RESOLUTION
RE: APPROVE MINOR RESUBDIVISION FOR THE VACATION OF A PORTION OF
ARROWHEAD DRIVE - ARROWHEAD SUBDIVISION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the board of County Commissioners held a public hearing on the 6th day of
August, 1997, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the request of George and Hazel Stephens, 5720 Arrowhead Drive, for Minor Resubdivision
S-427, for the vacation of a portion of Arrowhead Drive in Arrowhead Subdivision on the
following described real estate, to -wit:
Lot 20, Block 1, Arrowhead Subdivision 2nd Filing,
being a portion of Section 27, Township 5 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, George and Hazel Stephens, applicants, were present, and
WHEREAS, Section 8.2 of the Weld County Subdivision Ordinance provides standards
for review of said Minor Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.2.5 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 8.2 of the Weld County Subdivision Ordinance
including specifically:
a. Section 8.2.1 -- There is right-of-way shown on an approved plat that has
not been used for its intended purpose for the last 21 years, or since the
recording of the approved plat. The paved road section that is currently
existing on Arrowhead Drive follows the proposed configuration in this
application. The "eyebrow" section of Arrowhead Drive on Lot 20,
Block 1, shown on the plat is not developed.

b. Section 8.2.2 -- Seventy (70) percent of the landowners adjacent to the proposed
right-of-way vacation have waived any objection to the vacation by signing a
petition. Property owners from Lots 21 and 19, Block 1 and Lot 11, Block 13
have signed the petition for vacation of this portion of the road.
c. Section 8.2.3 -- The vacation shall only be permitted when it is compatible with
the surrounding area and uses, is consistent with efficient and orderly
development, is consistent with the Weld County Comprehensive Plan, and does
not deprive any parcel of adequate access to a public road or street right-of-way.
The primary lot affected by this vacation is the applicant's lot, Lot 20, Block 1.
The vacation does not deprive any lot within this subdivision of access to
Arrowhead Drive.
Section 8.2.4 -- The vacation of any right-of-way may require the reservation of
an easement for public utility or drainage purposes in order to meet the
easement requirements of Section 10.6. As shown on the plat for Arrowhead
Subdivision 2nd Filing, the 20 -foot utility easement and bridle path are located in
the back of each lot. The vacation of the "eyebrow" on Arrowhead Drive will not
affect any public utilities or drainage.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of George and Hazel Stephens for Minor
Resubdivision S-427, for the vacation of a portion of Arrowhead Drive in Arrowhead Subdivision
on the hereinabove described parcel of land be, and hereby is, granted subject to the following
conditions:
1. The applicant shall submit a completed plat to the Department of Planning
Services within 30 days of approval by the Board of County Commissioners.
The plat shall be recorded in the Weld County Clerk and Recorder's Office and
the applicant shall be responsible for all recording fees.
2. All accesses and easements shall be clearly delineated on the plat.

REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section
8.2.5 of the Weld County Subdivision Ordinance, as amended.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 8.2. of the Weld County Subdivision Ordinance, as amended, as
follows:

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.

30 days of approval by the Board of County Commissioners. The plat shall be recorded in
the Weld County Clerk and Recorder's Office and the applicant shall be responsible for all

There are no apparent unsafe conditions on the site
The portion of the eyebrow in consideration is already developed and landscaped.
Arrowhead Drive (the road pavement) actually follows the proposed vacation request,
the road does not take on the appearance of an eyebrow. The only lot that is affected
by this vacation is the applicants lot, Lot 20. There does not appear to be any safety
concerns associated with this request.

Vacation of a portion of Arrowhead Drive in Arrowhead Subdivision
I have visited the site and have the following comments:
My only concern is if there is an existing utility located within the vacated area, the applicant must
provide the utility company (companies) access through the vacated area for repair of that utility.
The applicant has already landscaped and developed the proposed vacated area. The eyebrow
areas are utilized for splitting lots at cul-de-sacs. This will provide additional on -street parking for
the lot owners. In this case, Lot 20 is the only lot that would be effected by the vacation.
I recommend that the applicant contact all the utilities using the Arrowhead Drive utility corridor that
may possibly be effected by the vacation of the eyebrow. This issue could be resolved through a
meeting with the utility board.

This is a request to vacate a portion of Arrowhead Drive adjacent to Lot 20 Block 1 of
Arrowhead 2nd Filing in such a manner that the Right of Way Line of Arrowhead Drive adjacent
to Lot 20 would be a curve of 95 feet in radius instead of the "kneecap" configuration that now
exists. The paved road section that now exists is consistent with the proposed configuration.
Since the "kneecap" is not developed, is not necessary for emergency vehicle access, and the
proposed curve would be consistent with other intersections in the area, the vacation should not
impact the users of Arrowhead drive. Tthe vacation will allow the property owner to landscape
and better maintain the area along the front of Lot 20..
All lots adjacent to the proposed right-of-way vacation meet the utility easement standards of
Section 10.5 of the Weld County Subdivision Ordinance, as amended.

I want to confirm you received my message regarding vacating a portion of Arrowhead Drive.
The City of Evans water department located the water line, and verified that it is away from the
vicinity of the proposed vacation. Therefore, the city does not need to request this portion of
vacated right-of-way to be dedicated for a utility easement, and the city finds no conflicts with the
vacation.
