GREELEY, CO 80632 COLORADO January 27, 1998 Patina Oil and Gas Attention: Bart Brookman 804 Grand Avenue Platteville, CO 80651 RE: Maintenance of Weld County Road 47.5, South from Weld County Road 34.5 Dear Mr. Brookman: The Board of County Commissioners of Weld County has been informed by Mr. Don Somer of the Weld County Public Works Department that Patina Oil and Gas Company has been using Weld County Road ("WCR") 47.5, south from WCR 34.5. The first half mile of this portion of WCR 47.5 is maintained by Weld County. The south one half mile is not maintained by the County but, rather, is maintained by approximately four to five families living nearby. H.S. Resources also participates in the maintenance. Patina's wells are located south of the last resident on the road. All of the homeowners and H.S. Resources have asked the Board of County Commissioners to inquire of your Company as to whether or not it is willing to participate in maintaining the south one half mile of the roadway which is not maintained by Weld County. Copies of pictures of the roadway are enclosed. There are many road rights-of-way located within Weld County which are owned by the County but are not maintained using public funds. Weld County's policy is to inform adjacent land owners that they may seek County maintenance if the roadway is brought up to applicable standards set by the Public Works Department. In this case, none of the families have the resources to spend on upgrading the roadway to the point where it is eligible for maintenance by the County. They have chosen instead to maintain it on their own and to seek the help of any persons or companies which may be using the roadway for access to privately owned properties. 980550 Patina Oil and Gas January 27, 1998 Page 2. The Board of County Commissioners views the homeowners' and H.S. Resources' request as reasonable. With knowledge of Patina's good record of community involvement and participation, the Board knows that your Company will respond in a neighborly fashion and assist the homeowners and H.S. Barker, Weld County Attorney wiDeDATE: January 20, 1998 RE: Request to P"tina Oil & Gas Company for Assistance in COLORADO Maintaining WCR 47.5 Attached are some materials from Don Somer of the Weld County Public Works Department regarding use of a portion of WCR 47.5, south of WCR 34.5 by Petina Oil and Gas Company. As you can see from Mr. Somer's statement, it appears that H.S. Resources and the various families who use the roadway are maintaining the south half of the mile south of WCR 34.5, without any assistance from Patina. They have asked Mr. Somer and the Board of County Commissioners to find out if l#tina is willing to assist in this maintenance. I recommend that the Board authorize the Chair's signature on the attached letter. Box 758 Greeley, CO 80632 Re: Maintenance of WCR 47.5 south from WCR 34.5 Dear Ms. Harbert: I have reviewed the road maintenance issues outlined in your letter dated January 27, 1998. I have also toured the road to gain a better understanding of the issues. The road as it is currently constructed is deficient and prone to a high degree of maintenance. It is my understanding that the road was constructed deficiently prior to Patina or Patina's predecessors use of the road for oil and gas operations. However, in the interest of sharing the responsibility of maintenance with other users of the road, Patina is willing to participate in the maintenance of that portion of the road not currently maintained by Weld County with the understanding that Patina's road maintenance duties shall be reasonably similar to other access roads maintained by Patina whereby Patina shall conduct blading operations generally on a semi-annual basis.
