RE: APPROVE ENTRY BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST
UPON VARIOUS LANDS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on either June 20, 26, 27, or 29, 1995, the Weld County Vegetation
Management Specialist mailed notices to various landowners within Weld County advising them
that lands owned or occupied by them contain Canada thistle, musk thistle, and/or leafy spurge,
noxious weeds, and
WHEREAS, said notices stated that said noxious weeds must be controlled or eradicated
within ten days from the date of said notices and gave recommendations as to what methods are
to be used for such control or eradication, and
WHEREAS, a copy of said list, containing the legal descriptions of the lands and the names
of those landowners who have failed to comply with said recommendations, is attached hereto and
incorporated herein by reference, and
WHEREAS, the County Vegetation Management Specialist has requested that the Board
approve his entry upon lands, as set forth in the abovementioned list, to affect the control or
eradication of noxious weeds, and
WHEREAS, at its meeting of July 12, 1995, the Board did Find as follows:
1. That those landowners mentioned on the list are the owners of said land within a
pest control district.
2. That Canada thistle, musk thistle, and/or leafy spurge, noxious weeds, are found
upon said lands.
3. That said landowners received appropriate notice and such notice specified the best
available means for control or eradication of said noxious weeds.
4. That said landowners have not complied with the requirements as stated by the
County Vegetation Management Specialist.

WHEREAS, pursuant to said Findings, the Board deems it advisable to approve the entry
by the Weld County Vegetation Management Specialist upon said lands described in the list
attached hereto, to affect the control or eradication of the abovementioned noxious weeds.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board does hereby approve the entry by the Weld County Vegetation
Management Specialist upon various lands as set forth in the list attached hereto to affect the
control or eradication of Canada thistle, musk thistle, and/or leafy spurge, noxious weeds.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 12th day of July, A.D., 1995.

Under the Pest Control District Law, CRS, 35-5-108, and the Colorado Weed Management Act,
CRS, 35-5.5-109, I must seek approval or right of entry from the Board of County
Commissioners to enter on private land to carry out weed control measures.
Below is a list of landowners, and the legal description of their land, that we may have to enforce
on. I am seeking your approval to enter upon these lands.

The weed notices were mailed on either June 20, 26,27 or 29, 1995, requesting control of one or
more of the following weed species: leafy spurge (Euphorbia esula), Canada thistle (Cirsium
arvense) and or musk thistle (Carduus nutans) . Enclosed is a copy of a notice sent under each
weed law.

RE: Notice of the Need for the Control or Eradication of Noxious Weeds
Dear Mr. and Mrs. Butler:
Under provision of the Pest Control Districts Law (35-5-108(1) C.R.S.), this letter is to serve as notice that
the presence of noxious weeds has been observed on property which is owned, leased, and/or occupied
by you and located in the 1/4 of Section 35 Township 7 North, Range
67 West of the 6th P.M., Weld County, Colorado. The property is designated in the Weld
County Assessors Office as parcel(s) number(s) 070535000032
This property is located in the Eaton - Ault pest control district.
The noxious weeds present on the property include; Canada thistle (Cirsium arvense) and leafy spurge
(Euchorbia esula)
Because these weeds are nearing bloom stage, they must be controlled and kept from going to seed.
Presently, the best methods of control are: 1) to mow as necessary throughout the year to keep the weeds
from going to seed (3-5 times) and then spray with herbicides in the fall, 2) to mow throughout the season
to keep the plants from going to seed, 3) to spray with herbicides up to the early flower stage.
Section 35-5-108,(1)C.R.S. requires you to control the weeds by using at least one of these methods.
Please be advised that if you do not control or eradicate these weeds by July 7, 1995 I will
ask the Board of County Commissioners of Weld County for permission to enter the property to use one of
these methods of control or eradication at your expense, as provided in Section 35-5-108 (2,3) C.R.S.
I will be glad to answer any questions you may have regarding the control or eradication of the noxious
weeds on the property. I am also available to assist you in developing short and long term weed
