RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF NELSON
SUBDIVISION - CHRIS STRONG
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 13th day
of May, 1998, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Chris Strong, 4261 Piedra Place, Boulder, Colorado 80301, for a
Resubdivision (Lot Line Adjustment Only) of Nelson Subdivision on the following described real
estate, to-wit:
Lots 6 and 8, Tract 1, Nelson Subdivision,
Weld County, Colorado
WHEREAS, said applicant was not present, and
WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards
for review of said Resubdivision (Lot Line Adjustment Only), and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.3.1 of the Weld County Subdivision Ordinance.

The Weld County Building Inspection Department, Public Works
Department, and Health Department have reviewed this request and find
no conflicts.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Chris Strong for a Resubdivision (Lot Line
Adjustment Only) S #451, on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The Resubdivision plat shall be submitted to the Weld County Department of
Planning Services for recording within 30 days of approval by the Weld County
Board of County Commissioners.
2. Prior to recording the plat:
a. The Resubdivision plat shall meet all requirements of Section 4.5.21 of
the Weld County Subdivision Ordinance, as amended.
b. The following notes and information shall be delineated on the plat:
1) The lots shall maintain compliance, at all times, with the
requirements of the Weld County Building Inspection, Public
Works, and Health Departments.
2) Installation of utilities shall comply with Section 12 of the Weld
County Subdivision Ordinance, as amended.
3) A 15-foot utility easement shall be delineated on Lots 6 and 8
adjacent to Weld County Road 37 and on Lot 8 adjacent to Nelson
Street.
4) A standard utility provider sign-off list shall be delineated on the
plat and shall be signed by each utility provider for the vacation of
the existing utility easement between Lots 6 and 8, as approved
by the Weld County Utility Advisory Committee.
5) An addition 10 feet of right-of-way for Weld County Road 37 shall
be reserved on the plat.
6) The property shall be limited to one access. No circle drives shall
be allowed.

2. The request is in conformance with Section 8.3.2 of the Weld County Subdivision Ordinance,
as amended as follows:

The proposed lot line revision is consistent with the existing uses within the subdivision.
The proposed lot line adjustment combines Lots 6& 8, Tract 1 of the Nelson Subdivision into
one Lot and vacates the existing utility easement through the center of the property.
b. Section 8.3.2.3.2-- How the application complies with the adopted rules, regulations, and
ordinances currently in force and affecting the subdivision.
The conditions of approval address the issues concerning the regulations and ordinances that
affect this proposal. The proposed lot line adjustment will not create any problems with the
existing circulation on the site and the existing structures will comply with all setback and
offset requirements of the Weld County Zoning Ordinance. The Weld County Building
Inspection Department, Public Works Department and Health Department reviewed this
request and find no conflicts.
Staffs recommendation is conditional upon the following:
1. The Resubdivision plat shall be submitted to the Weld County Department of Planning Services for
recording within 30 days of approval by the Weld County Board of County Commissioners.

Subject: Narrative regarding request to remove easement
Please accept this document as explanation of my request to have one of the
easements removed from my property in the Nelson Subdivision. I own lots 6
and 8 (please see map) and would like to remove the easement that runs
between these two lots, so that I can have the flexibility to put an improvement
on the portion of the ground in question. After contacting all of the utility
companies that service the area, they have all assured me that they would never
need to use this easement, since there will remain an easement completely
surrounding the two lots in question. The only properties that abut mine
already have the utilities installed, and the Utility companies don't use the
easement in question, regardless. In as much as my property is concerned, the
utility companies ( Electric and Natural Gas ) are standing by for installation
for my property upon your approval of this petition.

Subject: 5-451 - Request for approval of a Resubdivision for a Lot Line Adjustment of Lots 6 and 8, Tract 1 of
Nelson Subdivision, on a parcel of land described as Lot 6 and 8, Nelson Subdivision, located West
and adjacent to Weld County Road 37,Weld County, Colorado.
Dear Mr. Strong:
Your application and related materials for the request described above are complete and in order at the present
time. I will be contacting you in the near future for a hearing date with the Board of County Commissioners. I
have scheduled a meeting with the Weld County Utilities Advisory Committee for Thursday, March 26, 1998, at
10:00 a.m. This meeting will take place in the Weld County Administrative Offices, 1400 N. 17th Avenue,
Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to
the Lochbuie Planning Commission for its review and comments. Please call Town of Lochbuie at 303-659-6273,
for information regarding the date, time and place of the meeting and the review process.
It is recommended that you and/or a representative be in attendance at each of the meetings described above in
order to answer any questions that might arise with respect to your application.
A representative from the Department of Planning Services will be out to the property to post a sign adjacent to
and visible from a publicly maintained road right-of-way which identifies the hearing time,date, and location. In
the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will
be posted in the most prominent place on the property and post a second sign at the point at which the driveway
(access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the Weld
County Planning Commission. It is the responsibility of the applicant to contact the Department of Planning
Services office a few days before the date of the hearing to obtain that recommendation.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
I have visited the site of the resubdividing for a lot line adjustment incorporating Lots 6 and 8, Track 1 of Nelson
Subdivision.
WCR 37 is designated on the Transportation Plan Map as a Collector Status road requiring 80 feet of right-of-way
at full build out. There is presently 60 feet.
The applicant has moved a mobile home onto this site. The main access point is from WCR 37.
REQUIREMENTS:
The applicant should reserve an additional 10 feet of right-of-way through Lots 6 and 8 to accommodate future
expansion.
Only one access will be granted with no circle drives and no additional accesses. The applicant will not be required
to place a culvert at the new access point and site distance appears to be adequate in both directions from.
The existing utility easement between Lots 6 and 8 does not appear to be a problem, there is adequate easement
access for utilities in the rear and adjacent to WCR 37. It will be determined at the utility board hearing if this
access is needed.
