NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1888 submitted by Jacob and Ellen Kerbs be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for the proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat: A. Any existing septic system which is not currently permitted through the Weld County Health Department will require an ISDS evaluation prior to the issuance of the required septic permit. The north access to Weld County Road 13 from Lot B shall be abandoned for the purpose of residential use. 4. Prior to the release of residential building permits on Lot A, the applicants/ property owner shall provide evidence to the Department of Planning Services indicating that the access road to the residence proposed for Lot A is an all- weather surface gravel road able to handle a minimum of 60,000 pounds and a height clearance of 13 feet 6 inches, in accordance with a letter dated April 17, 1996, from William N. Bailey of the Mountain View Fire Protection District. 961156 0 STAFF RECOMMENDATION RE-1888 Jacob & Ellen Kerbs It is the opinion of the Department of Planning Services' staff that this recorded exemption does not meet the intent of the Transportation goals and policies of the Weld County Comprehensive Plan, as amended; specifically: Goal 1: "Provide a unified and coordinated countywide street and highway system which moves people and goods in a safe, economical and efficient manner." Policy 1: "The County should maintain a road classification system so county roads are designed and maintained according to their planned function." Goal 3: "Maximize the compatibility of roads, streets, and highways with adjacent land uses." Policy 3: "Establish policy standards for the regulation of accesses to streets and highways from abutting land-uses and intersecting roads." Goal 4: "Provide a balanced approach to transportation system development giving due consideration to all modes of travel." Policy 4.1: "The number of access points on collector and arterial roads should be kept to a minimum in order to minimize interruptions to traffic flow and to promote safety from the traveling public." Weld County Road 13 is classified as a County Arterial, with an average daily traffic count of more than 1,000 vehicles per day. Two accesses from the property to Weld County Road 13 are existing for residential, farm, and oil and gas use; a third residential access in this half-mile stretch was allowed in the approval of Recorded Exemption 1217 in 1989. The access proposed for usage by Lot A is at the south boundary to Weld County Road 13. Although the access is existing, its present usage is considerably less than what the proposed residential use would generate. Staff does not agree with allowing an access point for additional residential traffic at this site. The recorded exemption application does not comply with Urban Growth Boundary goals and policies of the Weld County Comprehensive Plan, as amended; specifically: Policy 2: "Land use development proposals within an urban growth boundary area will be determined according to the procedure set forth in an intergovernmental agreement between the County and the municipality. In the absence of an 0r,.. 1 f- • • intergovernmental agreement, land use proposals in urban growth boundary areas shall be encouraged if they adhere to the intent of the Weld County Comprehensive Plan and the referral responses received." The Town of Mead does not support this division of land. Reasons given were too many splits using the recorded exemption process and issues such as drainage, septic, fire flow and design of roads which should be addressed in a subdivision agreement. Additionally, the recorded exemption does not comply with the Statement of Purpose contained in the Weld County Su • bdi•v•ision Ordinance, as amended; specifically: Section 1.3.1: "Assisting orderly and integrated development" Section 1.3.2: "Promoting the health, safety, and general welfare of the residents of the County" The property has been divided twice previously, utilizing the recorded exemption process. The most recent recorded exemption was approved in 1989, also requested by Jacob Kerbs. It was staff's opinion, at that time, that the division did not meet the criteria for a recorded exemption. The case was presented before the Board &approved. The original parcel of 115 acres has three residences existing, two of which are able to access Weld County Road 13. The applicant is now requesting to create another small parcel, which will also access Weld County Road 13 and generate additional traffic on this road. According to the Weld County Comprehensive Plan page 7-3, the Transportation Definitions section states that "for better movement of traffic and safety of the traveling, arterials shall have no direct accesses." I recommend that this access not be used for the residential access due to the inadequate sight distance. This portion of WCR 13 is designated as an arterial. The number of access points on an arterial road should be kept to a minimum in order to maximize traffic flow and promote safety. The applicant has not identified length and width of Lot A. The only safe access point to Lot A is at the top of the hill. This would be adding an additional access to WCR 13. I would like to see if the applicant could access Lot A from the internal road system THROUGH Lot B. This would minimize granting an additional access to this arterial portion of WCR 13. Please see attached Table 4.9.2, "Sight Distance,Posted Speed Limit vs. Sight Distance for Safely Stopping a Vehicle." Lot B The applicant failed to show on the drawing the main access from WCR 34 to the residence. This road connects with an interior road system that accesses on to WCR 13 in two locations. Permits shall not be issued that include any design element or allow any turning movements where the sight distance is not adequate to allow the safe movement of any motorist using or passing the access. 2. The following table shall be used to determine the required horizontal and vertical sight distance necessary as measured from the vehicle traveling on the highway to the access. In addition to the sight distance necessary for vehicles traveling on the highway to see vehicles or objects in the traveled way, it is also necessary to provide the entering vehicle adequate sight distance in order to enter*or cross the highway. The following table shall be used to establish the minimum sight distance necessary for the entering vehicle. If there is no median or if the median is too narrow to safely store a left turning or crossing vehicle (a 20 foot minimum for passenger cars), both directions shall be considered from the access location. 37 i TRANSPORTATION DEFINITIONS -' C ., / Arterial Roads Arterial roads provide for the corridor movement and distribution of traffic with trip lengths and travel densities for substantial statewide or countywide travel. Some arterial road characteristics are as follows: Paved arterials will normally have an ADT greater than 1000. Unpaved arterials may have an ADT of 200 or greater. Arterials will be designed for a speed of 55 MPH. WHIP For better movement of traffic and safety of the traveling.arterials shall have no direct accesses. Direct accesses will be provided only for hardship cases or for high traffic generators. - Direct accesses will usually be limited to incoming collector roads, i.e.,one cross road intersection per mile. Arterial roads provide for the corridor movement and distribution of traffic with trip lengths and travel densities for substantial statewide or county wide travel. Collector Roads Collector roads combine smaller traffic flow until they reach a volume that warrants an intersection along an arterial roadway. Collectors expedite movement of traffic in the local area. Collectors serve a dual function between mobility and land access by connecting local roads to arterials. Collector roads serve smaller communities and neighborhoods, as well as travel of primarily a countywide nature. The characteristics of a collector road are: Paved collectors will normally have and ADTa of 200 to 1000. Unpaved collectors may have an ADT of 100 or greater. Collectors will be designed for a speed of 45 MPH. Direct accesses will be limited to six per mile. New individual lot access will be permitted in hardship cases. A distance of 1025 feet will be maintained between cross road intersections whenever practical. Collector roads combine smaller traffic flows until they reach a volume that warrants an intersection along an arterial roadway. Collectors expedite movement of traffic in the local area. Collectors serve a dual function between mobility and land access by connecting local roads to arterials. Collector roads serve smaller communities and neighborhoods. If requested by OWNER, prior to heavy equipment operations on each welisite, SOCO's representative will meet and consult with OWNER(or OWNER's representative)as to the location of the welisite, access roads, fiowlincs, tank batteries and other associated production facilities. 3. In conducting operations on the LANDS, SOCO shall: A. Limit the size of each welisite to approximately 300 feet by 300 feet during any drilling, completion, recompletion or workover operations and shall be no more than 1/4 acre in size during other periods. The area required for any tank battery location associated with each well shall be limited to approximately one-half acre in size upon completion of construction. Access roads shall be limited to approximately 30 feet in width during drilling, completion, recompletion and workover operations. The permanent access roads to the well head and tank battery location shall be limited to 16 feet in width. B. The following is a brief summation of the findings that you and I established at the location. 1. It would be better to utilize an existing access rather than create a new one, provided it could meet the criteria set by the state for a "safe access" 2. The existing sight distance on Weld County Road 13 north of the access road is the area of concern. 3. The existing sight distance is between 550 and 600 feet. 4. That one of the major factors contributing to the limited sight distance is the elevation of the access road and the slope of the hill that runs along road 13. The hill limits the ability of a driver going south on road 13 to see an east bound vehicle approaching the exit on the access road. The State Highway Access Code and specifically Section 4.9 provides the methods and measurements to determine the required sight distance of an access road. The eye level of a driver is of critical importance in determining the required distance to see another vehicle. Therefore, we both agreed that if the elevation of the access road was raised the sight distance could be increased significantly. In addition, we also felt that if the slope of the hill running parallel to road 13 was cut back the ability of a driver going south on road 13 to see an east bound vehicle approaching the exit on the access road would also be increased considerably. As of the date of this letter Mr. Kerbs has raised the elevation of the access road and cut back the adjoining slop as we discussed. I have since measured the sight distance according to the guidelines set forth in Section 4.9 of the State Highway Access Code and it is now over 650 feet_ I have enclosed photographs that were taken so that you could see the changes and the difference that it made. We also discussed briefly the volume of traffic on road 13. I was told that there was an average daily traffic count of over 1,000 vehicles per day on road 13 and that the additional residential traffic at this sight would bring the daily traffic count close to the maximum. It is my understanding from what you told me that road 13 could maintain up to a 9,000 average daily traffic count and that the traffic from an additional residential access would have little to no effect and would not adversely affect the safety of the traveling public. Proposed lot A will have an approved septic system and leach field installed per Weld County Health Department requirements. • The entire farm consists of approximately 108 acres of farmland. The land is currently dry farmed with winter wheat and sorghums as two of the most recent crops.. Lot B will continue to be farmed in this manner.
