HomeMy WebLinkAbout950702.tiffORDINANCE NO. 89 -DD IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS OF CERTAIN SECTIONS, AND THE ADDITION OF CERTAIN SECTIONS TO ORDINANCE NO. 89, WELD COUNTY ZONING ORDINANCE, AS CURRENTLY AMENDED, REVISING AND ADDING CERTAIN PROCEDURES, TERMS, AND REQUIREMENTS BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority, under the Weld County Home Rule Charter and State statute, including Article 28 of Title 30 CRS, to adopt zoning regulations for the unincorporated areas of the County of Weld, State of Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has previously adopted Ordinance No. 89, Weld County Zoning Ordinance, establishing a comprehensive revision of the Zoning Ordinance and zoning maps for unincorporated areas of the County of Weld, and has adopted amendments in Ordinance No. 89-A through 89 -CC, and WHEREAS, said Ordinance No. 89, as amended, is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of the County of Weld, State of Colorado, that certain existing sections of said Ordinance No. 89, as amended, are repealed and re-enacted, with amendments, and the various sections are revised to read as follows: Amend Section 10.1.D. by changing the existing definition of DWELLING, SINGLE FAMILY (SINGLE FAMILY DWELLING) to read: DWELLING, SINGLE FAMILY (SINGLE FAMILY DWELLING): A DWELLING UNIT or MANUFACTURED HOME other than a MOBILE HOME arranged, designed, and intended to be occupied by not more than one LIVING UNIT. The projected view of any exterior wall of a DWELLING UNIT or MANUFACTURED HOME shall not be less than 20'0". 950702 ORD89 RE: ORDINANCE #89 -DD PAGE 2 Amend Section 10.1.M. by changing the existing definition of MANUFACTURED HOME to read: MANUFACTURED HOME: A single family dwelling which: is practically or entirely manufactured in a factory; is not less than twenty-four feet in width and thirty-six feet in length; is installed on an engineered permanent foundation in compliance with ANSI A225.1-1987. Manufactured Home Installations. Appendix C. has brick, wood, or cosmetically equivalent exterior siding and a pitched roof; and is certified pursuant to the "National Manufactured Housing Construction and Safety Standards Act of 1974", 42 U.S.C. 5401 et seq, as amended. Amend the first sentence of Section 32.2.2.1 to read: One (1) SINGLE FAMILY DWELLING or MANUFACTURED HOME per LEGAL LOT, the SINGLE FAMILY DWELLING or MANUFACTURED HOME shall be connected to and served by a PUBLIC WATER system and a PUBLIC SEWER system. Amend Section 46.1.1 to read: After the effective date of this Ordinance no MANUFACTURED HOME may be located or relocated in Weld County, except in accordance with Section 46 of this Ordinance, including the issuance of any zoning permit which may be required by that Section. Each MANUFACTURED HOME located or relocated in Weld County after the effective date of this Section must have a BUILDING permit for a MANUFACTURED HOME issued pursuant to the Weld County Building Code Ordinance. An application for any zoning permit, where not allowed as a use by right, or building permit for a MANUFACTURED HOME required by Section 46 shall include the following: Amend Section 46.2.6 to read: PRINCIPAL DWELLING UNIT. Only one (1) MANUFACTURED HOME may be permitted as a use by right in the A (Agricultural) Zone District for each LEGAL LOT. The applicant shall obtain a building permit and comply with installation standards of the Weld County Building Code Ordinance. Delete Sections 46.2.6.1 through 46.2.6.2. ORD89 950702 RE: ORDINANCE #89 -DD PAGE 3 BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 89 -DD was, on motion duly made and seconded, adopted by the following vote on the 13th day of March, A.D., 1995.
