RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION # 1724 - LINDBERG
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #1724 was submitted by Craig A. Lindberg,
3560 Valley Oak Drive, Loveland, Colorado 80538, for property which is described as Lot A of RE
#1015, located in the E%: SW% of Section 32, Township 3 North, Range 68, West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
222 acres and 5 acres, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony
presented, the Board determined that said request shall be denied for the following reasons:
1. The Board feels this division would be inconsistent with efficient and orderly
development.
2. The Board feels this proposal is not consistent with the Weld County Comprehensive
Plan.
3. The Board feels the future enlargement of Union Reservoir could adversely affect the
property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption #1724, submitted by Craig A. Lindberg
be, and hereby is, denied.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 15th day of May, A.D., 1995.

Subject: RE -1724, Lot A of RE -1015 E2, SW4 of Section 32, T3N, R68W of the 6th P.M., Weld
County, Colorado
Dear Commissioners:
This request for a recorded exemption is submitted by Craig A. Lindberg. The parcel of land under
consideration is described as Lot A of RE -1015 being in the E2, SW4 of Section 32, T3N, R68W
of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent to Weld
County Road 26 and east of and adjacent to Union Reservoir. RE -188 approved by the Board of
County Commissioners, October 29, 1975 created two lots of 225 acres and 1 acres, more or less.
RE -1015, approved by the Department of Planning Services staff June 9, 1987 further divided
Parcel B of RE -188 into two parcels of 222 and 5 acres, more less, creating two additional lots.
The applicant is now requesting to further subdivide Lot A of RE -1015 into two parcels of 3.4 acres
and 2 acres, more or less. The land has no existing improvements on it and appears to have been
planted in row crop. The site lies within the Urban Growth Boundary of The City of Longmont and
The Town of Mead. The Mixed Use Development Area (MUD) lies directly south of the proposed
recorded exemption.
Access to both lots are proposed from Weld County Road 26. Longs Peak Water District is the
proposed water source. Longs Peak Water District has indicated that the applicant will need to make
significant improvements to the system in order to provide service to the property. Septic systems
are proposed for sewage disposal on the sites.
The Town of Mead reviewed this proposal and commented that this proposal is much more
appropriate than urban density development recently proposed for the southern portion of Union
Reservoir and stated that the request is compatible with their comprehensive plan. The City of
Longmonts Comprehensive Plan designates an open space buffer around Union Reservoir. The

proposed recorded exemption lies in the eastern buffer area.: The City of Longmont also has plans
to enlarge Union Reservoir from its current capacity of 12,768 acre feet to approximately 32,570
acre feet. The City of Longmont has purchased approximately 25 acres south of proposed recorded
exemption property for purposes of enlarging Union Reservoir. The City's property includes area
for a future dam. At the time the reservoir is enlarged, it will be necessary to reroute Weld County
Road 26. If the enlargement of Union Reservoir transpires the applicants property will be engulfed
by Union Reservoir. The City of Longmont requests that the County take into consideration the
future dam and the rerouting of Weld County Road 26 when reviewing this case.
The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with the Agricultural Goals and Policies as stated in the Weld County Comprehensive Plan. The
division of this parcel would create two buildable lots thus contributing to a sprawl row type
development. The 5.4 acre parcel is identified as prime farmground by the Department of
Agriculture Soil Conservation Service. Staff does not see the benefits to the Agricultural Zone
District for establishing the potential for increased development at this location. It is staffs opinion
that this proposal does not encourage or enhance agricultural land uses as intended by the County
Comprehensive Plan. Agricultural policy #1 states: "The agricultural zone district is intended to
preserve prime agricultural land and to provide areas for agricultural activities and uses dependent
upon agriculture without the interference of incompatible residential land uses." The surrounding
land uses are primarily agricultural in nature. Continued divisions of agricultural land is in conflict
with the Comprehensive Plan.
The applicant has stated in the application materials that the reason for the recorded exemption is
due to financial hardship of certain off -site water improvements imposed upon the applicant by the
Longs Peak Water District which he must pursue in order to develop his agricultural tree farm and
homesite. The Comprehensive Plan allows a lot in the A (Agricultural) Zone District to be divided
into two separate parcels if the intent of the Comprehensive Plan is met. The applicant however is
not able to satisfy any of the three criterion.
The Department of Planning Services staff has concerns that:
1. the intent of the Comprehensive Plan has not been met;
2. the future enlargement of Union Reservoir and the effects on the property;and
3. development of sprawl row type development.
The Department of Planning Services staff request that the Board of County Commissioners
consider this request and determine if the standards of Section 11.5.1 through 11.5.7 of the Weld
County Subdivision ordinance have been met.

THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
CITY OF LONGMONT, IN WELD COUNTY
THIS CLAIM was filed with the Water Clerk, Water Division 1,
on December 31, 1986 and the Referee being fully advised in the
premises, does hereby find:
All notices required by law of the filing of this application
were fulfilled, and the Referee has jurisdiction of this application.
Statements;of Opposition to said application were filed by CRS
Investments, Inc., The Newby Group, William Kemp Pace, Carol Pace and
Craig Lindberg, andUnion Property Owners. Subsequently, motions to
intervene were filed by the Union Reservoir Company and Susan
Ptetrzak. The time:for filing additional statements has expired.
All matters contained in the application were reviewed, and
testimony was taken where such testimony was necessar-: and such
corrections made as are indicated by the evidence presented.
FINDINGS OF FACT
L. A decree was entered for Union Reservoir by the District Court
in and for Boulder County on `?arch L3, 1907, with an appropriation date
of October 6, 1902 „for 13,219 acre feet of storage for agricultural
purposes. A refill decree was entered by the District Court in and for
Water Division No. f on March 31, 1977 in case No. W-7486, with an
appropriation date of May 1, L973 for 5,879 acre feet of storage for
irrigation purposes: The present application is for storage of an
additional 19,802 acre feet of water in an enlarged reservoir. The
actual capacity of the existing reservoir is 12,768 acre feet.

stipuiationa were entered into between the applicant and
objectors Edmund C. Oworak, Craig Lindberg, The Newby Group, Phillip
and Marsha Willis, and Joe Seewald providing that at the present time.
Longmont does not po*sess any property rights to inundate or otherwise
use property owned by these objectors for the enlargement of Union
Reservoir as proposed in the subject application. These objectors
further reserved all rights to receive any and all lawful compensation
for any property taken from them as a result cc the enlargement of
rnion Reservoir .is proposed is the subjecc application. subject to rhe
terms of this Stipulation, these objectors' statement of onposition
were withdrawn.
3. On October 28, 1986 at a regular meeting of the Longmont City
Council, the mayor was authorized to sign contracts for option to
purchase shares in Union Reservoir. Rocky mountain Consultants were
also authorized to conduct a detailed analysis of the potential for
exchanges out of the reservoir including the ability to use the
reservoir to re -regulate Windy Gap water. No mention of enlargement of
the reservoir was reflected in the minutes of the meeting.
4. On July 25, 1989 at a regular meeting of the Longmont City
Council, Resolution R-89-27 was passed confirming the intent to
appropriate water for the enlargement of Union Reservoir. A copy of
this resolution was not furnished to the court until September '_4,
L989-
5. Longmont now owns 130.15 shares of the 250 shares in Union
Reservoir.
6. All on site work was accomplished within the current high
water line of Union IReservoir except for surveying Union Reservoir
Enlargement high water line on a few selected parcels.
7. The Water Referee entered a ruling in this matter. on September
5, 1989 which ruling is hereby revised based upon new evidence
submitted. _

protection, generat .on of electric power and power generally,
recreation, fish and wildlife propagation, sewage treatment, street
sprinkling, maintenance of :_,1aquate storage reserves, replacement,
augmentation and exchange.
S. Water! shall not be impounded, except pursuant to the
operation of a _awful exchange, unless entitled to do so by eirtue .' f
the priority herein awarded. At all ether times, all inflow of water
into the reservoir from any source, including precipitation, shall be
removed by applicant or applicant's successors in interest by draining,
pumping or other means, and released into the nearest natural
watercourse or- below the reservoir, and not utilized by applicant or
applicant's successors in interest in any manner. Applicant shall
install and maintain such meters, measuring devices or other structures
as may be required by the Division Engineer of Water Division No. 1.
9. Name and capacity of ditches leading to the reservoir:
The total capacity of the ditches and proposed pipelines leading to the
reservoir will be 1,140 cubic feet per second as follows:
A. Portions of the Oligarchy Ditch through Longmont have
a capacity of 1000 cubic feet per second and its headgate is

The proposed Highland Exchange Structure will be located at
the point where the Highland Ditch intersects the N/S center
line of Section 19, Township 3 North, Range 68 West, 6th
P.M., Weld County; or approximately 2,600 feet East and 300
feet South of the NW ee rner, Section 19. The headgate of

C. The proposed pipelines from St. V rain Creek Pump Stations

will be located at a point on the North bank of St. tram
Creek approximately 1,400 feet East and L,560 feet South of
the NW corner, Section 11, Township 2 North, Range 69 West,
6th 'P.M., Boulder County. The proposed St. V rain ' Creek Pump
Station No. 2 will be located at a point en the West bank of
St. Vrai.n Creek approximately 190 feet North and 2,700 feet
East of the 3W'corner, Section 4, Township 2 North, Range 68
West, 6th P.M., Weld County.
10. It is also ordered that the conditional right herein
awarded is hereby continued in full force and effect until February
1997. If applicant desires to maintain such conditional decree, an
application for a lterreiremmi-&F finding of reasonable diligence shall be
filed on or before February,, 1997 or a showing made on or before such
date that the conditional water right has become an absolute water
right by reason of!the completion of the appropriation.
11. The Priority herein awarded said Union Reservoir
Enlargement was filed in the Water Court in the year of 1986 and shall
be administered as; having been filed in that year; and shall be junior
to all priorities filed in previous years. As between all rights,

the application meets the approval criteria of the Weld County Subdivision Ordinance, you will be notified
that the recorded exemption is approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a
public hearing. You will be informed of the hearing date prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the

accordance with the requirements of Section 11.7 of the Weld county Subdivision Ordinance.
The plat shall be submitted within sixty (60) days from the date of approval by the

ARTICLE I
REQUEST FOR A SUBDIVISION EXEMPTION:
Comes now Mr. Craig A. Lindberg to the County of Weld with a
request to divide a parcel of land 5.4 + or - acres into two
parcels; being 3.4 acres + or - and the other 2.0 acres + or -
The request is due to the financial hardship of certain off -site
water improvements imposed upon Mr. Lindberg by the Longs Peak
Water District which he must pursue in order to develop his
agricultural tree farm and homesite upon the 3.4 acres + or -.
In order to provide the improvements necessary for the Longs Peak
Water District Mr. Lindberg must complete approximately $75,000
in off -site work to the transmission system.
ARTICLE II
LEGAL DESCRIPTION: SEE EXHIBIT A; Surveyor Ronald W. Adams #13446
A 5.4 + or - acre parcel of land known as Lot B of RE -188
part of the E 1/2 of the SW 1/4 of Section 32, T3N, R68W of the
6th P.M., Weld County Colorado, which is a Recorded Exemption
from that larger 221 + or - parcel exempted from Edwind C. Dworak
for the person of Craig A. Lindberg, and recorded June 9, 1987
being Case # RE -1015 in the County of Weld, State of Colorado.
ARTICLE II
WATER SUPPLY:
The current 5.4 + or - acre tract has a well permit which
was issued by the State of Colorado for inside use of a single
family residential home.
The Longs Peak Water District had agreed to serve the parcel
at their meeting February 13, 1987. During the time lapse from
the approval letter until construction was contemplated in 1994,
several taps were allocated to other parcels within the district
and utilized by other builders. The net effect of the use of
those taps reduced the overall line service pressure to this
subject parcel to a level below their ability to provide domestic
service at this time.
The Longs Peak Water District has agreed that service will
still be provided when the Owner Mr. Craig A. Lindberg provides
the necessary upgrades to the system at his front end expense
(which can be reimbursed over time from the sale of additional
taps by the District).
In the mean time the requirement for this up -fronting of the
main transmission line to this service area for the water
district improvements by Mr. Lindberg has shown to be a financial
hardship. Although the State of Colorado has allowed a well
permit to be used for Mr. Lindberg to build his residence upon
the parcel he can not augment irrigation of his trees at certain

strategic times of the year when surface irrigation water will
not be available to him, nor can he use Longs Peak Water as he
had planned until he can complete the improvements.
ARTICLE III
ANSWERS TO THE RECORDED EXEMPTION QUESTIONNAIRE
1.) Each of the proposed parcels (parcel A which will be
approximately 3.4 acres, and parcel B which will be approximately
2.0 acres) will be used as agricultural parcels with a
residential home being built upon both sites Mr. Lindberg
intends to grow trees upon approximately 4.0 of the original 5.4
acre parcel. The remaining 1.4 acres will be used for access
ways and the placement of a residential home on each parcel. Mr
Lindberg will sell parcel B to another party but will continue to
lease approximately 0.6 acres from the new purchaser on a 99 year
lease for the purpose of continuing his proposed tree farm
operation.
2.) The existing parcel is located in the E 1/2 of the SW 1/4 of
Section 32, T3N, R68W of the 6th P. M. , Weld County Colorado.
The parcel is approximately 5.4 acres + or - and is currently
used as agricultural land. The agricultural use will remain as
intended after the completion of the division of the land by
exemption. Proposed new lot A will be approximately 3.4 acres;
parcel B will be approximately 2.0 acres.
3.) The proposal meets the continuing agricultural use
requirements of the Weld County Comprehensive plan. It is
further consistent with the original exemption in that
agricultural use will continue on both proposed parcels. It is
consistent with the hardship requirements of the plan as well.
Mr. Lindberg is being asked to make approximately $
75,000.00 in off -site improvements to the transmission system of
the Longs Peak Water District so that he can develop his tree
farm and build his residence upon the land. Although Mr.
Lindberg may recapture some of the cost of improving the Longs
Peak Water System over time, it is unclear how long it will take
for him to regain the investment before he can start the tree
farm or build his residence after expending the $75,000 up front.
4.) The surrounding use of the land is agricultural with owner
homes upon the parcels, this use will continue upon the Recorded
exemption parcel. As before stated approximately 4.0 of the
original 5.4 acres will remain in agricultural use.
5.) The existing zoning is for agricultural. The use of
agriculture will continue and will he consistent with the zoning
in the area.
6.) The parcel is consistent with efficient and orderly
development. This exemption will allow the owner to continue his
agricultural use, build his residence, and provide needed

improvements to a public water system to augment his irrigation
needs.
7.) Adequate protection of the health safety and welfare of the
inhabitants of the neighborhood will be accomplished by the
addition of the tree farm which will provide increased levels of
oxygen to the area. The neighborhood will be enhanced by the
beauty of growing trees next to the lake. People living in the
neighborhood will have an additional neighbor to help them safely
live in proximity with each other as they watch out for each
others interests. The general welfare of the agricultural
community will continue to remain as it has been over the years
with the addition of the neighborhood tree farm.
ARTICLE IV
SANITARY WASTE DISPOSAL
Each parcel will provide an engineered septic system and
leach field.
ARTICLE V
ACCESS FROM A PUBLIC WAY
Private access to the parcels will be from a common road
which will originate from Weld County Road #26. The common road
will be maintained by mutual agreement of the owners, and will
not require maintenance by Weld County.

Re: Request for Commitment for Service
Dear Mr. Lindberg;
This letter is in response to your request that the Longs Peak Water
District commit to provide domestic water service to property described as
follows:
A parcel of land situate in the SW 1/4 of Section 32, Township
3N, Range 68 West of the 6th Principal Meridian in Weld County,
Colorado. Further, this property is said. to be north of Weld
County Road 26 and east of Union reservoir. It is our
understanding that this parcel of land is proposed to be split
into two (2) parcels.
The request is for two (2) standard 5/8" X 3/4" residential water taps
(one per lot).
We currently have a 1" diameter water line located along the north
side of Weld County Road 26 in the above described area. The current lines
feeding this area have no additional capacity available. Therefore, we will
commit to provide service to these lots via one standard residential water
tap per lot only with the understanding that significant improvements must
be made to our distribution system in order to provide service. The
following conditions are pertinent to this commitment:
1. Significant improvements to our system must be made in order
to provide service to the above described property. Those
improvements will be your responsibility should you decide to
proceed.
2. To determine the extent of improvements necessary to provide
service, our engineer will have to produce a hydraulic study of
the area. Costs for this study are estimated to be approximately
$1,500. If you would like us to proceed with the study, please
send a check in the amount of $1,500 along with a "Tap Review
Request" (form enclosed) to our office. We will then authorize a
study of the area. If the deposit is in excess of the actual
costs of the study, we will refund the remaining amount upon
completion. If additional costs are incurred, we will bill you
for the additional amount.

3. All improvements to District facilities required to provide
service will be the financial responsibility of the developer in
accordance with District Bylaws, Policies and Regulations. All
improvements must conform to District Specifications.
This commitment will expire six months from the date of this letter if
the taps have not been purchased and installed by that date.
The current fee for the above described water taps is $5,000.00 (each)
and is subject to change without notice.

Dear Shani:
I have reviewed the requested "recorded exemption" for Craig Lindberg, described as Lot A of
RE -1015, in the N% of the SW % of Section 32, T3N, R68W, referred to the Town of Mead. The
division of this five acre parcel into a 2 acre parcel and a 3.4 acre parcel is compatible with our
comprehensive plan. This proposal is much more appropriate than the urban density
development recently proposed for the southern portion of Union Reservoir. The town does not
object to the use of septic systems for sanitary disposal on these large lots.
Therefore, the Town does not have an objection to a granting of the proposed recorded

Thank you very much for sending the Lindberg recorded exemption application to the City of
Longmont for our review and comment. The proposed recorded exemption is adjacent to Union
Reservoir and north of WCR26. The applicant proposes to split a 5 acre± parcel into two smaller
parcels. The 5 acre± parcel is the result of a previously approved recorded exemption. The
intent is to use both parcels for agricultural uses with a house on each parcel.
In our comments on the Weld County Comprehensive Plan update, the City has discussed the
value of preserving a buffer of agriculturally zoned property between Longmont and the I-25
Mixed Use Development Area. This buffer would provide for the physical separation between
the City and the urban development within unincorporated Weld County. The Longmont Area
Comprehensive Plan designates the area around Union Reservoir as part of the Eastern Buffer.
This proposed recorded exemption is within the Eastern Buffer.
The City recognizes that Weld County needs to honor existing development approvals. This 5
acre± property already is the result of a recorded exemption. The City respectfully requests that
Weld County consider the cumulative effect that approving subsequent exemptions, and smaller
and smaller parcels, may have on the long term viability of agriculture: both on this property
and in this general area.
It is important for Weld County, the applicant, and future property owners to know that the City
has a conditional decree to enlarge Union Reservoir from its current capacity of 12,768 acre feet
to approximately 32,570 acre feet (case 86-CW-394). The City purchased approximately 25 acres
south of this parcel for the purpose of enlarging Union Reservoir. The City's property includes
area for a future dam which will be needed to allow for the reservoir's enlargement.
At the time the reservoir is enlarged, it will be necessary to reroute WCR26 to the south side of
the City's property immediately south of and adjacent to the proposed dam. Consequently, the
City suggests that Weld County take into consideration the future dam and the rerouting of
WCR26 in your review of the recorded exemption application.

Minutes of April 21, 1994 Meeting
newly -elected directors. Mr. Rodgers directed that copies of the oaths be
attached to and made part of these minutes.
7.'ELECTION/APPOINTMENT OF OFFICERS/CONSULTANTS. Mr. Rodgers declared that the
biennial election and appointment of officers and consultants should occur. Mr.
Boyd nominated Mr. Rodgers for the office of President. There being no further
nominations, it was moved by Mr. Boyd and seconded by Mr. Olander that a
unanimous ballot be cast for Mr. Rodgers. The motion carried unanimously.
Mr. Peterson nominated Mr. Boyd for the office of'Vice--President, There being
no further nominations, it was moved by Mr. Peterson and seconded by Mr. Prescott
that a unanimous ballot be cast for Mr. Boyd. The motion carried unanimously.
Fir. Olander nominated Mr. Peterson for the office of Treasurer. There being no
further nominations, it was moved by Mr. Olander and seconded by Mr. Prescott
that a unanimous ballot be cast for Mr Peterson. The motion carried unanimously.
It was moved by Mr. Prescott and seconded by Mr. Peterson that Mrs. Storey be
appointed Secretary and Mr. Bernard be appointed Assistant Secretary. The motion
carried unanimously.
It was moved by Mr. Prescott and seconded by Mr. Peterson that fir. Rollin be
appointed as the District's engineer and that Mr. Bernard be appointed as the
District's Attorney. The motion carried unanimously.
E. MINUTES APPROVED. It was moved by Mr. Olander and seconded by Mr. Prescott
that the minutes of the special meeting on March 17, 1994 be approved as
presented. The motion carried unanimously.
9. PUBLIC COhiNEMTS. iir. Lefever appeared to raise questions about the
Participation Agreement including the engineering fees, especially fees for
observations of boring. He also objected to certain provisions in the
Participation Agreement including how interest is computed and how the total
amount is to be divided. By consensus, the Board agreed that the Participation
Agreement should be amended to provide for 8% interest from March 17, i994 to the
date on which the Board approved subsequent taps within the area affected by 'the
Participation Agreement.
1O. LINDBERa TAP COMMITMENT. Mr. Lindberg appeared to ,request service on his
land at the southeast side of Union Reservoir. Mr. Peppler and Mr. Rollin
explained the water pressure problems in the area and noted that several other
applicants for tap commitments in the same area had their requests for tap
commitments turned down since Mr. Li ndberg's previous tap commitments had expired
several years ago. The Board suggested that Mr. Lindberg contact Mike Felton,
Jay Docheff or Fowler Realty regarding the possibility of a group being formed
to raise the funds necessary for line expansions and improvements in the area.
