Subject: Certified Letter Z 193 639 724—Bearson Dairy, LLC
Dear Mr. Jiricek:
This letter is a formal response to your letter referenced above dated June 3, 1999, regarding
Bearson Dairy, LLC. As outlined in your letter,you are aware Bearson Dairy, LLC is in the
process of applying for a USR permit from Weld County. Your office received a copy of the
Comprehensive Manure and Wastewater Management Plan and designs for the facility on April
8, 1999. A second copy is attached.
The new stormwater containment pond outlined in the plan is currently under construction and
will be completed within 90 days in accordance with the State CAFO Regulations and the
attached Plan. This should alleviate any concerns regarding stormwater containment and
compliance with the CAFO Regulations.
You inspected Bearson Dairy for the USR application on April 27, 1999, immediately after the
unusual spring rains. No violation or follow-up action occurred as a result of that inspection.
Additionally, attached is a summary of Bearon Dairy's rainfall data for the period in question
outlining a 25-year, 24-hour storm event occurred on both April 1 and April 30, 1999.
As an experienced county health employee, you and your department are familiar with the
neighborhood politics that occur during the USR permit process. It is questionable that a
complaint on June 1, 1999, after several weeks of dry weather, warrants a pending discharge
violation and a Weld County response of this nature.

We respectfully request postponement of any action regarding this issue until after the Weld
County USR hearing for Bearson Dairy, LLC currently scheduled for July 7, 1999. This request
would extend the deadline in your June 3, 1999 correspondence only four days. Additionally, we
would like to schedule a meeting with you and Mr. Jeff Stoll,Director of Environmental
Protection Services., at your convenience, to discuss the series of events that precipitated this
action and our plan for improvements to the facility. weld County Planning Dept.
