HomeMy WebLinkAbout650340.tiff/1. 6 C RESOLUTION WHEREAS, a public hearing was held in the office of the Board of County Commissioners, Weld County Court House, Greeley, Colorado, on Friday, March 5, 1965 at 2:30 P.M. pursuant to the laws of the State of Colorado as provided, and, WHEREAS, at said meeting the application for rezoning from Estate District to "B" Business District of F. W. Dickinson, ''L+,1 Roy Johnson and Bonnie Grantham of west Greeley zoning area was heard, and, WHEREAS, said meeting was attended by all petitioners and ten interested property owners in the immediate vicinity of said area, and, WHEREAS, the petitioners represented that the reasons for rezoning was that they had been contacted by interested persons in starting a business location in this area, and, WHEREAS, the property owners present in the area stated that they had purchased their property having in mind that this was a residential area and that they objected to business being located along 20th Street as it was already a heavily traveled street, and, WHEREAS, it was further discussed that a shopping center existed on 10th Street to the north and possibly one to the south on 28th Street and that 20th Street was a heavily traveled street because of the American Legion, Municipal Golf Course, Greeley High School West and the residences in the area, and, WHEREAS, good zoning practices follow that no shopping centers or business areas should be located closer than 2 miles, and it appears that business will now locate along 10th Street extended west and 28th Street extended west being old Highway #34 and the new By -Pass of Highway #34, and, -1- PLcq,i' 650340 WHEREAS, the petitioners further stated that in all prob- ability no business would be located in the area for several years. NOW THEREFORE BE IT RESOLVED by the Board of County Com- missioners that the application for rezoning from "E" Estate District to "B" Business District of F. W. Dickinson, Roy Johnson and Bonnie Grantham of the west Greeley zoning area covering the following property in Weld County, Colorado, to -wit: NE corner of Section 15 Sly along E line said Section 15, 845 feet, thence W 1020', m/1, to the SE corner of Lot 5, Lundvall subdivision to said point being on center line of Grapevine Ditch; to the N line of said Section 15; thence E along the N line of said Section 15 to the true point of beginning; and all of Lot 1, Lundvall Subdivision. is hereby denied for the reasons stated herein and that in the opinion of the Board of County Commissioners it is not best use of the land, nor does it follow the plans for the area. Shultz: we will proceed with the reading of the notice of the hearing Pursuant to the zoning laws of the State of Colorado, the yield County Planning Commission recommends and certifies to the Board of County Commissioners of weld County, Colorado that the application from rezoning from "E" Estate District to "B" Business District of F. .J. That is the notice of the hearing. Now we will open the hearing by listening to the people who are in favor of thogranting of this change of zone. Anyone caring to give remarks will 2 give their name and proceed. Carl Ahlborn: I am representing the petitioners I would like to have Loth Mr. Dickerson and Mr. Johnson explain the reasons for the change and what they have in mind. Ns. Dickerson: V,e had asked for this zoning the reasons being that we think this location being exactly 1 mile south of Highway 34 now which will be 1 mile north of the new Highway 24, will be a very logical location for an area for a shopping center whenever the need comes. So we thought this war a good time to do it before more people ask for development in the area. To do this and get it zoned nothing may happen in the way of building, we do not have any immediate plans. are will just take it as it comes, it will probably be a nuli:ber of years before anyone is building commercial property there. It is our belief that if we do this now other in the area who intend to buy around the area will know the situation and know what is going to be there. fear. Johnson: I am a partner with tAr. Dickerson on this land, that we are discussing. I have sat on in these hearings before a ?ear ago and I realized one position where a, or opposition could put in anything. Dick and I have respect for a piece of land and we will have specifications that it will not be just anything come in, it is going to be a respectable business. we do have a few calls of business on that section and like as I stated a year ago that wanted it revoked --- that we could put in junk yards or used car lot or something like that. cell there is nothing in our 3` Mr.Johnson: thinking. We are proud of it and it is going to be an asset to the community. We are going to put something that will be an asset to the neighbors in that community. We are going to have specifications that they will be proud of and we will be too, Which will bring the assets up to oilr land and theirs and outside of that I don't have to much more to say. If you have any questions I will be glad to answer them. Mr. Shultz: Thank you. Would anyone else care to make any remarks in favor of granting of this change. Mrs. Grantham: I think I pay more taxes than my neighbors do and for the same amount for that reason I would like to have my lots rezoned and I also have a beauty shop out there and I want it zoned for business. Mr. Shultz: Is it not true Mrs Grantham that you can have a beauty shop there with the present zone. Mrs Grantham: That true but it limits me, if I should happen to be ill or something I could not hire anybody else. Mr. Shultz: Thats correct. Is there anyone else who would care to make a remark in favor of granting the change of zone If not we will listen to the people who are not in favor of the change. Ralph Faber: I live 2010 Fiftieth Avenue, I have a petition signed by 12 landowners on 50th Avenue bordering Grapehiine Ditch on the west side which is just across the property from which you are referring n 4 gar. Faber read petition " We the undersigned propety owners of 50th Avenue want it known that we are opposed to the proposed change of zone for the property of F. W. Dressor Mr. Faber: My personal feeling on this is that I was sold a home in an estate area I bought it there because I want to raise my family there, I don't belive there is any type of business you could put next to my area, next to my property which would enhance the value and I am certain it would deplete the value of it. If anyone here doesn'.t think so if they just want to pay me what the place is worth now if they think they can make some money off a change. As far as Mrs. Grantham property is concerned they came to us and asked if we cared about the beauty shop and we said we did not. /e think that everyone should have a right to make a living as long as they do not change it to a business zone. My home is next to hers and we are certainly are against chaning any of it into any kind of a business zone. we also just as a matter of interest notice that the zoning Board here voted against a shopping center out there.... they said it is our feeling that 20th Street should be retained as a residentail collector street and also 5` . e1 Mr. Faber: the street should be used for the transportation of school and church attendance and recreation purpose. Mrs. Faber: I would like to ask a question, if they do business zone this how can we be sure it will be kept a respectable type business. Once it is business zoned any type of business with minimum specifications could buy this property. Mr. JohnsoN: I know there are several who think we are going to put in a beer joint or something like that well that plum out. Some people might think - well theres one lady in there who want a portion to build a nice home and have a bridge club where she can teach people to play bridge, it a respectable club for ladies to go to learn to play bridge and that is one instance. As the gentlemen stated about his home there I am sure that this is far enough away if there is a business corner it will be a half mile away from his house, whether its a filling station or a shopping center or what it is I am sure it would not deputize his house or lot for his family in any form. here not -- in our specificatons we will have the planning committee or the Commissioners set the qualifications if it will help the people as of neighbors. We want to be neighbors and friends and to put up something respectable and to us too. The reason for this is we have some inquiries who want something like this. Mr. Dickinson; Mr. Chairman in answer to this ladies question is that we are asking for a "B" zone of course many many things are restricted in "B" zoning - in other words undesirable types of business such as junk yards and that type of thing You are protected with "B" zoning because only certain types 6• of buildings can be in this zone Mr. Faber: A short rebuttal it wouldn't be a half a mile away its only one half away to the east side of that property, its right across the ditch. Its a pretty good bet that if they put any type of business zone in there that they would probably use that for an alleyway for their trucks. I am against any type of business zone - regardless. Mary Chestnut: I don't particularly care to have a business behind my house either, there is nothing stating that these fellows can't sell their land to someone else that would in turn want some other kind of business. Mrs. Warm I live right next to dir. Faber - we bought out there with the intentions of getting away from town. Mrs. Faber One more thing there is a variance going in a mile south of us on that main highway. I don't see the real advantage of having two shopping centers in a one mile area. It doesn't sound feasible to me. Mrs. Morton: We live on the west side of 20th Avenue we bought out there as strictly residential area and we don't care to see any business zone. Mr. Shultz: Mr. Ahlborn: Anyone else who would care to speak? Mr. Ahlborn. I think everything has been brought out as I understand it this Grapevine Ditch there is an embankment there which is a natural barrier, the property sought to be rezoned and the homes the petitioner objecting to it so that actuality its not setting at the same level or at the same property line. There is a natural barrier there created by the ditch. which will remain. r'h 7 Mr . Johnson: I would like to add a little to that, across the ditch it is all residential it is just this one side along the road which to the ditch is residential except the 300 feet or 1530 feet in from the 20th Street Road and it is specified in the map. Its not the whole place it is just the frontage that zoned business. The rest of it is residential across from the ditch all the way around. It is just the frontage we are talking about. Mr. Shultz: The frontage on 20th Street and 47th Avenue is that correct ? Mx. Johnson: Right +r. Shultz: Any other comments that anyone would like to make? With that I believe we have listened to both sides of the issue and the Commissioners will take the hearing under advisement and hope to make our decision in the very near future, since there has been considerable opposition we this is the approach to take to it. We will make a fair study of it and assure you we will do our best to make the right decision. The hearing is now closed. It is felt that due to the length of time that has lapsed since the public hearing was held the following facts should be known by the Board of County Commissioners: The Public Hearing was held on September 23, 1963, at 2:30 P. M. for the Request for Change of Zone of Meadow Acres, and was taken under advisement by the Planning Commission. It was again brought up on November 12, 1963, and it was decided to table it for further study. On November 19, 1963, a field trip was made of,the area and resolution made by Price Hopkins and Seconded by John Watson. The resolution of November 19, 1963, was withdrawn and a new resolution made on December 9, 1963, which is the one now being recommended to the Board of County Commissioners. On September 14, 1964, Frank Boxberger was present and stated that they had com- pleted with the recommendations required by the Planning Commission. During the time since the Public Hearing of September 23, 1963, the Planning Com- mission felt there should have been another hearing because of the dissention of the neighbors, but legally were unable to schedule another hearing. It is under- stood by the Planning Commission that these people would like to express their disapproval at your hearing.
