Chris: Thank you for the opportunity to review this use by special review submitted by Richard Podtburg to allow the expansion of his existing dairy operations. Staff has reviewed the referral to ensure consistency with the City's Comprehensive Plan and presented the USR to the City of Greeley Planning Commission to offer a recommendation to the Weld County Planning Commission. Planning staff bad two major concerns with the proposed dairy expansion, both concerns stemming from the locality of the dairy. The City of Greeley's prevailing winds come from the northwest; thereby, carrying odor produced from the dairy directly into the City. Although the proposed dairy expansion is located out of the City of Greeley's Long -Range Expected Growth Area (LREGA), staff was concerned that any expansion of a dairy operation, especially one located in line with the northwesterly prevailing winds, would aggravate the present odor problem. Additionally, the Western Arterial Bypass Study designated 83n° Avenue as a four -lane major arterial with a 150 foot right-of-way. This arterial bypass will be the major connection to Windsor as well as northern Colorado. Staff noted that this study projected twenty years in the future; however, 83' Avenue, also called WCR 27, would intersect the eastern boundary of the site which might not be compatible with anticipated residential or commercial land uses that could develop alongside the future arterial bypass. The USR to allow the expansion of the existing dairy was presented to the City of Greeley Planning Commission on april 8, 1997 and they recommended that the Weld County Planning 04/14/97 13:19 TX/RX N0.700 EXHIBIT I a/ 970983 04/14/97 MON 14:16 FAX 970 350 9800 GREELEY PLANNING Z1003 Commission should approve the use by special review with the following conditions: 1. Haul routes should be identified. 2. The number of exits from this parcel onto 83rd should be limited to two. 3. The permitted use should be nontransferable to any other subsequent property owner. 4. The special use should be reviewed in twenty years or at such time urbanization takes place within 1,000 feet of the dairy site, which ever comes first.
