HomeMy WebLinkAbout970130.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 27, 1997 TAPE #97-03 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 27, 1997, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Carol A. Harding Comptroller, Claud Hanes MINUTES: CERTIFICATION OF HEARINGS: ADDITIONS: Commissioner Webster moved to approve the minutes of the Board of County Commissioners meeting of January 22, 1997, as printed. Commissioner Hall seconded the motion, and it carried unanimously. Commissioner Harbert moved to approve the hearings conducted on January 22, 1997, as follows: 1) Minor Subdivision Final Plat for a two -lot Subdivision in the 1-3 Zone District, ARC Development, c/o Doug Coleman (Planner Hodges); and 2) Resubdivision for the purpose of dividing a 2.11 -acre lot in the Etherton Subdivision, A. Michael and Rosemary A. Vetrone (Planner Goranson). Commissioner Hall seconded the motion, which carried unanimously. There were no additions to the agenda; however, item #4 under new business was moved to item #3 on the Social Services agenda. Items #5 through #20 were renumbered. CONSENT AGENDA: Commissioner Hall moved to approve the consent agenda as printed. Commissioner Webster seconded the motion, and it carried unanimously. 970130 BC0016 COMMISSIONER COORDINATOR REPORTS: No reports were given. PUBLIC INPUT: No public input was offered. WARRANTS: Claud Hanes, Comptroller, presented the following warrants for approval by the Board: All Funds $ 1,414,551.34 Commissioner Webster moved to approve the warrants as presented by Mr. Hanes. Commissioner Harbert seconded the motion, which carried unanimously. BUSINESS: NEW: CONSIDER TAX ABATEMENT PETITION FROM GS SUPER FOODS AND AUTHORIZE CHAIR TO SIGN: Warren Lasell, Assessor, stated the "Best Information Available" appraisal listed on said property was not removed after the property owner turned in his declaration schedule, thereby causing a double assessment. He recommended approval of said abatement. Commissioner Hall moved to approve said petition and authorize the Chair to sign. The motion, which was seconded by Commissioner Harbert, carried unanimously. CONSIDER TAX ABATEMENT PETITION FROM BIGFOOT TURF FARMS AND AUTHORIZE CHAIR TO SIGN: Mr. Lasell stated this petition was appealed and adjusted in 1996, therefore, it cannot be submitted for abatement this year. He stated the petition for abatement hinges on the classification of said property, noting Mary Huddleston, Colorado Property Tax Administrator, has indicated throughout Colorado operations of this sort are classified entirely as agricultural. Mr. Lasell requested the Board deny this petition, and state he will make sure the classification is properly assigned for the next appraisal period. Bruce Barker, County Attorney, explained a property for which the basis of appeal is overvaluation and which was appealed in 1996 cannot now be abated; however, he noted this appears to be under question because of the classification, not the value. Responding to Commissioner Harbert, Mr. Lasell stated this may or may not be correctly classified as commercial, he cannot determine without staffs reappraisal. Responding to Commissioners Hall and Webster, Mr. Lasell recommended the Board deny this petition and stated he will verify the classification prior to the next appraisal period. Mr. Barker reiterated, if the reason for the abatement is overvaluation and the property was appealed in 1996, it cannot be abated; however, this petition for abatement is requested on the basis of a misclassification and should be considered. Mr. Minutes, January 27, 1997 970130 Page 2 BC0016 Lasell then stated that, based on Mr. Barker's statements, he would recommend this abatement for approval, and he will look at the classification prior to the next appraisal. Commissioner Hall moved to approve the petition and authorize the Chair to sign. The motion, which was seconded by Commissioner Harbert, carried unanimously. CONSIDER LETTER AGREEMENT WITH LUTHERAN HEALTH SYSTEMS/NCMC AND AUTHORIZE CHAIR TO SIGN: Commissioner Harbert moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Hall, carried unanimously. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1986-1 - WELD COUNTY ANTELOPE HILLS: Chair Baxter called the next fifteen items to be discussed at one time. Mr. Barker noted all fifteen items concern release of liens for properties included in various Local Improvement Districts, which were paid in full during the 1996 fiscal year. He made record of the districts by name. Commissioner Hall moved to approve release of liens as listed by Mr. Barker. Seconded by Commissioner Harbert, the motion carried unanimously. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1995-1 - WELD COUNTY ROTH SUBDIVISION: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1992-1 - WELD COUNTY ROAD 32: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1992-3 - WELD COUNTY ROAD 8: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1992-4 - WELD COUNTY ROAD 38: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1993-2 - WELD COUNTY JOHNSON SUBDIVISION: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1988-1 - WELD COUNTY NORTHMOOR: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1989-2 - WELD COUNTY CASA GRANDE/ENCHANTED HILLS: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1989-3 - WELD COUNTY KNAUS SUBDIVISION: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1987-1 - WELD COUNTY INDIANHEAD: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1990-1 - WELD COUNTY 71ST AVENUE: Approved under previous motion. CONSIDER RELEASE OF LIENS FOR CERTAIN DESCRIBED PROPERTIES LOCATED IN LOCAL IMPROVEMENT DISTRICT NO. 1992-2 - WELD COUNTY ROAD 34: Approved under previous motion. CONSIDER VACATION OF FORMER UNION PACIFIC RAILROAD RIGHT- OF-WAY IN SE1/4SE1/4 S32, T8N, R62W - CASS FARMS COMPANY: Mr. Barker explained this is regarding an abandoned railroad right-of-way which was transferred to Weld County in 1978 for the purpose of building Weld County Road 392, which has recently been improved. He stated said right-of-way is no longer required for road purposes; therefore, it is necessary for the Board to vacate it. Mr. Barker stated Stan Cass of Cass Farms Company owns the property on both sides of the right-of-way; therefore, the County was required to send notice only to him. For the record, Mr. Barker noted Mr. Cass is not present. Commissioner Webster moved to approve said vacation. Seconded by Commissioner Hall, the motion carried unanimously. CONSIDER ACCEPTANCE OF QUIT CLAIM DEEDS AND GRANTS OF EASEMENT FROM CASS FARMS COMPANY AND ESTATE OF THELMA MAE CASS - S28, S32, AND S33, T8N, R62W, AND S5 AND S8, T7, R62W: Mr. Barker stated this is the paperwork necessary to complete the prior item and consists of two Quit Claim Deeds and two Grants of Easement. Commissioner Webster moved to accept said documents. Seconded by Commissioner Harbert, the motion carried unanimously. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
