FOR PERMIT APPLICATION SUBMITTED TO
U.S . ARMY CORPS OF ENGINEERS
AND
COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT
The District Engineer, U. S. Army Engineer District, Omaha, Nebraska is
evaluating a Department of the Army permit application from Andesite Rock
Company, 9065 Quince Street, Henderson, Colorado 80640 . Permits are issued under
Section 404 of the Clean Water Act which regulates the discharge of dredged or
fill material in the nation's waters.
Andesite Rock Company is requesting authorization to establish a gravel
mining operation in Section 10, Township 2 North, Range 68 West, Weld County,
Colorado.
Andesite Rock Company is planning to mine aggregate from 183 acres of the
240 acres Camenisch Resource Gravel Pit. In January 1998, Andesite Rock Company
applied for a Nationwide Authorization for two road crossings. This
authorization was granted because the two road crossings required impacting 0. 064
acres of wetlands. The mining activity will impact an additional 0 . 5 acres.
Andesite Rock Company has agreed to mitigate both impacts (0 .564 acres) during
the mining operation.
Camenisch mine will operate year-round, using dry-pit mining methods in
five identified phases (1A, 1B, lc, 2, and 3) . It expects to excavate 10-15
acres per year removing approximately 400, 000 tons of aggregate annually. The
expected mining period for this site is 8-14 years with reclamation taking
approximately 2 additional years . Temporary structures include a wash plant,
concrete plant and an asphalt plant to be located initially in the east-central
area of Phase 1C (see maps for infrastructure locations) . Set backs from Idaho
Creek and Rural Ditch will be approximately 50 feet. Idaho Creek will be
maintained by the mining operation pumping pit water from the pit into the Creek.
The applicant chose to go through an individual permit application review in-
lieu-of waiting for the Nationwide changes to take place.
The purpose of the project is to remove the necessary sand and gravel to
mix with concrete and asphalt for the construction of roads and buildings. The
original mining plan called for impacting Idaho Creek and re-aligning it once the
mining was completed. The applicant revised the plan to avoid the creek and
approximately 5 acres of adjacent wetlands. However, mining will impact both
sides of the creek to include isolated wetlands.
Approximately 0.564 acres of wetlands will be replaced near the northern
edge of Phase 1B, enhancing the existing wetland by the end of the 1998 growing
season. (see wetland map exhibit) Wetland mitigation will replace the wetland
impacts to wetlands #7 and #8 as identified in the wetland delineation and the
two road crossings of Idaho Creek permitted by Nationwide 14. Impacts to Idaho
Creek will be avoided except for the two road crossings.
Upon completion of the mining operation three lakes with the potential for
additional wetland establishment will remain.
Avoiding all the wetlands within the proposed mining boundaries was
reviewed but not accepted. Most of the site wetlands are located in the western
section (phase 1) making it difficult to avoid all wetlands.
MITIGATION PLAN:
Wetland #7 is identified as a drainage from a non-vegetated pond to Idaho
Creek and wetland #8 is a salt-encrusted low lying swale. Wetland mitigation
will replace the 0.564 acres of wetlands consisting of the small pond and
drainage that will be removed at the northern edge of Phase 1A. The mitigation
plan is to enlarge an existing wetland associated with Idaho Creek, along the
northern edge of the mining permit boundary(phase 1B) . The mitigation site will
be graded to an elevation consistent with the existing wetland. Wetland soils
from the two areas lost to mining will be used to begin the replacement planting.
Approximately 4-6 inches of root zone topsoil from the wetlands identified to be
impacted will be carefully scraped off and spread evenly in the new wetland
mitigation area. Mitigation areas will be protected from livestock grazing until
the Corps accepts the mitigation.
The US Fish & Wildlife Service has reviewed and accepted surveys for
Spiranthes diluvialis and Zapus hudsonius preblei.
Alternatives to mining this site were reviewed prior to applying for a
department of the Army Permit. Those alternatives included shutting down the
mining operation, avoiding all the wetlands within the mining area, and mining
a different site. Because the aggregate is in demand for development closing up
shop was not acceptable. Avoiding all the wetland is not acceptable because of
the location of two particular isolated wetlands and the need for road crossings.
Other locations were reviewed, however, they required impacting more wetlands
than the proposed site, the property was sold to another mining company, or the
property was not available for mining. Therefor, the proposed alternative as
described in this public notice was concluded to be the most acceptable.
The Colorado Department of Public Health and Environment, WQCD-GWPS-B2,
4300 Cherry Creek Drive South, Denver, Colorado 80222-1530, will review the
proposed project for state certification in accordance with the provisions of
Section 401 of the Clean Water Act. The certification, if issued, will express
the State's opinion that the operations undertaken by the applicant will not
result in a violation of applicable water quality standards. The Colorado
Department of Public Health and Environment hereby incorporates this public
notice as its own public notice and procedures by reference thereto.
The Colorado Department of Public Health and Environment also reviews each
project with respect to the antidegradation provisions in state regulations. For
the project which is the subject of this public notice the Colorado Department
of Public Health and Environment has preliminarily determined that this project
is not located on waters that require an antidegradation review. For further
information regarding antidegradation provisions, please contact Mr. John Farrow,
telephone (303) 692-3575, at the Colorado Water Quality Control Division.
Pursuant to the Endangered Species Act, the proposed project is being
reviewed for impacts to threatened or endangered species and their critical

habitat. Our preliminary review indicates there will be no affect, because no
such species are known to utilize the project area.
The Omaha District will comply with the National Historic Preservation Act
of 1966 and 36 CFR 800. We have checked the National Register of Historic Places
and "its current supplements", and no property listed in the Register or proposed
for listing is located in the permit area. This is the extent of our knowledge
about historic properties in the permit area at this time. However, we will
evaluate input by the State Historic Preservation Officer and the public in
response to this public notice, and we may conduct or require a reconnaissance
survey of the permit area or check for unknown historic properties, if warranted.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts including cumulative impacts of the proposed activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefits which reasonably
may be expected to accrue from the proposal must be balanced against the
reasonably foreseeable detriments. All factors which may be relevant to the
proposal will be considered including the cumulative effects thereof; among those
are conservation, economics, aesthetics, wetlands, fish and wildlife values,
flood hazards, floodplain values, land use, navigation, shoreline erosion and
accretion, recreation, water supply and conservation, energy needs, safety, food
and fiber production, mineral needs, considerations of property ownership and,
in general, the needs and welfare of the people. In addition, the evaluation of
the impact of the work on the public interest will include application of the
guidelines promulgated by the Administrator, Environmental Protection Agency,
under authority of Section 404 (b) of the Clean Water Act (40 C.F.R. Part 230) .
The Corps of Engineers is soliciting written comments from the public;
Federal, state and local agencies and officials; Indian Tribes; and other
interested parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers to
determine whether to issue, modify, condition or deny a permit for this proposal.
To make this decision, comments are used to assess impacts on endangered species,
historic properties, water quality, general environmental effects, and other
public interest factors listed above. Comments are used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement pursuant to
the National Environmental Policy Act. Comments are also used to determine the
need for a public hearing and to determine the overall public interest of the
proposed activity.
Comments, both favorable and unfavorable, will be accepted, made a part of
the record and will receive full consideration in subsequent actions on this
application. Any agency or individual having an objection to the work should
identify it as an objection with clear and specific reasons. All replies to the
public notice should be sent to the U. S. Army Corps of Engineers, Tri-Lakes
Project Office, 9307 Colorado State Highway 121, Littleton, Colorado 80123-6901.

The District Engineer will consider requests for holding a public hearing,
for the purpose of gathering additional information. Before the expiration date
of this notice, anyone may request, in writing, that a public hearing be held.
Requests for a public hearing should state specifically the reasons for holding
a public hearing, and what additional information would be obtained. Should the
District Engineer decide that additional information is required and a public
hearing should be held, interested parties will be notified of the date, time and
location.
Comments received after the close of business on the expiration date of
this public notice will not be considered.
