No permanent disposal of wastes shall be permitted at this site. 2. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 3. Fugitive dust shall be controlled on this site. 4. A dumpster or trash cans shall be provided at the site during times of use. 5. The maximum permissible noise level shall not exceed 70 db(A), as measured according to 25-12-102, Colorado Revised Statutes. 6. An individual sewage disposal system, is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. A vault system is acceptable. 7. The site shall comply with Section 4.6, Water Quality Standards for Natural Swimming Areas, of the Colorado Swimming Pools and Mineral Bath Regulations (5CCR1003-5). The number of tournaments is limited to three per calendar year, consisting of no more than two days for each tournament. Unanimously approved." At this time the Central Colorado Water Conservancy District requests that more information be provided pertaining to water rights, historic use of said water rights and potential injury to senior water rights. Simpson State Engineer Dear Mr. Hodges: We have reviewed the above referenced proposal to allow a recreational waterski lake comprised of two connected oblong areas of 11 and 13 acres in an agricultural area. We previously commented on this facility in our letter of May 31, 1989. The current proposal does not appear to include any increase in water use. The lakes have been decreed for storage in water court case No. 85-CW-443. Paragraph 10 of the decree states, "This water right is subject to administration by the State Engineer pursuant to C.R.S. 37-92-502, as amended. Water shall not be impounded, except pursuant to the operation of a lawful exchange, ---less entitled to do so by virtue of the priority herein awarded. At all other times, all inflow of water from any source .eluding precipitation, shall be removed by Claimant or Claimant's successors in interest by draining , pumping or other means, and released into the nearest natural watercourse or below the reservoir, and not utilized by Claimant or Claimant's successor in interest in any manner. Claimant shall install and maintain such meters, measuring devices or other structures as may be required by the Division Engineer of Water Division 1." We recommend that the applicant confer with the water commissioner regarding the availability of water under the decreed right on a year to year basis. The plat submitted shows existing ponds on the property. The applicant should indicate the origin, purpose and operation of this pond area, since evaporation from the pond could injure vested water rights. We have no objection to the proposal contingent upon the applicant documenting that the pond will not cause injury to vested water rights. If you have any questions please contact me.
