • precincts thereof , as ordered by the Board to be held , notice of which was by the Board ordered to be made , given and published in the PIERCE RECORD , a weekly newspaper printed and published in the Court of Weld , in ' the State of Colorado . WHEREUPON , it appearing to the Board, that this 12th day of April is the second Monday next succeeding the said election of April 3rd , 1909 , and the day appointed by the statute for the can- vassing of the votes cast at said election, the Board, on motion duly made , seconed and unanimously carried , proceeded to examine the Proof of publication of the notice of said election heretofore , filed with this Board , and to determine whether or not the notice of said election had been properly ent advertised, made , given and published for the time , and izv manner , required by law, and as commanded in the order of the Board calling said election. And it was then and there found by the Board that the order of the Board calling said election and notice of said election, in due and proper form, had been made , given and published fbr the time , and in manner , required by law, and in conformity with the order of the Board; and that said notice , containing skid' order , had been published in the PIERCE RECORD , a weekly newspaper printed and published, and of general circulation in the County of Weld, in the State of Colorado , for at least three weeks immediatly prior to said election, and that all matters and things requisite and necessary to be done and performed prior to the holding of said election, had been done and performed in the time and manner by law required; and that proper proof , by affidavit , of said notice of said election as aforesaid, had been filed with and is on file in the office of the Board , which proof is in all respects us required by law. WHEREUPON , on motion of E. J. Estes , duly seooned and carried, the Board then and there pro- ended to open the returns and to canvas the votes oast at the election held In the proposed THE GREELEY-POUDRE IRRIGATION DISTRICT , to determine the question of whether or not the territory embrams cad within the boundaries of said District in said nitice, and in order of the Board set forth , • J Fr 21'2 should4be organized into an Irrigation District Which should be knO*n aas THE GREELEY-POUDRE IRRIGA- TION DISTRICT , and for the election of a Board of Directors in and for the various divisions of said irrigation district , and to take evidence and consider and determine in what manner said election was held, and the number of legally qualified voters in said district . And then and there the said election returns were opened; and the votes cast at said election, so noticed and advertised as aforesaid, and' held on the 3rd day of4April , 1909 , were canvassed and counted, from which it was then and there found by the Board that the total number of votes cast in said district and in all the voting precincts thereof at said election, upon the question of the organization of said proposed district was 203 votes ; That the number of votes cast in Election Precinct No . 1 of said District , upon said question was 9S votes . That the number of votes east in Election Precinct No . 2 of said District , upon said question was 74 votes . That the number of votes cast in Election precinct No . 3 of said District , upon said question was 31 votes . And that : of .the total number of votes cast , the number of votes containing the words : "Irrigation District , YES , "was 199 The number of votes containing the words : " Irrigation District , NO " , was 4 And that the votes upon said question of the organization of said district , by precincts , U • 3 was as follows : IN PRECINCT NO . 1 . "Irrigation District , NO " 0 votes From which it appeared to the Board, and was then and there found by the Board , after taking evidence as to the number of legally qualified electors in said District , that a majority of all the legally qualified electors , as defined in the statute, of said proposed THE GREELEY—POUDRE IRRIGA- TION DISTRICT , cast ballots at said election in favor of the organization of said THE GREELEY- POUDRE IRRIGATION DISTRICT as an irrigation district , with the powers and for the purposes provided by law; and that a majority of the legally qualified electors of said. proposed THE GREELEY—POUDRE IRRIGATION DISTRICT cast ballots at said election containing the words , "Irrigation District , Yes " . - THEREUPON , the Board proceeded to canvas the votes cast in said. district for Directors of said district , and found the following results . That the following names were submitted at said election, to be 'voted for as directors of the various divisions of said irrigation district , respectively , and that said names eppeared' on the ballots of said election: For Director for Division No . 1: F. S . Lourimore 'and William Eidson. ' For Director for Division No . 2: B. A. Shafer . For Director for Division No . 3: C . E. Latham. _ That there were cast for Director in and for Division No . 1 of THE GREELEY—POUDRE IRRIGATION DISTRICT , in the entire district ,, votes as follows : - • For William Eidson 124 votes • • For F. S. Lourimore 76 voter That the ;otes for directors in and for Division No . 1 of said district , by precincts , was as follows : - In Precinct No . 1 William Eidson 49 votes . . F. S. That the votes for directors in and for Division No . 2 of said district , by precincts , was as Follows : - In Precinct No . 1 : B. A. Shafer 96 votes . In Precinct No . 2: B . A. That there were cast for director 'sin and for Division No . 3 of THE GREELEY—POUDRE IRRIGATION DISTRICT , in the entire district , votes as follows : — For C . E. Latham 192 votes . That the votes for directors in and for Division No . 3 of said district , by precincts , was as follows : — Fr 214 _ == In Precinct No . 1 : C . E. Latham 91t. votes In Precinct No . 2: C . E. Latham 67 votes . In Precinct No . 3: C . E. Latham 31 votes . WHEREUPON , it was found by the Board that William Eidson received the highest number of votes cast at said election for director in and for Division No . 1 of said irrigation district , and is duly elected director in and for Division No . 1 of said district . That B . A. Shafer received the highest number of votes cast at said election for director in and for Division No . 2 of said irrigation district , and is duly elected director in and for said Division No . 2 of said District . That C. E. Latham received the highest number of votes cast at said election for director in and for Division No . 3 of said irrigation district , and is duly elected director,: in and for d aid n . 1 Division no . 3 of said District . And the Board then and there , having considered' and canvassed the returns of said election and the notice of Raid election, and all other evidence pertinent to the matter , found and determined that said election had been,, in all respects , duly and regularly held and was , in all respects , ac- cording to law. THEREUPON , on motion of Commissioner E. J. Estes , second by Commissioner P. G. Bolander , the following resolution was unanimously adopted by aye and nay vote of the Board , to-wit : - "WHEREAS , Heretofore on the 6th day of March A.D. , 1909, at a regular meeting of the Boars of County ;Commissioners of the County of Weld , in the State' of Colorado , there was presented. by C . C. Rogers , L. T. Rice and F. S.Lourimore , a petition signed by F.M. Eastlack and others!, praying fob the establishment and formation of an irrigation district ' to' be known as THE GREELEY-POUDRE IRRIGATION DISTRICT , which said district as prayed to be established embraced lands in said County of Weld in the State of Colorado only, at which time of presentation of said ppetition due proof or proper publication of notice of presentation of said petition to said Board was duly and legally made ; and WHEREAS , the said Board did , upon said 6th day of March , A.D. 1909 , by resolution in that behalf duly fix , determine and establish the boundaries of said THE GREELEY•-POUDRE IRRIGATION DISTRICT; and said Board did at said time order an election to be held of all the qualified electors of said district as by law provided, for the purpose of voting upon and determineing whether or not the said proposed irrigation district should be organized as required by law, to be held in said district on the 3rd day of April , A.D . 1909 , after notice thereof duly given and published as required by law, for three successive weeks prior to such election; iri the Pierce Record, a weekly newspaper of general circulation, printed and published in the County of Weld in the State of Colorado ; and WHEREAS , said notice was duly and regularly given and published for the time and in the manner required by law and al]jnatters and things in' and about said election were done and performed pursuant to the orders of said Board and pursuant to and in compliance with law; and. WHEREAS , the returns of said election have been duly made and reported to this Board and the votes cast at said election have been by this Board duly counted and canvassed ; and it has been IS 215 • t determined by this Board that the said election held as aforesaid for the purpose of determining the organization of said district has been duly carried and that the majority of the legally qualified electors of said district have voted upon the question submitted to them of the organization of said irrigation district , "Irrigation District Yes" , said vote being as follows : "Irrigation District Yes ," 199 votes ; "Irrigation District No , " 4 votes ; IT IS THEREFORE ORDERED , in pursuance of law and of said prodeeedings and all the proceedings and orders of said Board , and in pursuance of the election and the votes cast aforesaid, that the following described territory in the County of Weld , in the State of Colorado , is hereby declared to be duly organized as an irrigation district under the name and style of the GREF1EY-P0UDRE IRRIGATION DISTRICT , the said terrirtory so organized into said irrigation district being entirely within the County of Weld in the State of Colorado , and lying and being within the boundaries which are hereby established, fixed and created as the boundaries of said THE GREELEY—POUDRE IRRIGATION DISTRICT , to- wit : of thQ Beginning at the point where the west or upper line of the right of way1L . Caned of THE I,ARIMIE-POUDRE RESORVOIRS AND IRRIGATION COMPANY, as Said canal is constructed and in the course of construction and as then same is shown upon the plat thereof as filed in the office of the State Hydraulic Engineer of the State of Colorado on the 8th day of January , A. thence through Sections 19, 18 , 17 , 20 , again 17 , 8 , again 17 , 16 , 9, 1-0 , 15 , 22 , 21 , again 22 , 27 andi 26 in Township 9 , North , Range 65 West , to the high water line or upper contour of the McGrew Lake Reservoir of said THE LARALIE-POUDRE RESERVOIRS AND IRRIGATz0N COMPANY; thence along said high water line of said McGrew Lake Reservoir and along the westerly side of said lake to the upper or east line of the right of way of the _outl et ditch of said McGrew Lake Reservoir as the sqme is platted and filed in the office of the State Engineer of Colorado as aforesaid; Forman, David Brinbie, J .M.Kirby, and other freeholders of the ebunty of Weld, in the state of Colorado , stating that it is the purpose of Y . 242 ____ ________ _ _ _ _ _____________ the petitioners to organize an irrigtion district in accordance with law, containing a general des" eription of the exterior boundaries of such proposed district and of the lands to be embraced within said district , and all and singular the averments by law provided and required praying that this board define and establish the boundaries of said irrigation district and describe the lands to be included in said district , which it is prayed in said petition shall be known as "THE DENVER - ST .- VRAIN MUNICIPAL IRRIGATION DISTRICT" , and submit the question of the organization of the same tothe vote of the qualified electors resident and entitled to vote thereupon within said proposed district d duly signed by the requisite number of freeholders who are owners in the aggregate of a majority of the whole number of acres beltng4ng to resident freeholders in said proposed district ; and WHEREAS the said petition has been found to be in due and regular farm; that notice of the pre- entation of the same has been regularly given and published as required by law; that the said pet- ition has been filed and that a bond has been duly filed and approved by the board providing for the payment of the expenses of the proceedings and the election in case the district shall not be established, and that the law h- s in all other respects been complied with in the filing, publishing, presentation and allowance of said petition, and that all and singular the recitals in said petition are true ; and WHEREAS certain ditches , canals , laterals , reservoirs , reservoir sites and water rights have in accordance with the prayer of said petition been excluded therefrom and exempted from the operations of said proposed district ; and 1iF,RF.AS certain lanDs included within the exterior boundaries of said district have been ex- cluded from said district as prayed for by said petitioners:. and WHEREAS it has been shown to the satisfaction of this board that all matters embraced in said petition and all objections thereto , together with all the petitions for the exclusion of land from said district or the inclusion of land within the same , and all other matters and things proper to be considered by said board pertinent to said; petition have been duly considered and determined as preliminary to the fixing and establishment of the said proposed district and the boundaries thereof and the lands to be included therein; that in the opinion of the board all lands within said boun- daries as modified herein and as defined and described to be within said irrigation district and the operations thereof are susceptible to irrigation by the irrigation works described in said petition of and sought to be used as a means of supply water for the irrigation of the said lands to be embra- ced within said district ; and that in the opinion of the board the ownership of stock of The Farmers of Reservoir and Irrigation Company will furnish a proper means of supply4water for the irrigation of said lands: IT IS THEREFORE ORDERED, That the prayer of said petitioners shall be granted, and that the boundaries of said district and of the lands to be embraced therein be fixed in accor dance with the prayer of said petition, as modified by the action of the board, as above set forth. W4 DeVINkJY, stated that the meeting had been regularly called pursuant to the requirements of the statutes for the purpose of canvassing the votes cast at the election held on Friday the 2nd day of July A. D. 1909 , in the proposed THE DENVER-ST . VRAIN MUNICIPAL IRRIGATION DISTRICT , and in the several divisions and voting precincts thereof , as ordered by notice of which was duly the Board, given and advertised in the county of Weld pursuant to said order , 88 required by law, and for the further purpose of transacting such other business . as may properly come before the board . Whereupon it was moved by Commissioner P . G. Bolander , seconed by Commissioner E . J . Estes , M and unanimously carried, that the board proceed to examine the proofs and determine whether or not the notice of said election has been properly advertised and given in the county of Weld as required by law and as commanded in the order of the board calling said election. ti Thereupon the board proceeded to examine the proof of publication of the notice of said electim and from said examination it was found and determined that the order of the board calling said eleclit tion was duly and regularly given in the county of Weld as required by law, and that all matters and things necessary to be done prior to the holding of said election had been done and performed as required by law, a copy of the notice of said election as ordered by the board and as required by law having been duly published in THE WELD COUNTY REPUBLICAN and in THE FT. Bolander, and unanimously carried, the board proceeded to open the returns and canvass the votes cast at the election held in the proposed THE DENVER-ST.VRAIN MUNICIPAL IRRIGATION DISTRICT to determine the i- - - 260 question of wheer or not 'the territory embraced within the exterior boundaries of said district and the lands included therein and comprising the said district , as in said notice and the orders of b I • the board set forth , should be organized into an irrigation district to be known as THE DENVER- - ? ST. VRAIN MUNICIPAL IRRIGATION DISTRICT , and for theAbtard of directors in and for the various divi . sions or precincts of said district . A Then and there the returns were .opened and the votes east at said election so noticed and advertised in the county aforesaid in the manner aforesaid , and held on the 2nd day of July A. D. 1909 were canvassed and counted , from which it was found that eleven ( 11 ) votes were marlced_ with a cross opposite the words "IRRIGATION DISTRICT-YES" and none of said votes were marked with a cross- - opposite the words "IRRIGATION DISTRICT-NO" , from which it appeared to the board and was found by the said board that the majority of all the resident freeholders who are legal electors in said proposed district and have paid property taxes in the last year preceding said election have voted and did vote "IRRIGATION DISTRICT-YES" ; and thereupon the board , proceedctnto canvass the votes cast in said district for directors , found the following results : o For Director in and for Division number I , F. E. FORMAN received eleven ( 11) votes . For Director in and for Division number II , A. P. BALLINGER received eleven ( 11) votes . For Director in and for Division number III , 0 . C. BLATTER received eleven ( 11) votes . and no person other than those above named received any votes for the office of director in and for any division of said district . Commissioner P. G. Bolander thereupon presented the following resolution and order for the consideration of the board and moved its adoption by the board, to wit : "WHEREAS heretofore and on the 7th day of June A. D. 1909, at the regular meeting of the board C ' of county commissioners of Weld county , state of Colorado , there was presented by A. P. BALLINGER, F. E. FORMAN and ALEX. THOMPSON a petition signed by said persons and others , praying for the establishment , organization and creation of an irrigation district to be known as THE DENVER - ST. VRAIN MUNICIPAL IRRIGATION DISTRICT, which said proposed district as described by the said petition embraced and comprised lands in the county of Weld , said county of Weld embracing the entire acreage of said proposed district , at which time in pursuance of the petition aforesaid due proof of pub- lication in the county of Weld of the notice of presentation of said petition to said board was duly given and publication of said petition was duly had and made ; and V WHEREAS on the 7th day of June A.
