Re: Case Number IISR-121'
We are writing to express our concern for two items in the development plan for Faith Tabernacle Church.
LEGAL DESCRIPTION: Lots 2 through 7, block 1,of Peterson-Alexander Subdivision;being parr of
Section 16, 15N,R56W of the 6th P.M., Weld County, Colorado.
LOCATION. North of and adjacent to US Hwy 34 Bypass Frontage Road(28th Street)east of and adjacent
to 71" Avenue(WCR 291.
Our first concern is for two ditches; a concrete-lined ditch that runs parallel to 71"Avenue and an open
ditch that runs west to east. Those ditches carry irrigation water to our pasture. In fact,they have been
serving that same function to our family's property for the last 25+years. Any developments made must be
with the understanding that the service those two ditches provide remains unchanged. That is the only
means of delivering irrigation water to our property.
Our second concern is for the future development of 26th Street east of 7l"Avenue. We hold additional
acreage east.of 71" Avenue that could be landlocked if the currently planned 26th Street layout is altered.
We would be opposed to ally substantial changes in the development plan for 26th Street.

We have several primary concerns with the change in zoning and development of
this property as proposed.
1) The #1 Boomerang Irrigation Ditch Easement:
This must be maintained and continued to be delivered to the same point,
rate, and elevation as it is currently with any changes acceptable to the
ditch right owners. This must be taken care of with a contract in place
between Faith Tabernacle and the ditch right owners prior to any change
in zoning and permit issuance. This is a contract that will address the
use of an engineer by Faith Tabernacle to address any changes to the
ditch location, physical changes, or use over or around the ditch, as
well as an engineer for the ditch right owners to assess these changes
as acceptable, (This was expressed as a neccessity by the Greeley-Loveland
Irrigation Company management, and has been expressed to City of Greeley
Planning and to Weld County Planning numerous times by Ron Brinkman. )
2) Septic System with Leech Field:
We have serious concerns with this for a high volume use situation as
this would be. Considering the clay and shale that underlies this area,
we feel this system would not be appropriate for the high volume use.
The leech field substances can very easily 'leech' into the ditch water,
carrying this to neighboring areas, where people could be exposed and
animals could ingest this. During farm irrigation season, spring runoff,
and heavier rains this problem can exponentially increase.
Connection with the city sewer system is important with this zone change
reoj:est.
3) Landscaping and screening:
With change in zoning from residential to a public higher volume use,
privacy and decrease in probability of property values decreasing need
to be addressed. Screening and landscaping are important along the east
where the residential properties lie, as well as along the frontage road.
Lighting: should not affect neighbors. As currently planned, there is not
large enough species or mature enough plants planned, with no screen or
landscaping planned for the east or north sides. Faith Tabernacle will.
will also find this to be very beneficial in their own noise, dust, and
pollution reduction.
4) Access from 28th Street:
With 71st ave. available for access to this property, access from 28th Str,
isn't necessary. This would mean a much increased volume of traffic on
28th Street, and as a result:
Safely issues - Children play and ride bikes in and around this street;
Horses are ridden in thes area; bicyclists and joggers
use this fre%uently. Safety will be seriously affected.
Congestive issue - It is a small 2 lane road with private driveways,
and the intersection to this at 65th ave. is very small
with an increased volume meaning much increased danger.
Property values - These will decrease for 28th street homeowners
as a result of the issues addressed above, as
Suality of life would be negatively affected.
71st Ave. is practical as an access to a non residential property,
as this is a main road that will also_be widened in the. future.
Granting change in zoning and permitting construction of Faith Tabernacle
needs to be contigent on an acceptable contract regarding the irrigation
ditch and with very serious consideration of the above issues. The zoning
change should not have a negative impact on the already existing neighbors
and positive peaceful area to live.
